Well someone said they saw Major Cluck a.k.a. Cathy Deluca on Main Street in Ravena, New York, and she was dressed for the fight! You GO! girl!

And all the commotion is about the RCS board of education proposing a resolution that requires anyone doing business on school property to do it legally. We realize that’s something really new and revolutionary in the RCS district but it had to come sooner or later.

Here’s the text of the resolution that has Cathy Deluca’s feathers in a tizzy:

Here is the latest stunt from our “Fab Five” on the RCS BOE. Their new policy

2.13 BE IT RESOLVED that the Board hereby directs the Superintendent of Schools to implement the following procedures with respect to organizations that may lawfully use school district facilities for fund raising activities:
Prior to approving a use the not-for-profit organization must present the Superintendent with written documentation regarding the fee schedule for entrance fees, raffle prices and or goods to be sold on the school district premises; An estimate of the amount of proceeds must be presented to the Superintendent with written evidence of the actual cost of the goods or services that will be paid out of the gross fees and/or sales; The amount of money estimated to be gifted to a general educational or general charitable entity shall be set forth in writing, detailing how the monies will be paid over to such entity; The accounting of the gross sales shall be conducted in the presence of a school district official or employee; No use application shall be granted where the conditions set forth above have not been met, except for the accounting of the gross sales process that will be conducted at the end of the use period.

PLEASE NOTE: they are trying to not only control “who” can raise funds for the school but also “where” the funds are applied. They are UNBELIEVABLE!


Yes, Cathy, to the mind of a dumb cluck it probably is “UNBELIEVABLE!” It’s unbelievable that you’ll finally have to do things legally. But you can change, you’ve done it so many times before. When I listen to you I really believe that creatures the size of a dinosaur can actually live with a brain the size of a peanut. You’re living proof!

But Deluca is not the only dumb cluck in town, listen to Kathleen Ryan Gill’s come-back:

What egotistical idiots would bite the hand that feeds them? RCS school board, that’s who. By the way, I will take this time to thank the wonderful teachers who have given so much to my grandchildren in spite of the RCS leadership. Hurt my children and grandchildren and you will awaken momma bears who will not stand by and take it.”

I Think I’ve Been Insulted!

I guess if your name is Cathy or Kathy you must be sharing the same bird brain! Seems to me, Kathleen Ryan Gill, that the only “kids” you’ve served have been honey-roasted! The normally functioning intellect will not need me to point out the absolute idiocy of Kathleen Ryan Gill’s published stupidity. But I will…Gill seems to think that it’s  the school board who is creating “negativity” and that the “bickering and nitpicking” is from the “school board.” Well, when Kathleen Ryan Gill comes out of her senile dementia episodes and her drug-induced coma, she might actually realize that the board has been the model of cooperation and consensus and that the “bickering and nitpicking” has been coming from the Deluca FaceBook Teletubby bunch, who have done nothing but bellyache and point their fingers, and ambush the board at every turn, that is, when they’re not on Twinkie binges.

Other charter members of the Clucks Club: Cathy DeLuca (Chief Cluck), Jeanette Smith Borger, Tracey Traver, Mike Varney, Moose Misuraca (smh), don’t miss a beat in clucking idiotic opinions and misguided advice. Not one of them knows what she or he is talking about. It’s reads like a lonely hearts club, dear Abby mutation. It reeks of self-loathing and myopia! These people have a serious case of unrecovered children of dysfunctional families or serious co-dependence.

Cathy Deluca and her lackies, her clucks, function out of hate and envy, and apparently self-loathing. Nothing the present board of education majority would or could ever do would please them because the Coeymanazi Teletubbettes are a deeply unhappy, unfulfilled mob. The Delucas and their Coeymanazis are so envious and sour-grapes, they’ve lost so many times, they’re known as the Coeymans Losers Club, that they are blinded by their envy. Only misfits would join with them.

Kathleen Ryan Gill apparently comes from some still unmapped area of rural “Appalachia” that hasn’t yet heard that there are laws that regulate who operates what on school property. And Yes! Since about 1912, the government has been very interested in how people make money and what’s done with it. Maybe Kathleen Ryan Gill has never paid any income or sales taxes or never filled out a tax form. But that’s OK. We don’t think the RCS Sports Association or Cathy Deluca ever has, either. And they both claim to have some sense of business…Coeymanazi business. Crooks!

But the best of Kathleen Ryan Gill comes at the closing. GRRR! Momma Bears loose! Gimme a break! Grow up grandma! You’re starting to really scare me and I hope your neighbors know about you…do you get out much?

And then there’s Brenda Biance Pommakoy, obviously a Teletubby of few words, who writes in response to grandma Ryan-Gill: “So sad what the district has resorted to!” Yes, it is sad, Brenda. So sad that the privilege of free speech can be used so frequently by the Deluca Teletubbies only to publish their despicable ignorance, and to continue to foster the apparently predominant impression, so frequently published in the Times Useless, that the people of this RCS district are a bunch of ignorant, illiterate, hypocritical cannibals.

