Mayor Bruno’s Campaign Letter: Mail Fraud? Official Misconduct?


UPDATE
We have verified that the Bruno letter was processed through the Ravena Post Office and was delivered by U.S.P.S. personnel. We have been informed that several complaints have been sent to the regional postmaster in Albany and to the U.S.P.S. Inspector General for investigation. The NYS Board of Elections has been advised. The Office of the NYS Comptroller has been informed.

Mail Fraud or Official Misconduct?

Mayor John Bruno and his “Colleagues” Martin Case and Rocco Persico need to answer some questions about how a letter to “Occupant” got into Ravena residents’ mailboxes this past week. The letter arrived simply addressed to “Occupant” and had no stamp, no postage paid imprint, and no bulk mail permit imprint. A reliable local source not connected with neither Bruno’s or Misuraça’s campaign confirms the “rumor that the Bruno flyer was inserted in the mailboxes of residents by the mail carrier with no postage and the mail carrier advised that the Mayor had paid the post office.” This allegation has not yet been verified but the source is reliable.

We’d also like an investigation into where the letter was photocopied and whether village equipment and resources were misused for Bruno’s political campaign. That should be easy enough to prove, Mr Mayor, just produce the receipt from the copying business showing that you paid for the copies and didn’t use village equipment.

If it wasn’t the United States Postal Service mail carrier who put the letters in the Ravena residents’ mailboxes, we’d also like to know who was sneaking along Ravena village streets slipping Bruno’s letter into residents’ mailboxes. Was it a village employee? We want to know!

Either way, there’s something very fishy about Bruno’s letter distribution thing.

The Misuraca campaign did everything by the book. They used stamps or bulk mailing permits, and paid for their copying. No fraud, theft or misconduct there. Just plain honesty and playing by the rules. But we all know that’s not how Mayor Bruno or his “colleagues” Martin Case or Rocco Persico work. Ravena residents, better check your wallets!

Fraud? Maybe.

Generally speaking, a regular fraud case that would normally be prosecuted by local prosecuting attorneys at the state level can become a federal mail fraud case if the U.S. Postal Service was utilized by the accused defendant to commit the fraud. The U.S. Postal Inspectors are the agency that investigates fraud and other criminal abuse of the U.S. Postal System in furtherance of committing a crime. The mail fraud federal statute is broad based and allows the federal government to prosecute fraud and other types of cases resulting in some instances of sentences of 20 years in federal prison and 30 years in federal prison if a financial institution is the victim of a fraud.

Official Misconduct

Misconduct on the part of U.S. Postal Service employees includes misuse of Postal Service computers, destruction or theft of Postal Service property, falsification of official documents and forgery, theft of funds, abuse of authority, sabotage of operations, narcotics usage or sale of drugs while on duty, and alcohol abuse.

We’ll be contacting the New York State Board of Elections, too, to inform them of this situation and advise them that we are contacting the United States Postal Service Inspector General to request an inquiry and investigation of this incident. We think you should take the same action.

The laugh comes when you go to your mailbox and found that the mummy fairy has left a bit of really junk mail: A personal letter from the Mummy Mayor himself!

Here are some excerpts and our comments:

“”I am seeking one final term so that I can see through a number of projects and programs that the Village Board and I have initiated for the benefit of our Village”

We’ve been hearing about Bruno’s last and “final” term for the last three or four elections already. When is the “final term” finally going to come. We hope this is his final term and that he’s out on the street on March 18th; that’s what we all hope. Bruno has a “number of projects and programs” that he wants to see through, but he doesn’t tell us what they are. Damned, his next project must be to finish the job of destroying the village of Ravena. Anybody know of any missing nukes? What’s his next project, poisoning the water supply?

I ask that you look at my record and that of my colleagues. When you look at our accomplishments, I am confident that you will decide that I have worked hard to improve our community while minimizing the cost of village government and keeping taxes low. I hope you will give me the opportunity to finish what I have started.

This guy is either psychotic or has entered the terminal stages of senile dementia! He’s starting to really scare us now! He’s asking us to look at his record,  his accomplishments?!? Is he referring to Main Street, Ravena, and the ghost town he and his “colleagues” have created? The empty Teen Center building? The ruined streets? What are his “accomplishments”? We know about the “Black Mamba” and his record of corruption and bullying. And where’s all of the improvements? Anyone know or see something we’re missing in Ravena? The biggest fright is when you read, “I hope you will give me the opportunity to finish what I have started.” That is really scary…and we’re worried about terrorist attacks? We feel threatened by Russia? The biggest threat to Ravena’s future is John Bruno!

Bruno admits to having raised village taxes but then goes on to say, “I want to continue to improve our infrastructure so that development can continue to occur in the Village.” We’re really confused when Bruno writes, “so that development can continue to occur in the Village.” Bruno must be hallucinating. He must have found the cache of Coeymans police officers’ pot and has been helping them to dispose of it….damned fool is smoking it! Dear Bimbo Bruno: THERE IS NO DEVELOPMENT IN RAVENA! YOU KILLED THAT YEARS AGO, when you still had a badly impaired but still almost functioning brain!

The man has lost it completely when he writes:

 “I am especially pleased with the improvements and increase in services we are providing to youth and seniors in particular.”