Cathy Deluca has been involved in so many shadey deals in this community that the only one who’s probably shadier is her partner, Dirty-Hands Jerry Deluca. If they aren’t getting the kudos for their corrupt practices then they’ll lynch anyone who tries to do good. Deluca’s behind the idiotic Bruno corruption that’s insanely trying to put a fitness center in the library space. And what’s worse, she tries to justify the idea on her FaceBook page. She stands to benefit (she’s supposed to manage the fitness center, you know), so screw the library! Well, looking at most of the residents they sure do need a fitness center more than a library: to drop a couple twinky tons. And judging by what I read in some of those FaceBook comments, they don’t need a library, they wouldn’t know what to do with a book. Maybe Bruno’s not so senile as I thought.

Elizabeth “Betsy” R. Smith a.k.a. Superintendent Double-Talk

Mr James Latter Recently Informed the Community that The Superintendent of Schools ‘Does Not have to Answer Residents’ Questions.’

Well, Mr Latter, Although You Were Out of Order and Very Wrong to Have Written that, You’ll Be Pleased to Know that RCS Central School District Superintendent Elizabeth R. Smith Doesn’t Answer Residents’ Questions.

She Just Double-talks Them to Oblivion!

Well, That’s Being Too Fair, Actually, She’s Apparently Dyslexic … We’ve already Established That She’s Illiterate (see our article,  The RCS District RFP Is an Embarassment and a Sham!) but We Now Think She Has a Much More Serious Problem: Indifference!

But she did little when she was in the job, now she’s given her notice–after she’s padded her retirement checks with the $140,000 salary she’s ending with–and so she can wait it out another month or two, she’s a shorttimer now. She’ll leave the mess for the next crook who gets hired to the position.

We covered the illicit, delinquent, and illegal conduct of the RCS athletics coaches when they asked students to sell raffle tickets on behalf of the RCS Sports Association (see our article, Raffle, Anyone?). It was clear in that article that there was serious misconduct going on right under Brian Bailey’s and Elizabeth Smith’s noses!  We also published Superintendent Smith’s idiotic response (rather, refusal to respond) to that situation, as well in our article, No Response From District Office, Ms. Smith. It gets worse, still, because when we published our article on our suspicion of illegal money transactions at the National Bank of Coxsackie by the RCS Sports Association, there was still no action taken (see our article More Money Questions…Who’s Cashing the Checks?)

No Answers, Betsy?

So, even after all of that scandalous misconduct, we are still asking why the RCS district offices, the Superintendent, especially, and the Board of Education, too, have not addressed these concerns and put their foot down squarely on the culprits’ necks?!? We’re still asking WHO? is the RCS Sports Association, WHAT? are they doing having the coaches hand out raffle tickets to students to sell, and HOW MUCH? the RCS Bottle Blitz is paying to use school facilities!

We recently obtained a copy of a letter request addressed to Superintendent Elizabeth “Betsy” R. Smith, dated September 11, 2012 and received at the District Offices on September 12, 2012, in which a concerned resident requests information regarding the action taken against the RCS athletics coaches who writes:


“Could you please advise me of the action taken with the coaches that told the students to sell raffle tickets? It is my understanding that this is illegal and the students again were placed in a situtation that gave them no recourse except to do what they were told for fear of reprisal. Also, who is collecting this money, and who and what will these funds be used for? Many community members are very concerned that inappropriate behavior on the part of our teachers/coaches continues and feel it is essential that administration take immediate, legal action against any and all staff who continue to disregard policy and law further damaging the welfare of the students as well as this district’s reputation.

The letter is very clear in that the writer asks specific questions:

  1. What is the action taken with the coaches who unlawfully told students to sell raffle tickets?
  2. Who is collecting the money?
  3. For whom and for what will the funds be used?
  4. The question is also asked impliedly “What action the administration is going to take against any and all staff who disregard policy and law, endangering students and damaging the district’s reputation?”

The questions are pretty clear, aren’t they? You’d expect the Superintendent of schools to be able to read and understand such simple language, wouldn’t you? After all, it’s clear English, and it’s really quite clear and plainly stated, isn’t it?

But the question is nagging: Why doesn’t Superintendent Smith simply answer the questions? She simply refuses to answer our questions or those posed by residents! Why is that, we wonder!?! So, here’s your Superintendent of Schools, Ms Elizabeth “Betsy” R. Smith‘s “answer” to the resident’s written questions:


Thank you for your letter, which I opened today.  [Name Redacted] delivered it to me after our Building, Grounds and Transportation meeting yesterday.   All RCS coaches of fall sports were notified of the law restricting raffle ticket sales to adults 18 and over. 

“Community Organizations and Parent-Teacher Organizations may conduct fund raisers and raffles.  Those organizations can be contacted for information about their fund raisers.