Wasn’t it John Bruno who was persecuting the young people in Ravena when they were hanging out around the aazebo on Pulver and Main Street. Wasn’t it Bruno and Warner who were patrolling the gazebo and sending the Coeymans police to harass the kids? Wasn’t it John Bruno and his lackeys Warner, Case and Persico who harassed the Ravena-Coeymans Youth and Teen Activities Center until it had to close down? Bruno and his lackeys Warner, Case and Persico didn’t offer a dime to support youth in Ravena-Coeymans; in fact, they did everything they could to throw Ravena-Coeymans youth out on the streets again! Excuse us, Mr Mayor, but you are full of proverbial bullshit!

Bruno has the old-man’s balls to actually bring up the Ravena Health and Fitness Center, his personal gift of a playpen to bottle-blond bimbo Cathy Deluca. The bet is that she can manage Ravena taxpayers’ money into a third fitness club failure. Everybody in village hall gets a little of the Ravena taxpayers’ sugar: Bob Fisk gets to sell his scrap equipment after Cathy Deluca closed his fitness center ($40,000 of taxpayer money. Thank you, Mr Mayor.) Then they evict the RCS Community Library after raising their rent an outrageous additional $600 a month to force the library out. Then Bruno and his lackeys Warner, Bailey and YES! Martin Case and Rocco Persico allocated another $105,000.00 in taxpayer money to finance Cathy Deluca’s playpen for 2014. The Ravena Health and Fitness Center doesn’t pay rent for the space like the community library did. Doesn’t pay for utilities, either! But it’s spending tax dollars and Cathy Deluca is cashing in to the tune of $30,000 plus full benefits. The membership numbers just aren’t there to break even. Bruno’s money pit; Deluca’s cash cow. Ravena’s open sore.

“We have reached out to building owners and I want to work with to find new tenants and opportunities for Main Street. I am also working with Senator Tkaczyk and Assemblyman Lopez to ensure that CSX Rail replants trees along Magnolia Circle and operates as safely as possible when passing through Ravena.”

We are really at a loss for words when reading this pile of bullshit. Is Bruno so far gone, so out of it, so out of touch with reality that he actually thinks that anyone who lives in or near Ravena believes this blather he’s writing? “Reaching out to building owners?” “New tenants and opportunities for Main Street?” But anyone who has been following the CSX conspiracy, especially the residents along Magnolia Circle, those residents who are already living on top of a railroad toxic waste dump (Know about the transformer waste buried there? Ask Mr Bruno about it.), who woke up one morning to find that CSX had done some landscaping for them. Bruno claimed he knew nothing about it? If you believe that, neighbors, I’ve got a bridge you might want to buy. Cheap.

Letter to the Editor: Ravena Damage Control

On occasion, some readers’ comments are just so good and so on-topic that we think they should be published on their own as free-standing articles. With this in mind, we’ll be publishing what we call “Letters to the Editor,” similar to those you’d read in any of the local rags, but much more informative and honest, of course.

This letter-to-the-editor is one of a two-part series that we think you’ll really enjoy, especially in this pre-election run-up period in Ravena. When reading these letters, you may want to ask you why these commonsense actions haven’t been taken already by the incumbent Bruno gang. They’ve had several decades to to it but haven’t done a damned thing. So here goes!

In response to your email, following you will find the two postings I finally posted today. Hopefully people will take a look.
I had also recently posted two others. Thanks for what you do.

Hi Again and Thanks for the opportunity to post here.
 
I am happy to see a contested race for Mayor of Ravena-the residents deserve it.
I am writing this-long overdue-as a possible hot potato in the current Mayoral and Village Board races.

No matter where we live, it would be great to see municipal property be returned to the tax rolls, minimize governmental use of property, see some good old fashioned common sense applied to the way our governments are run-they are ours, after all!

Close to home, I suggest the following:

 1.         The Village of Ravena Public Works Department relocate from the West Shore Street location to the area near the former landfill at the end of, I believe, Edna Avenue, where the Village maintains ownership of the property. Of course they would need to erect a building to house the equipment but that would be a small price to pay to have such desirable Rail Road siding property put back on the tax rolls and offer business a chance to have at it. Location-wise, there probably is not that much difference in miles traveled and the Edna Avenue property would be put to good use, that is, being occupied.
 
2.         The Town of Coeymans should approach the Village of Ravena petitioning for the Village to contract with the Town. Residents outside the Village could receive services already afforded Village residents, like grass and brush pickup, stump removal along the right of way and the like. The Village could use the income and the residents could use the service. The Village already has the equipment so the cost should not be too much.
 
3.         The Village should divest itself of the property on the corner of Main Street and Pulver Avenue and return it to the tax roll. The assumption here is that the property ‘belongs’ to the Village and if it does not, then the grotto-like structure there seems to indicate it does and should be removed. Nothing else need be said here.
 
4.         Both the Village and the Town should have a ‘must bid’ local law on the books for all products and services to assure the residents are getting the best value for the least money.
 
5.         The Village and the Town need to work with the County and/or the State to find a solution to the necessary for business heavy truck traffic on Main Street—nothing is being done by the Village or the Town, and it is only a matter of time before the unthinkable happens. The current Village parking lots on Central Avenue and on Main Street at least give those who have to walk the last mile to their destination a chance but a more basic idea is needed. As mentioned, the truck traffic is necessary for business, but it is surely not suited for a very narrow and curvy Main Street.

We have to ask what the John T. Bruno and his flying monkeys have been doing all these years. We know and you know, so what’s the use of asking a question we all know the answer to? Bruno’s been in office for more than 20 years and his rat-pack in the last decade or so have done NOTHING except intimidate, tax, retaliate, drive out residents and businesses, and pad their friends’ pockets with plum jobs (like Cathy Deluca and the Ravena Health and Fitness Center a.k.a. Cathy’s Playpen) at your expense. Up until now, the town of Coeymans board has been almost as bad but the Coeymanazi police department has taken up the slack, and has been draining the town of Coeymans for a bundle, and then the crooks retire and get pensions you pay for; the Coeymanazi p.d. has even collaborated with the Bruno mob. Ravena can’t take much more without dropping into the river. That’s why Ravena voters have to put a stop to the stupidity and put Bruno, Case and Persico on the street. Next year voters can make housekeeping complete by dumping Nancy Warner and Bill Bailey. Only when you fumigate the house and get all the vermin out will there be any chance at all of revitalizing Ravena. One of the first steps to be taken by the new Ravena administration is to close that money pit, the Ravena Health and Fitness Center! and send Cathy Deluca packing or to jail (she’s still got to answer for civil rights violations and falsely reporting an incident)! That $100,000 plus can be better spent elsewhere!

Pundit is a frequent commenter and reader. We think he’s been in local government in the past because he knows an awful lot about the people and events. He also thinks like a good administrator should think. But we’d like to hear what YOU think about Pundit’s letter. Please leave a comment.

Do We really have to fill in the blank for you?

While we do not condone campaign sign vandalism, one Ravena resident was very clear in his/her opinion of the Bruno-Persico-Case ticket! (Can you fill in the missing letters?)

Bruno-Case-Persico campaign signs peppering (just lightly, though) Ravena tell voters to “Vote Row A“. Any ideas what the “A” stands for? (Hint: Please refer to the sign on the left.)

Here’s the clincher: both of these signs, including the “annotated” one, are on the corner of Russell Avenue and Main Street in Ravena, within a couple of hundred feet of the Coeymans police station in Coeymans town hall! What does that tell you about the efficiency and attention level of Coeymans’ finest? Answer: DUH!!!!

Seems Ravena Mayor John Bruno and his flying monkeys can monitor and videotape everying going on in and around the Ravena village offices but can’t keep factual comments off of their campaign signs. Same is true of Coeymans police chief Gregory “DoDo Cop” Darlington, who has cameras everywhere in and around Coeymans town hall but can’t prevent vandalism a couple of feet down the street! What a bunch of clowns!

It’s Election Time Again and They’re Out For Your Vote,  In the Local Rags and They’re Knocking On Our Doors—and it’s not Trick-or-Treaters!

But Who Are They, Anyway?!?!?

The problem is that we know only those incumbents who we see on public access television, thanks to our one-horse-town cable provider, MidHudson Cable, who is in their pockets, too. And what we see is not very easy on the stomach. It makes the Three Stooges look like rocket scientists. Compared to the Ravena village council, the Coeymans town board, and the New Baltimore flea circus, the Keystone Cops look like Nobel prize laureates.

Most voters fool themselves into thinking they know something about them because the local rags publish their statements, statements written by the candidates’ keepers or by the candidates themselves but does anyone really read them? Sure, curiosity compels us to read them but they’re so full of misinformation it makes you want to puke. They tell us only what they want us to know and that’s not much and what there is, is—well, pig-in-lipstick.

What we need is to know is what we want to know…

complete and utter bullshitDid you know that village hall and town hall don’t have résumés for their board members? No, they don’t. And they don’t require them either. So if you wanted to know about a board member’s education, employment, previous employment you wouldn’t be able to find out. Is that fair?

All you get to know about the candidates is that they’re running, which political party is supporting them, and what they want you to know.

We say: Get them all into village hall and town hall and let’s have a town meeting. All of the candidates together. Let the community ask the tough questions and get the answers in person, on the spot, and on public access TV so those who can’t make it to the meeting can see and hear.

Let’s ask them directly about who they are, what they know about the community, what they’ve done, what their experience is, what their education is, and some burning questions that they’ll have to answer now and produce results if they are elected.

For example, I would like to ask Susan O’Rorke, town supervisor for the Town of New Baltimore, about the town purchasing policies and about the purchase of a new truck for more than $100,000. I’d like to ask Susan O’Rorke how and why she lost the Independenc Party’s endorsement and why her petition signatures were disqualified. I’d like to know her take on why she got only 4 votes in the primaries.

I’d like to know what Diane Jordan’s education and qualifications—we mean other than the fact that she’s an insider and married to the New Baltimore Highway superintendent, Denis Jordan— are to be tax collector. And I’d like to know the same answers from their opponents.

Two other insiders are running for town board seats in New Baltimore: Angelis and Schrauf. These two are closely connected with the lunatic fringe in New Baltimore and are members of the Insiders Club. Control freaks. In fact, Schrauf was rewarded for her club activities by being made the director of—you’re not going to believe this title—Director of the New Baltimore Farmer’s Market! It’s a paid position in New Baltimore. You know somethng’s got to be fishy when they give someone a title like that!  Now, would you want anyone with a title like that and a member of that elitist club to be making decisions about your life and family? The gender-ambiguous Angelis is in the community but not of the community; she belongs to the Ross-Knighton-O’Rorke-Conservancy club. Now you know for sure why Angelus can’t be considered as a potential New Baltimore town boad member. If you put the names Schrauf and Angelis together you get DISASTER! Please don’t try it!

We’re curious also why Angelis and Schrauf don’t use their first names on their campaign signs; you’d think they were trying to hide the fact that they’re women. If anyone can come up with a better explanation, we’d love to hear it.