Am I missing something, or what? “Thank you…[Name Redacted] delivered the letter…All RCS coaches…were notified of the law restricting raffle ticket sales to adults 18 and over.” What about the coaches distributing the tickets to students and telling them to sell them? Did you miss that Betsy? Didn’t you understand the question, Betsy? Need your eyes examined, Betsy?

Wot Duhn’t U Understand, Ms Smith?

Those organizations can be contacted for information about their fund raisers.” What in hell are you blathering about, Betsy? Have you lost your mind? Who cares? Answer the damned questions, why don’t you?!?

So parents, residents, community members, on September 18, 2012, at the very next board of education meeting, we urge you to press Ms Smith for a more detailed, responsive answer to these questions we’ve raised in our article about the raffle ticket sales (see Raffle, Anyone?), Smith’s command of the English language, and the progress made in getting the required documentation from the RCS Sports Association that verifies their legality.

Who’s Cleaning Up the Money?

We will also be interested in parents, residents, taxpayers, and community members pressing Ms Smith and the Board of Education to know how much the RCS Bottle Blitz was charged for the use of the high school cafeteria on September 14th. As an outside program not affiliated with the RCS school district and not a registered organization of any kind, the RCS Bottle Blitz would be subject to hourly charges for the use of the school property, just like the community sports clubs are being charged. We need to know, How much? Who’s paying for opening and closing the building, the insurance, the utilities, the clean-up, etc.?

So, Superintendent Smith, we have just one last question for you: If YOU, the Superintendent of Schools for this RCS central school district, can’t read and comprehend simple English in a short letter asking very clear and concise questions for the purpose of answering them just as plainly and concisely, how do you intend to convince parents, taxpayers of this district that they are getting what they think they’re paying for.

Also, will you please now answer the questions the resident asked in the above letter. Thank you!

Dirty-Hands Jerry: “We don’t care…”

Dirty-Hands Jerrry Has Resurfaced and Arrogantly Thinks He’s the Spokesperson for the Entire RCS Central School District: “We don’t care what the other schools do!” Well, We Don’t Care What You Care About, Jerry, Either.

 According to Gerald “Dirty-Hands Jerry” Deluca, the RCS parents and residents shouldn’t care what other districts are doing. That profound bit of lunatic wisdom came during the public statement portion of the September 4, 2012, RCS board of education meeting, when Deluca made a cameo appearance after months of invisibility. Deluca was remarkably understated and gentle when he took the podium, even timid. We can only guess what the effects of his long withdrawal and quiet time might have been (was it imposed by the Ravena-Coeymans godfather, we wonder?). He was getting too mouthy and uppity, anyway. No one missed him or his bottle baglady partner Cathy Deluca  nor his lapdog R.J. D’Esposito. But school’s in session and they’re back so we might as well get used to it.

Damn! Just when the neighborhood started to look good again!

Deluca made the statement, apparently on behalf of the Coeymanazi mob, because all previous speakers were apalled at the article published in the Sunday Times Useless, “Big tab, mixed results. State’s per pupil cost is tops in U.S., but outcomes elusive” (S. Waldman, Sept 1, 2012) (Click here to read the entire article.)

The article reports per pupil expenses for some area school districts for the 2010-2011 school year (the most recent available). RCS is the highest cost per pupil of the entire group! Why is that?

  • Albany: $19,723
  • Ballston Spa: $16,248
  • Bethlehem: $17,026
  • East Greenbush: $17,980
  • Guilderland: $15,906
  • Niskayuna: $17,398
  • Ravena-Coeymans-Selkirk: $21,011
  • Saratoga Springs: $14,760
  • Schenectady: $16,519
  • Shenendehowa: $15,014
  • South Colonie: $16,173
  • Troy: $19,792
  • Voorheesville: $18,176

But Dirty-Hands Jerry doesn’t think that’s significant because, Deluca wants us all to know that he’s there  “to remind people is that this school district does so  many good things for kids and wehn I hear people stand up and say we’re not Bethlehem or we’re not Balston Spa. No, we’re not. We’re RCS and we do very good things and we want to do the best we can for our kids. We don’t care what other schools do.”

Well, Mr Deluca, some of us do care what other districts are doing. We’re not into this isolation thing you seem to worship. We live in a world where we need to be aware of what’s going on around us. We need to compare and, by comparing, learn from others. We’re not as wise and all-knowing as you seem to think you are, Jerry. If this district is the most expensive out of some 13 districts surveyed, there’s really something wrong here. When Bethlehem and Ballston Spa and Albany can do it for less, there’s something really wrong in this district and we’d better hurry up and find out what it is. Any ideas, Jerry?

And we’d better care what the other districts are doing because the state and federal education authorities have a silly little thing they call comparisons. They tend to like to compare things, especially, school performances (and RCS’s performance, despite the hype, is pretty mediocre) costs per pupil, and they tend to ask some very sticky questions when things start to look a little odd, like in the RCS district. Didn’t you know that, Jerry? But you’re special, aren’t you? You don’t have to care. Well the rest of us do, Jerry, so Shut up and disappear, Jerry!