I’d like to ask Michelle Maddage, running for Coeymans town clerk, how many years of experience she has in a town clerk’s office. I’d like to ask Ms Maddage about her work experience and her education. I’d like to ask her some specific questions on the town clerk’s jobs and test her knowledge of municipal law, freedom of information law, etc.  I”d like to ask Ms Maddage how much experience she has serving on municipal boards. But most especially, I’d like to ask Ms Maddage about her relationship with Coeymans police chief Gregory Darlington, and I’d ask Mr Darlington why he pushed Michelle Maddage to run for town clerk, a position for which she has absolutely NO QUALIFICATIONS or EXPERIENCE WHATSOEVER!!!!

Still in the town of Coeymans: I’d like Mr Thomas “Tom” Boehm to tell us exactly what he’s done to bring new business to the town of Coeymans (and I don’t mean the dust factory on Rt 144 that’s clogging everyone’s lungs, air filters but is a God-send for Flach’s car wash!). What exactly has Mr Boehm done for Coeymans besides make life miserable for people in Coeymans town hall and keep a chair warm with his fat ass? Mr Boehm, we need you to appear at a meet the candidates event, stand up at the podium, and tell us about your record!

And Ms Dawn Rogers: You need to get a real life, a real job, and some real friends. You are about as effective as tits on a bull. You’re about as visible as the spaces between these words. What in hell do you do on the Coeymans town board, anyway? What we need to know is: “Are you really alive?” Rather than FOIL reams of board meeting minutes, maybe if you appear at a meet the candidates event, take the podium and expose yourself to open questions from the community, we’d have a reason to vote for you, or not to (which is more likely). Come on, let’s go public!

We’d ask also why George Dardiani, the traffic ticket collection agent for the town of Coeymans masquerading as a town justice, even bothers to waste money on campaign signs. When we can’t even start to speak of qualifications and Dardiani in the same breath; he has none. No one wants the dull-witted job enough to run against him. He’s running unopposed; in other words, you’re not really voting or making a choice when it comes to “electing” a town justice. Best thing to do is don’t even waste your time pulling the lever or checking off his name. The fewer of us that give him the satisfaction of putting his name on the rolls the better; at least he won’t have the numbers.

The village of Ravena is so corrupt and such a mess we don’t even want to get involved in discussing the favoritism and unsavory business that goes on there. But Coeymans has been infected with the favoritism bug. You have the chief of police, Gregory Darlington hiring his daughter and other kids of friends to work as police dispatchers. What’s wrong with the rest of the community? You have Cathy Deluca hiring her favorites and relatives to work inthe Ravena Health and Fitness Center. What’s wrong with the rest of the community? You have Dawn LaMountain in the Coeymans police department as Darlingtons “confidential secretary” (Darlington got the Coeymans town board to approve hiring Kerry Thompson, too, to be Darlington’s administrative assistant at a cool $31+/hr*) and you have her rotund son getting hired to be a police officer (trainee) in the same department. Now you have LaMountain’s husband, George LaMountain, running for Town of Coeymans Highway Superintendent! How many LaMountains do we need in Coeymans town hall?!?! Is the Coeymans town hall turning into a members-only country club, like the village of Ravena or New Baltimore?

We won’t waste space here because we’ve dedicated an entire article to Martin “Marty” Case and his handlers in Ravena village hall. Dubbed the Tipsy-Teacher because of allegations that Case took to partying while chaperoning a group of RCS students to Washington DC, we’d like to get case in front of a community group and ask him a couple of questions. Wouldn’t you? By the way, Marty, the town supervisor position is a full-time position. We’d like to ask you how you’ll manage a full-time teaching position, the town supervisor position, and don’t you also sell real-estate with Josie Bruno at Prudential real estate? How ya gonna do it all, Marty?

NYS Comptroller’s Audit Slams Coeymans Board for Financial Mismanagement; Ravena Doesn’t Pay its Sewer Bill

The New York State Comptroller’s Office Released its Findings Today on its Audit of the Town of Coeymans Financial Recordkeeping and Cash Disbursements

Village of Ravena Cited for Causing Enormous Revenue Shortfall and Capital Expenditures in Coeymans

While the Comptrollers auditors cite a number of discrepancies in the town of Coeymans’ financial recordkeeping and checkwriting practices, it specifically cites the village of Ravena’s failure to pay its fair share of sewer billings because of Ravena’s “over the Town’s cost allocation method and costs incurred for sewer-related capital projects.” This forced the town of Coeymans to dig into the town general fund to compensate, which caused a cascade of problems.

According to the Comptroller’s report:

As noted in our prior audit report,1 the sewer district fund ended 2009 with a fund deficit of about $590,000 as a result of a shortfall in operating revenues. This shortfall was caused by the non-payment of sewer charges from the Village of Ravena (Village) resulting from a dispute over the Town’s cost allocation method and costs incurred for sewer-related capital projects that should have been accounted for in the capital project fund, rather than the sewer district fund. As a result, Town officials made substantial interfund advances to the sewer district fund from the part-town general fund to finance the revenue shortfall and capital expenditures. (Report, p. 7)

The sewer district fund’s liability originated in the years prior to our audit period. The sewer district fund’s finances were severely impacted in 2009 due to a substantial shortfall in operating revenues because of the dispute with the Village over the Town’s cost allocation method and costs incurred for sewer-related capital projects (previously discussed). (Report, p. 9)

The report goes on to say that the town of Coeymans did not accurately report the actual condition of the sewer district fund with serious consequences:

Although the financial condition of the sewer district fund has been improving and is better than originally reported, the failure to accurately report this information increases the risk that the Supervisor and Board will not be able to effectively evaluate and manage the Town’s financial activities. (Report, p. 9) [our emphasis]

The town of Coeymans’ financial reports do not correctly report the real financial condition of the sewer district fund. Coeymans 2011 annual financial report reported an unrestricted fund balance deficit of $230,368 in the sewer district fund. This balance was incorrect because there were costs incurred for other capital projects that were incorrectly accounted for in the sewer district fund instead of the capital projects fund and the sewer district fund included an interfund loan to the capital projects fund that was, in effect, uncollectible because that project had been closed. If the necessary adjustments were made to the accounting records, The Town would have reported a positive fund balance of $451 in the sewer district fund instead of the negative $230,000. According to the Comptroller’s report:

General Municipal Law states that moneys advanced between funds are to be repaid as soon as the funds become available, but in no event later than the close of the fiscal year in which the advance was made. While the use of an interfund advance is a permissible form of short – term borrowing to meet current cash flow needs, it is not intended to be used as a long-term approach for providing financial resources. (Repport, p. 9)

This situation highlights why it is important to maintain accurate and complete financial reports so that the Board can determine the financial condition of a fund at any point in time. Without accurate financial information, the Board cannot effectively evaluate and manage the Town’s financial activities. (Report, p. 10)

The Comptroller’s auditors also found serious problems in the town of Coeymans payroll practices, lack of supervision of the payroll clerk’s operations, and failure to secure the towns check stock! Here’s what the auditors write:

An important component of any internal control system is proper segregation of duties over cash disbursements, which ensures that no one person controls all phases of a transaction. Concentrating key duties (such as authorization, recordkeeping, and custody of assets) with one individual with little or no management oversight through increased supervision significantly increases the risk that errors or irregularities could occur and go undetected. (Report, page 12)

That’s what the auditor’s found happening in Coeymans: one person has control over everything — just like in the village of Ravena and the town New Baltimore — which “significantly increases the risk that errors or irregularities could occur and go undetected.” Sounds like common sense, doesn’t it? Well, maybe someone should ask Mr Thomas Boehm, Mr Thomas Dolan, Mr Peter Masti, Ms Dawn Rogers why commons sense is in such short supply on the Coeymans town board? Didn’t the residents of the town of Coeymans elect the Gang-of-Four to keep an eye on things like this? Instead, they go ahead and cooperate with the village of Ravena on Ravena mayor John Bruno’s Make-Us-A-Ghost-Town Project or to rename the town Reubenville! Dumb as a box of rocks!

Actually, from where we’re sitting it looks like the only “significant irregularities” that have happened have happened in the voting booths: somehow Tom Boehm, Tom Dolan, Peter Masti, and Dawn Rogers got elected. Same “significant irregularities” happened in the village of Ravena when mummy-mayor John Bruno, the wicked witch-on-a-stick, Nancy Warner, and the Ravena Flying Monkeys, William “Bill” Bailey (a.k.a. “Ravena Mumbles”), Martin “Marty” Case (a.k.a. the “Tipsy Teacher”), and Rocco Persico (a.k.a. the “Shrinking Shrink”)  got elected! And don’t sit there sniggering, New Baltimore, you’ve shot yourselves in the foot with your painted piglet Susan O’Rorke and Chris Norris (Didn’t he get early retirement for mental problems? Says it was because of 911 but the record allegedly shows he was on vacation when 911 occurred!). But more on New Baltimore later. Much more!

The Town’s payroll-related costs total almost $3.2 million per year. Therefore, it is essential that management design and implement effective controls over the payroll process comprising well-developed practices and procedures, adequate managerial oversight, and proper segregation of duties. (Report, p. 12)

There is an inadequate segregation of duties because of the payroll clerk’s over-involvement in the payroll process…As a result, there is an increased chance that errors or irregularities could occur and not be detected and corrected in a timely fashion. (Report p. 12 – 13)

In plainlanguage this means that the poor recordkeeping and lack of supervision of Town of Coeymans financial activties can’t detect who’s thieving or where. This same lack of recordkeeping and lack of supervision by the town of Coeymans town board is what we’ve been writing about with regard to the Coeymans police department and so-called chief Gregory Darlington. With almost every step the town of Coeymans town board members have tripped over their own feet and have failed the people of this town. (It seems the only two people in Coeymans town hall with any sense of duty or common sense are Diane Millious, the town clerk, and town supervisor, Stephen Flach, but they’re outnumbered at least 3-1 by the rocks-in-a-box, Boehm, Dolan, Masti, Rogers, and Darlington and his thugs!)

One problem common to both the town of Coeymans and the town of New Baltimore is a legal-lesion known as a David Wukitsch, who acts as town attorney for both towns. Wukitsch is about as useful as a one legged man at an ass-kicking contest or pants on a hooker! Wukitsch’s legal advice has caused both towns more legal problems than it has prevented. We’re preparing an article on the town of New Baltimore and some of the craziness that Susan O’Rorke and her flying monkeys have cooked up, and David Wukitsch is right there to provide the worst legal advice available, second only to David Soares’ legal ignorance.

So, there you have it. The New York State Comptroller’s auditors confirm what we all knew in our deepest places what is true: We’ve elected a bunch of rocks to oversee taxpayer dollars, and that box of rocks can’t even put common-sense safeguards in place to ensure that you’re either not robbed blind — which is the case in the village of Ravena and very likely the case in the town of New Baltimore as it now stands — and the vile, hateful bunch of incompetents on the Village of Ravena board want to ship their shit to Coeymans and then default on the bill. Problem is, the town of Coeymans can’t even do the simple math or keep their beans in the proper boxes so Coeymans residents don’t have a clue how much or how little or where it is!