Jerry Deluca and his mob crammed the 2012-13 RCS school budget down your throats, now you’re seeing where that great advice got you all! What about all you Yes! voters who are now screaming bloody murder that you’re going to have to pay more to use school facilities? How do you all feel now that the teachers clique and the Deluca mob has led you down the rosey path to oblivion? Maybe now you’ll start listening to the real people, the business persons on the board of education and stop pointing the finger!

(Has anyone bothered to ask what the RCS school district is charging Cathy Deluca and her gang for the use of the school property for the so-called RCS Bottle Blitz? That’s not an official program of the RCS school district, either. The RCS Bottle Blitz is an entirely privately organized activity that has nothing to do with the RCS Central School District. So Cathy Deluca and Loraine Misuraca, you have to make a request, the request must be discussed by the BoE, and you have to pay for the use of the facilities. O.K.? Are you thinking about that, Superintentent Elizabeth R. Smith?)

Residents and Property Owners, You’d Better Start Asking Some Very Serious Questions Why the RCS CSD is Costing Property Owners more than $21,000 per pupil! There’s A Big Hole Somewhere and Your Money’s Leaking Into a Big Pit (a.k.a. a cesspool of corruption). (New Baltimore Residents had Better Start Doing Some Investigation, Too, Because You’re the Heaviest Taxed of Any of the RCS Locales! You need to consider why this is so when thinking about whether to re-elect your current town board mafia members. New Baltimore, you need to wake up, too! You’re being snookered.)

Raffle, Anyone?

The RCS Sports Association and the Maverick RCS Coaches Appear to Be Mooning the RCS Central School District Superintendent, Business Manager, and the Board of Education and Ignoring Policies and Procedures, Not to Mention the Law.

Is the RCS Sports Association Raffle Illegal?

Several weeks ago the RCS Sports Association was told in no uncertain terms by the Board of Education and residents of the RCS school district that they’d better cough up the registrations, tax information, insurance policies, etc. and comply with district polices and proceedures to operate on school property and to conduct any business on public property.  The RCS Sports Association is not an official school organization and appears to be inappropriately abusing the concept of implied endorsement by using the “RCS” in its name.  So far, nothing’s happened; the RCS Sports Association hasn’t produced a single sheet of meaningful paper…if they have, the RCS Central School District Superintendent and Business Manager have kept the community and the Board of Education in complete darkness. Our bet is that they’re telling the Superintendent to kiss their ass (and she’s complying), and they’re doing what they please.

No Way José!

We now have information that the RCS athletics coaches are allegedly passing out raffle tickets to students with instructions to sell them on behalf of the RCS Sports Association for a raffle allegedly to take place in October. The purpose and nature of the raffle has not been disclosed.

We just received a copy of a message sent to the RCS CSD Superintendent of Schools, Elizabeth R. Smith, and to the RCS CSD business manager, Diane Malecki, that contains the following text (the sender has requested anonymity):


Dear Ms Smith, Ms Malecki:

 Can you please a.s.a.p.:

  1.  Inform me of the current policy regarding students selling raffle tickets on behalf of organizations not affiliated with the RCS CSD
  2. Inform me whether or not the RCS Sports Association has filed with the District their articles of association, their business registrations, their list of officers, their NYS and federal tax registration status and their tax identification number, proof of insurance. Please itemize each of these with a yes or a no response.
  3. Inform me of the role of the RCS athletics coaches and their authorization to have RCS CSD students selling raffle tickets on behalf of the RCS Sports Association
  4. Inform me of the type and substance of disclosure of the event for which the raffle tickets are being sold
  5. The date such request was made to the RCS CSD to permit the sale of said raffle tickets
  6. The date and vote by the RCS CSD Board of Education deliberating, discussing, voting and approving/disapproving such request by the RCS Sports Association

Unless I hear from you by 12:00 p.m. on September 6, 2012 with the answers to the above questions I shall, without prejudice, notify the appropriate tax and finance authorities of the RCS Sports Association’s illicit activities, the NYSED office of counsel and the relevant administrative authorities at the SED, and the FBI and State Law Enforcement entities charged with the enforcement of the tax codes and the investigation of public corruption.
 
Furthermore, unless I have answers to the above questions I intend, without prejudice, to file formal notices of claim and demands for investigation of the operation of the RCS Sports Association, its officers, members, and associates, naming also the Superintendent and the Business Manager of the RCS CSD as accessories in any illegal transactions by the RCS Sports Association.
 
Furthermore, unless I have answers to the above questions by the time indicated, I intend to file without prejudice, notices of claim and demands for investigation and inquiry with the relevant state and federal child welfare authorities, naming the RCS Sports Association, its officers, members, and associates, naming also the Superintendent and the Business Manager of the RCS CSD as accessories in any illegal transactions by the RCS Sports Association.
 