The Ravena Health and Fitness Center has been surrounded by controversy and accusations of wrong-doing since Day One. In fact, the place gets deeper and deeper into trouble as time goes on. As you’ve read here—but not in the News Herald or the Times Union, of course—all about the financial misconduct, the administrative misconduct, the hiring misconduct, and the list goes on. So why would the Ravena News Herald or the Times Union pick up on a scandal story abour their cronies? The point is: They wouldn’t and you’d still be in La-La Land thinking everything is just peachy–just like you’ve been doing for decades while village of Ravena mayor John Bruno, village of Ravena trustee Nancy Warner, Coeymans Police Department employee Gerald “Dirty-Hands Jerry” Deluca, village of Ravene unlawful employee Cathy Deluca, town of Coeymans “runaway bunny police chief” Gregory Darlington and their mob rub their hands together just so impatient to get their pice of the action. Well, last month, even before the Ravena Health and Fitness Center officially opened its doors, Cathy Deluca opened her big mouth and got herself and the village of Ravena into a bit of a pickle. As a result, a Notice of Claim was filed against the village of Ravena, Cathy Deluca, and the Ravena Health and Fitness Center. It’s the first step before the lawsuits.

But the dirt doesn’t stop there. It appears the Cathy Deluca had no sooner blabbed her way into a lawsuit but she then reports an incident to her little friends down at chubby-hubby’s Coeymans Police Department, alleging that she’d been harassed and stating false facts. This is a misdemeanor crime in New York state. Well, her plan to get an innocent party into hot water backfired on her. Sorry, Cathy!

What’s worse is that she apparently managed to get an employee of the Ravena Health and Fitness Center to lie along with her. That’s another felony/misdemeanor called conspiracy. You see when you plan to commit a crime and get someone to help you out, whether that someone knows what you’re doing or not, that person is involved in a conspiracy. So, Cathy D. apparently got an employee of the Ravena Health and Fitness Center under her control and supervision, a Claude A. Wheeles, to allegedly corroborate her lies to the Coeymans Police Department.

Well, the fact that falsely reporting an incident to law enforcement and causing law enforcement to investigate something that never happened is a serious crime. So is getting someone to collaborate with you in that crime. And that’s apparently, or at least according to the papers filed with the Coeymans Police Department allege that Deluca did.

What Cathy D. and her little helper, Claude A. Wheeles,  didn’tknow is that the entire incident was caught on tape and that recording was recently turned over to the Coeymans Police Department as evidence that Cathy D. and her alleged co-conspirator Mr Wheeles lied to the police about the incident they alleged to have happened at the Ravena Health and Fitness Center.

According to the papers we have, that resulted in a second Notice of Claim, in addition to the first one served on the village of Ravena, the second one alleging that Cathy D. committed the crimes of falsely reporting an incident to law enforcement and conspiring to do so. Now the village of Ravena has to answer for a second, now criminal, complaint against the Teflon-Tootsie.

Question is: Do We Go After the town of Coeymans, the Coeymans Police Department, Gregory Darlington on Civil or Criminal Charges Stemming from Indifference and Negligence, and Incompetence to Obstruction of Justice?

Of course, the Coeymans police department, the very place where the Teflon-Tootsie’s chubby-hubby, Gerald “Dirty-Hands Jerry” Deluca works as a so-called police investigator, is dragging their dung-stained heels on the investigation. Darlington, the so-called chief of the Coeymans Keystones, hasn’t responded to any of several letters concerning the case. And the Complainant has warned Darlington and his minions that chubby-hubby Jerry Deluca had better be kept far from the investigation of his wife and had better not have access to any investigation information or any of the evidence provided or gathered.

Darlington, himself, because of his mismanagement of the department and his indifference to citizen’s complaints and inquiries has set himself up for disciplinary action and he’s only making it worse for himself by refusing to respond to the Claimant’s requests for updates and callbacks to take the Claimant’s statement.

The village of Ravena and the Albany County Civil Service Department are also under fire because of the way the village of Ravena requested creation of a new civil service job title for Cathy Deluca and saying that the positon should be classified as “exempt“. That means that the village of Ravena claims that the position would not be suitable for classification as a “competitive” position. Does that surprise anyone?

The so-called director of the Albany County Civil Service department, Michael Cummings, is on the hotseat for approving the position without the necessary paperwork or explanations. His last response was that there was “clerical error.” Bullshit, Cummings. You’re incompetent and in cahoots with your crooked friends in Ravena! Well, Cummings and mayor John Bruno with his hatchet-woman Nancy Warner and Cathy Deluca  thought the whole filthy affair would never get discovered and they’d get away with their little conspiracy. They still haven’t learned that things are different now. We find things out and they get published.

Cummings got caught with his pants around his ankles on this one and there will be a lot of questions to be answered when this gets to the New York State Civil Service Department, to the Office of the NYS Comptroller, and to the Office of the NYS Attorney General with all of the exhibits and demands for investigation and prosecution. No Cummings, Bruno, Warner, Deluca, it isn’t over by a longshot.

Let’s see: Ravena Village Clerk. Isn’t the office of the village clerk an elected office? Let’s ask Kristine Biernacki or Annette Demitraszek, they should know, right? Actually, anywhere else, the village clerk would probably be elected. But not in Ravena! Village law allows the mayor to appoint and the village board to approve the mayor’s appointment to the office of village of Ravena Clerk. Smell INCEST here?

Ravena Village Trustee Nancy Biscone-Warner. Isn’t the office of village trustee an elected office? Well, is it Nancy Biscone-Warner? And what about the office of the mayor of the village of Ravena, that’s an elected office, isn’t it? Well, isn’t it John Bruno? Well, aren’t public servants, elected officials supposed to serve the community? Aren’t they supposed to serve the best interests of the community who put them in office? Well, can anyone tell us why Demitraszek, Biscone-Warner, Bruno are doing their best to stonewall? What are they trying to hide? Wouldn’t you think they could come up with the documents and the figures for the village of Ravena’s legal expenses? It’s public information after all!

Committee for Open Government (NY Department of State!) and Robert J. Freeman.  Nancy Biscone-Warner is really working hard to keep it all under wraps, even upstaging the village clerk Demitraszek and passing on misinformation to a club member at the Committee for Open Government (now that’s a joke!), attorney Robert J. Freeman, who plays their cute little game with them. The incest club hard at work. Well Robert J. Freeman is a political appointee and has been occupying the executive director’s office of the Committee for Open Government for more than 36 years! Isn’t there something wrong with that? It sounds like somebody’s getting rewarded for some hefty favors, doesn’t it? Sorta like our own little nest of thieves rewarding Cathy Deluca with the Ravena Health and Fitness Center and the position of director. Right Nancy Biscone-Warner? Must be Nancy’s “Biscone” showing through. Right, Nancy? Stinks of raw sewerage from Albany all the way down to Ravena village hall. And you’re paying for it all…through the nose!

The Request to Disclose Legal Fees Paid to Attorneys Between 2000 and 2013.

We have acquired documents served on the village of Ravena under the provisions of the New York State Freedom of Information Law (F.O.I.L.) that demand that the village of Ravena produce documents showing the amount and the recipient of legal fees and payments. In short the demand for disclosure and production of docments read:

“For the period of on or about January 1, 1990 to on or about January 1, 2013 all invoices, statements, requests for payment, expense reports, demands for payment, or vouchers, or such documents that otherwise authorize or show payment in an amount certain for legal services provided by the law firm or partners or associates of the law firm of Michael J. Biscone or the law firm of Biscone and Neri, or Louis Neri, Esq., or Michael J. Biscone, Esq., including but not by limitation any compensation for activity as a public official for or on behalf of the village of Ravena.”

Other parts of the F.O.I.L include similar requests for payments made to Joseph C. Rotello or any law firm of Joseph C. Rotello, or Joseph C. Rotello, Esq.; the law firm of John T. Biscone or any law firm of John T. Biscone, or John T. Biscone, Esq.; the law firm of Gregory Teresi or any law firm of Gregory Teresi, or Gregory Teresi, Esq., and further requests

“Please note that if the particulars (the attorney invoice number, the matter number, or the substance of the matter) of the service for which payment is requested is not stated in the voucher, this request also demands production of any document specifically identifying the specifics of the service (such as the attorney invoice) for which payment is being authorized but not the documents memorializing the matter itself.”

Having served the F.O.I.L demands, the requestor adds:

“Please find attached my demand for disclosure under the provisions of the NYS FOIL.
“Please contact me promptly if you have any questions relating to this demand.”
The first village of Ravena response received by the citizen making the request reads:

“Please be advised that your request for legal services payments does not reasonably describe records in our possession because our vouchers are fiiled in chronological order not by subject.” (Kristine Biernacki, Village Clerk)

Isn’t that interesting? The request for “legal services payments does not reasonably describe records” in the village of Ravena’s possession.”  And why? Because the village of Ravena’s filing system is in “chronological order not by subject.”  Now, we’re not talking the Borough of Manhattan, we’re talking about receipts and vouchers for legal services paid by the village of Ravena. But you see where this is going, don’t you?

The requestor replies:

“The FOIL is not required anticipate, to comply with or to allow for record-keeping idiosyncrasies of the custodian of the demanded records; the fact that you state that records particularized and specified in the FOIL might represent a “request for legal services payments [that] does not reasonably describe records in our possession” is clearly insufficient grounds for refusing to produce the documents demanded in the FOIL. The fact that the village of Ravena maintains its payment vouchers chronologically does not reasonably represent an absolute impediment or imppossibility of production whatsoever. It simply means that your search will necessarily have to be made chronologically in the absence of a more crossreferenced or alternative system of records keeping. That has no bearing whatsoever on the demands of the FOIL in question. [emphasis provided]
Not having heard a peep from the village of Ravena, the requestor writes:
“Can you please provide an update on the progress of your fulfillment of the production demand of the amended legal fees FOIL.”

Ravena village clerk Kristine Biernacki replies on March 19, 2013:
“I am extremely busy right now collecting for Village water/sewer bills and I am working alone now with a part time person,  so it will be some time before I am able to fulfill your request.”

Reading between the lines: I’m too busy right now collecting money for mayor Bruno to waste my time complying with state of New York laws.

The Requestor writes back:

“Thank you, Kris, for the heads-up. I appreciate it. 
“Please do keep me updated.”
Sounds friendly enough, right. First the village tries to get out of producing the records because they claim the request doesn’t reasonbly describe the records being requested. Now, they are saying that they can’t get to it because they’re collecting water and sewer bills. All along, the requestor is obviously patient and courteous.
 