Furthermore, unless I receive your response to the above questions, said responses being immediately at hand in the normal and regular conduct of RCS CSD business, I shall file a grievance and demand for investigation with the RCS CSD board of education to fully investigate the complicity and involvement of the RCS CSD with the allegedly and facially illicit activities of the RCS Sports Association improperly operated in virtue of the implied endorsement of the RCS CSD Superintendent and Business Manager, and with their implicit cooperation and acquiescence, and furthermore, to demand that any processes, proceedings or actions in progress or to be inaugurated with regard to the Superinendent’s activities, including but not by limitation retirement, resignation, pension, retirement benefits, etc., be stayed until the completion of all inquiries, investigations, or prosecutions associated with the activities of the so-called RCS Sports Association, its officers, members, and associates, naming also the Superintendent and the Business Manager of the RCS CSD as accessories in any illegal transactions by the RCS Sports Association.
 
I urge you, Mme Superintendent and Business Manager, to respond to the above questions 1-6 by or before the time indicated above.

Apparently, Superintendent E.R. Smith, saw the wisdom and the prudence in responding immediately, albeit defensively, to the resident’s demand submitted earlier today. Here’s her response:


[Name Redacted], I do not appreciate your threat made against me. I will however, answer your questions with a statement. John Vadney brought to my attention within the last hour, the fact that a student sold him a raffle ticket sponsored by the RCS Sports Association. An organization not affiliated with the RCS Central School District cannot ask students to sell tickets or be involved in any form of fund raising. The Sports Association has been notified this evening of this. No permission was granted by RCS School District for the selling of a Daytona 500 Ticket.

Thank you very much for your prompt response, Ms Smith.

Paranoia and defensiveness is a pitiful state indeed; there was no explicit or implict threat “against” you in the demand. The steps enumerated in the demand were reasonable and prosecutable under the circumstances.

I am still at a loss that you, the principal of the high school and his many minions had to be notified by the president of the BoE of the illicit misconduct of your high school coaches right under your noses!

  • Where was principal Bailey when his coaches and staff were pandering to the RCS Sports Association?
  • Will the District be notifying those who paid for the illegal tickets that their money will be refunded?
  • What steps does the District intend to take against the offending coaches?
  • What steps does the District intend to take against the high school prinicpal?
  • What steps does the District intend to take against the RCS Sports Association?
  • Will the RCS Sports Association be banned from any activity on school property for a reasonable period of time by way of disciplinary action?
  • What, exactly, does the District intend to do to discourage such misconduct in future and to heal the damage done by those miscreants at the RCS Sports Association?

Please be assured that I intend to request that this correspondence be appropriately published for the community to read and evaluate.

It is my considered personal and professional opinion, Ms Smith, that you were derelict in your responsibilities, as was principal Bailey, and that you both would benefit form censure or discipline. This community should be grievously offended by your negligence, your lack of candor, and your indifference to misconduct in this school district.

My demand and the recourse set forth in that demand were explicitly “without prejudice,” and I reserve the option to file formal complaints and charges as the result of this continuing dereliction! That, Madam, is not a threat but an assurance.

Superintendent Smith’s Favorite Fix-It
Or Just Ignore It

Why is it that Mr John Vadney, the president of the RCS board of education, diligent and commited as he is, had to be the one to inform you, Ms Smith, of the RCS coaches illegal activity on behalf of the RCS Sports Association. Where was Mr Bailey when all of this was going on right under his nose?!?! And you mention solely “that a student sold him [Mr Vadney] a raffle ticket sponsored by the RCS Sports Association” and that Mr Vadney informed you of that fact. Where, Ms Smith, did the student get the ticket(s)? Who provided the student with the ticket(s)? That, Ms Smith, is the operative question here (you really need to ask that question, you know); not that the student was selling tickets nor that Mr Vadney bought a ticket and then informed you of the fact (which you or your principal should already have known) that the high school athletics coaches were distributing the tickets to students with instructions to flog them to residents! Facts, Ms Smith, facts! How is it that the RCS Sports Association can get away with such misconduct in broad daylight…what would a drug dealer get away with? Oh, the questions do arise, Ms Smith!

Can we reasonably expect that the offending coaches will face some disciplinary action for their misconduct? One would reasonably hope so!

Thank you Ms Smith, on behalf of all of us, for your prompt response, even though it is only partial. I suppose we should be grateful that you responded at all to the resident. But it seems to me that you, Ms Smith, are a bit paranoid, or at least suspiciously defensive, since there is no threat against you to be read in the alternatives to any non-response, simply that reasonable steps would be taken to ensure the best interests of the tax-paying public, something you don’t seem to have been able to ensure in the year or so you’ve been collecting your salary as superintendent.

(Has anyone bothered to ask what the RCS school district is charging Cathy Deluca and her gang for the use of the school property for the so-called RCS Bottle Blitz? That’s not an official program of the RCS school district, either. The RCS Bottle Blitz is an entirely privately organized activity that has nothing to do with the RCS Central School District. How about that, Ms Smith?)

Does this mean that the RCS CSD is going to face another investigation, audit, claim, lawsuit? Why not just enforce the policies and procedures and keep the Board of Education in the loop?!? Why do everything from behind the smoke screens? What in hell is the RCS CSD Superintendent of Schools, Elizabeth R. Smith, and the RCS CSD Business Manager, Diane Malecki, doing all day long? Planning the anticipated retirement party?

The Law Now Makes Teachers, Principals, Administrators, School Districts Responsible and Liable for Acts of Bullying that Take Place on School Property or in the Context of School Activities. Now, In Addition to their Civil Liabilities for the Welfare of School Children, the Law Makes the Schools Co-Liable for Bullying of Students on Students,  or Teachers, TA’s, or Coaches on Students. But It’s Up to YOU, It’s YOUR Responsibility as Parents, to be Proactive and Public in Protecting Your Children!

We just received another request from a concerned RCS parent with a child or children in the RCS schools who writes [names redacted to protect the individual’s identity and to ensure confidentiality]:


The Parent’s Plea:

“Hello Im another concerned parent of RCS children …I was hoping you assist me. Simply what I am Looking for is…What lawyer is representing the [redacted] family in their suit against the RCS district? I ask since I am in the process of seeking my own legal advice for bullying. If you don’t know or feel uncomfortable disclosing that information hopefully you can suggest an attorney who isn’t so-called “corrupted”.
“Also would you be able to direct me to any other possible resources out there that may be able to help me?
“I have followed the “chain of command” regarding the bullying since October 2011, teacher- guidance – principal – superintendent – CSE – teacher- principal -superintendent &  recently a email to the board (no replies to the email).
“Simply put .. I’m at a large brick wall of a dead end- and need direction, to insure the safety of my child.”


Our Response:

Your original message was forwarded to us by one of our contributors whom you contacted with your request but did not have the information you needed. We hope we can offer you some help in this response.

No child deserves to be hurt socially, emotionally or psychologically, least of all in our schools!

First of all, any concerned parent would be well advised to seek out other concerned parents and to join together to seek representation as a group. First of all, a group has more backbone to pursue such a campaign, there’s “power in numbers.” Secondly, in a group, you can all share your experiences and establish a pattern of abuse and indifference by the administration, essential probative items for a good case. Thirdly, in a group you can share not only stories but also expenses. Getting individual representation might be difficult but if a group of you approach an attorney, s/he’ll have a better feel for the situation and can put together a better strategy. Fourthly, the District would be more intimidated and more prone to settle if confronted by a group of parents represented by an attorney who is ready to kick ass.

One of the problems you parents who contact us have is that you say you want to protect your children but are willing only to go half way. You want to do what you’ve been doing for years–not only you but so many others–creeping around in the shadows, trying to stay invisible, yet saying you want to stop the bullying or solve the problems. But you’ve got to stand up and come out into the light to do that.

You parents are not going to get anything done by skulking around in the shadows, not wanting your names mentioned, not wanting to tell your stories to the public, wanting to assert your rights but wanting also for someone else to carry the load for you. Sorry, that doesn’t work.

Individually, your lovely school district is going to eat you up one-by-one when you come with your complaint. You think your tax dollars are going to the children in your schools, do you? Just wait until you have an issue with the school district, that same school district who is always telling the voters, “We’re here for the kids.” But not your kids. You may have already experienced how concerned they are for the kids: did you get any response to your complaints or inquiries about the incidents you are talking about? Probably not. The RCS CSD turns into an entirely different animal when it comes to having to deal with a problem, especially when it might make them look bad. And it’s an ugly beast when it comes to responding to a complaint about a child’s welfare in the schools; that really makes them look bad. Don’t you think you should be telling the world about that?

It’s usually very unlikely that the District will respond to e-mails, they’re too dangerous. But what I do and always suggest first and foremost is that you document everything in writing in a notebook or some other way as soon as possible after an event or incident or contact. That’s very important when it comes to evidence and any hearings or court appearances. If it’s written down as soon as possible after it happens it’s 1000x better than plain old memory. Second, put all your requests into letter form, clearly stating the problem (no emotions, just the facts, please), times, dates, names, and what you want answered. Always include a reasonable request for something to be done that will make you happy or satisfy you. Then mail it to the school principal, the RCS CSD superintendent, and to the president of the board of education. Send the copy to the RCS CSD superintendent by certified mail, return receipt requested. Then you have proof you made the inquiry, proof they received it, and then proof they didn’t bother to respond.

As for sharing information about someone else’s representation or case, I’m afraid I”m not in the position to to do that. But what I would suggest is that you call the individual or drop by that individual’s home, they’re very welcoming and helpful, and talk to them about your needs and concerns. Talking directly to persons with similar problems is immensely helpful and healing. It’s worked well with many types of problems.

If you still want to go at it alone, I would suggest you contact the New York State Bar Association Lawyer Referral and Information Service at 1 (800) 342-3661 lr@nysba.org, or Department for Children, Youth and Families Programs & Services at the Child Protective Services (CPS) Hotline: 1 (800) 342-3720, tell them what you need, a ask for a recommendation for assistance in moving forward with your case.