So, along comes April 1, 2013, and the deadline for the village’s response is just days away, and the requestor contacts the village:
“I am following up on the production in response to my foil below. 
“Can you please provide a date certain when you expect to have the Village’s response ready?”
Are you getting the feeling somebody’s getting the run-around? I do!
So April 10, 2013, rolls around and the requestor has to write again:
“I need to know when I can expect the information demanded in the legal fees FOIL.
” I am willing to wait until Friday, April 12, 2013, 12:00 noon for the full response; after that, I’m afraid I shall have to presume that the village of Ravena is refusing to comply with a lawful demand, and I shall submit a complaint to the Office of the State Attorney General together with a request for investigation. 
“My last two emails have gone unanswered and I presume that to be the village’s attempt to avoid responding.”
So, on April 11, 2013, over a month after the request was made, and after several excuses already, Kris Biernacki writes:

“I am not able to provide you with most of your FOIL request regarding legal services payments due to the fact that they can not be reasonably obtained.  However, with respect to the records that can be accessed,  I will provide them to you by August 2, 2013.”

Flabbergasted at this incredible response, the requestor writes:

“Am I reading this correctly? Are you telling me (1) that you can’t provide the village of Ravena’s records for legal expenses? That they are cannot be “reasonably obtained?” and (2) that the records that can be accessed can be provided by “August 2, 2013?” Or is that a typo?”

Biernacki writes back, now she’s telling the requestor that Mr Robert Freeman of the Committee on Open Government (Yeah! Right!) is telling her:

Per Robert Freeman, Executive Director of the Committee on Open Government, your demand for the legal services payments dating back to 1990 is not a reasonable request.  The recent information that I can access will be provided to you by the date stated.

So, the requestor, patient and cooperative as always, writes:

“You could have said that earlier. I am amending the request to 2000-present.
” Notwithstanding the amendment, I have been extraordinarily patient in working with the village of Ravena, and agreed to extend on your request for more time because were involved with sewer and water billing. 
“In future and in the case of any future FOIL demand, I would expect the courtesy of a timely response and timely advice if you or your office find a request unclear or “unreasonable.” The handling of this request has been unacceptable.”
 In order to make it easier, the requestor knocks off 10 years and sits back waiting for the next excuse. He doesn’t have to wait long. Kris Biernacki writes:

“This is in receipt to your FOIL amendment.  Again, I will have the information to you on or before August 2, 2013.”

The village of Ravena is saying that it will need more than 114 days to find it’s records on payments made to lawyers. By now the requestor is reasonably irked and writes:

“That, I repeat, is outrageous.
” The FOIL continues as is and the village of Ravena is now in default of its affirmative obligations under the Freedom of Information Law.
” I expressly do not withdraw the FOIL in its currently amended form. The amendment was offered as a courtesy and to facilitate the village of Ravena’s compliance within the time provided by the Freedom of Information Law. “The law is explicit and clear, Mr Freedman does not have legislative authority. The times set forth in the law are explicit and clear, as are the disallowed “excuses” for failure to comply.
” I hereby demand immediate compliance or the village of Ravena’s explicit written refusal to comply.
 “You may want to pass this by Mr Biscone if he’s not too distracted by his sanctions battle. Yes, I’m watching that play out with considerable interest as I hope the local press is.”

He’s been on the payroll of the NY Department of State since about 1974—a bit too long, in our honest opinion—Freeman has worked for the New York State Committee on Open Government since its creation in 1974 and was appointed executive director in 1976. He’s a bit too comfy in his little nest he’s created for himself.  Don’t you think there’s something bizarre about a state employee being executive director for more than 36 years?!? Isn’t that a little, corrupt?

So here you have this guy, Bob Freeman, who’s really firmly established in what we can reasonably call his little nest for more than 36 years, bloated with power, and making decisions on who gets what from government. A snotty little turd if there ever was one. And guess who’s talking to him about the disclosure of Ravena’s payments to lawyers (Teresi, Biscone, Rotello, Neri): Nancy Bicone-Warner, wife of village justice and ex-cop Harold “Hal” Warner. The same Nancy Biscone-Warner who is knee-deep in Cathy Deluca’s little scam, the Ravena Health and Fitness Center. Yes, it’s the same Nancy Biscone-Warner who haunts the village of Ravena offices 25/7, who has everyone there by the short-and-curlies. Now she’s passing on inaccurate information to the Committee on Open Government, trying desperately to avoid having to disclose the village of Ravena’s payments to the local legal incest club.

We know that Nancy Warner was faster than lightning on the phone to Freeman trying to get out of producing documents in regard to another F.O.I.L. And Bob Freeman is playing right along with them. Committee on Open Government? Guess again! Apparently it’s a committee of one: Bob Freeman.

Do you expect anything different out of Albany, the cesspool of democrat corruption. Freeman’s a lawyer. No doubt with connections with Joe Rotello, a clerk  in the Court of Appeals, the Teresis, Ravena shyster Greg Teresi and dirty old dad, Joe Teresi on the NYS Supreme Court, Michael Biscone in Ravena, theyve all got their hands in the cash-box called the village of Ravena. And watchdog gatekeeper Nancy Biscone-Warner ain’t letting anything get by her to upset the little party boat they have floating in taxpayer cash. And don’t expect any help from the Albany County DA, P. David Soares. He likes to party, too.
 
Just a note: The town of Coeymans responded to the very same F.O.I.L. within a couple of days. Now, do you think something’s up in the village of Ravena? Why are they fighting tooth-and-nail to avoid coming up with those documents? Do you think there’s something they don’t want residents to know. Maybe they’re scared shiteless that if you get it, we’ll see it. Do ya think?