I’d also suggest that you get out of that Democrat cesspool of political party machinery and give Pete Lopez, your NYS Assemblyman for the 127nd Assembly District (but running for the newly formed 102nd district that includes Ravena-Coeymans-Selkirk, New Baltimore are part of his district), tell him about the problems you’re having, about the response you’re getting from the District, ask for his help. Tell him this bullying problem is big here and obviously big everywhere if the legislatures of a large number of states have actually passed laws like the the Dignity for All Students Act (DASA),  New York’s “Dignity Act“! That’s why he’s there. Besides, if you hadn’t already heard, it’s an election year and the candidates will be chomping at the bit for sensitive issues to toy with.” In fact, call everyone who’s running and not part of the local political machine (that would exclude Tom Dolan who has done NOTHING with regard to helping parents with the bullying problem–he’s part of the political gang that’s part of the problem!). And you haven’t heard a peep out of the Delucas, the Bartletts, the Whalens, Engels, Revilles, Latters, Misuracas, Leput-Hommels or any of the other Coeymanazi bunch about the bullying problem. Of course not! They’re part of the system and you don’t buck your own system. And besides, they’re all out doing something ultra-important: collecting bottles. Do you get it? If it’s easy and gets them brownie points they’ll do it; if it involves getting their hands dirty and being prophets, Forget it! Just give them glory and they’ll love you for it but don’t expect much in return.

So, what I’d recommend first of all is to find like-minded allies, especially parents whose children were bullied in the past and may have graduated or left the RCS school district. They may be very willing to step out with you. Then, contact parents with children still in the RCS school district and get together, explaining how important it is to join up and step out. You’ll get nothing done if you and others like you keep hiding. You’ll never be able to say that you actually did sometihing to protect your children and some day they might actually ask you, “Why didn’t you, mom, dad? What will you answer?

Of course I will respect your request to keep our conversations private but I would also ask you to please continue to keep us updated on what you are doing and how it’s working for you. It helps us to help others in your situation or in similar situations to know how our advice is working for them.

Teacher- and Coach-on-Student Bully

Keep in mind the types of bullying that go on in our schools includes student-on-student, teacher-on-student, coach-on-student (sometimes even teacher-on-teacher, and student-on-teacher, believe it or not)! We can talk about various types of bullying that often appear simultaneously:

  • Physical: pushing, kicking, assault with objects, etc. It occurs more frequently in primary than in secondary. But don’t be led astray by this generalization, as student’s get older, physical abuse becomes more covert, more calculated, more dangerous and symptomatic of bigger problems ahead! Research shows that bully teachers and coaches have a history of being bullied. There’s also evidence of a bullied-connection withviolent, sociopathic behavior in adults.
  • Verbal abuse and name-calling, slurs in public, highlighting physical defects, etc.. It is the most common and can leave very deep scars. Words do harm and harm deeply.  Teachers be especially aware of this in yourselves.
  • Psychological: undermine the individual’s self-esteem and foster their sense of fear. The psychological harm is really a common feature of any bullying but it is a standalone form of bullying, too.
  • Social: attempts to isolate the members of other groups, or to exclude certain persons or classmate as members of a group. Scarring. Can produce problems further down the road in the young adult and the mature adult (true for all of the bullying types!).

So, In Summary, Our Advice Is:

  • You need to be parents to your children. That’s more than just providing them with a cellphone, junk food, and a ride to the mall! You need to be a positive role model, a source of nurture and protection. Not a friend, a parent!
  • Have open, honest dialogue with your children about the reality of bullying and that there is a law against it.
  • Encourage your children to bring their concerns to you immediately, not to wait, not to be afraid.
  • Get names of other children who have been bullied (your own children will probably be the best sources for this information, believe it or not). Kids see and hear a lot at the school and that makes them great sources of information. Contact the parents of other children who have been bullied or abused in your district. Get together to form an action committee. There’s power in numbers and the more people you have with similar experiences, the more credible your own case. This will become very important later at hearings or in court!
  • Document all incidents, conversations, contacts, etc. in a written record with dates, times, incendent description, names of those involved, names of those contacted, outcome (always with dates and times!).
  • Confront principals, administrators, superintendent, board of education immediately with your concerns. Don’t wait! They’ll use that against you! And do it in writing(not by e-mail), and what you expect to be done to fix the situation. The best way is a copy of the letter of notice or inquiry to each of the levels (principal, administrators, superintendent, BoE) with the copy to the superintent by certified mail, return receipt requested. Remember: Stick to the facts, admit nothing, don’t get emotional, assume you are always the victim! Don’t let them use anything against you later! Don’t believe any promises! Get it in writing!
  • Follow up on each of your inquiries or complaints by telephone call (note date, time, who spoken to, and substance of the call), and then with a written confirmation of the follow-up and brief details of the conversation. Send a copy to the other party and to the superintendent.
  • If you still don’t get a response. Contact the local police, make a complaint. Send a copy of the complaint to the Albany County District Attorney’s Office referring to the Dignity for All Students Act (DASA), send a copy to your Assemblyman and to your state Senator. Do this by regular mail, not by e-mail. You can follow up or confirm by e-mail and attach a scanned copy of the hard copy letter or complaint.
  • Contact the  New York State Bar Association Lawyer Referral and Information Service at 1 (800) 342-3661 lr@nysba.org for a referral to an attorney specializing in lawsuits against school districts, even specializing in cases under the Dignity for All Students Act (DASA). Under the law you are entitled to an initial free consultation with an attorney. If s/she decides to take the case, get him or her to provide you with a written letter of representation that states the approximate cost of the case in fees etc. and the approximate length of time s/he expects the case to take to resolution. Do not ask for promises that you will win; that’s unreasonable.
  • From that point on, let the attorney do his/her magic, but follow-up regularly, never trust or think that they’re on top of it, they’re probably not and will likely need some high-voltage prodding to get them to move their asses. Stay out of the way but stay informed!
  • Be  active! Be very active! It’s your children at risk, not theirs. Your children will thank you some day…or curse you if you’don’t act now!

More Money Questions…Who’s Cashing the Checks?

We now have some evidence that will help to track the money trail in the case of the RCS Sports Association, the so-called RCS Indians Football Camp, and the Duffle Bag Blitz. Seems that the allegedly unregistered RCS Sports Association or Athletics Association or whatever they’re calling themselves today are putting the money they collect into an account at National Bank of Coxsackie in Ravena. That’s interesting enough but the big Who? question still looms large in most residents’ minds. And how is it that a local state and federally regulated banking institution isn’t more careful with whom they deal and how they manage deposits?

It’s been our experience that when you open a bank account you have to provide tons of identification and a social security number. If you’re an organization or a business, it’s even tougher, and most banks require a lot more information as well as verifications. So what’s going on when you’re claiming to be a non-profit organization, collecting money from parents of RCS students but despite demands from the RCS community and the RCS CSD Board of Education, have never produced your paperwork on your organization’s registrations, tax status, tax classification, your list of officers’ names, etc.? Has the bank asked for these and has the bank gotten the information? If so, why can’t the school district get it? And if the RCS Sports Association doesn’t produce it for the school district, what the hell are they doing collecting money from the parents of school students and operating a football camp on school property?

We’ve just received a copy of a check from a parent who is asking these and other questions. 

On July 26, 2012, the parent of an RCS student wrote a check in the amount of $75.00 to the RCS Sports Association for a “Football Camp.” The unendorsed check was deposited on August 10, 2012, to the order of the National Bank of Coxsackie (Ravena Branch) ID 021307054, “For Deposit Only INDIANS TEAM FOOTBALL CAMP” a/c 0307765966.

On April 5, 2012, that same parent wrote a check in the amount of $41.00 to the Indian Football Camp for a “Duffle Bag.” The unendorsed check was deposited on June 14, 2012, to the order of the National Bank of Coxsackie (Ravena Branch) ID 021307054, “For Deposit Only INDIANS TEAM FOOTBALL CAMP” a/c 0307765966.

So, here we have an RCS parent who so far has written checks in the amount of at least $116.00 to an organization calling itself the RCS Sports Association holding an account called the Indians Football Team Camp and using the RCS highschool sports teams’ moniker “Indians” to promote a football camp that operates on RCS school property, and even allegedly accepts participants (for payment, of course) from other districts, but no one seems to know who they are or how they are organized or operate. Worse still, they are associating themselves with the RCS school district but have not responded to the district’s or local residents’ demands to produce their financial records, their organization registration, the names of their officers, proof of insurance coverage and their tax information. Something’s really, really fishy here.

The RCS Sports Association, although not an official school organization, is taking plenty of advantage from what is known as “implied endorsement,” that is, making the false  impression that it is endorsed by the RCS Central School District by using the RCS initials and the “Indians” mascot name, when the RCS Sports Association is not endorsed by the school distict at all.

So, National Bank of Coxsackie, are you an accomplice, in complicity with this maverick organization? Are you shortcutting some serious banking policies and procedures regarding handling money from undocumented organizations? Or do you have the documentation, the same documentation that the RCS Sports Association has not provided on demand to the RCS Central School District  board of education?

Now, National Bank of Coxsackie, are you aware that the “old” RCS Sports Association has disbanded and that there’s a “new” RCS Sports Association? Or at least that’s what the public and the RCS board of education have allegedly been told. Do you, National Bank of Coxsackie, have the information relating to the “new” organization and, if you do, can you perhaps explain why the documents and information have not been disclosed on demand to the RCS CSD administration or to the board of education?

Have you, National Bank of Coxsackie seen any documents on organization registration, non-profit certificates, tax documents, etc.?

Who? National Bank of Coxsackie, is signing the RCS Sports Association checks? Who? National Bank of Coxsackie, is signing the Indians Football Team Camp checks? Don’t you think you’d better get some questions answered real quick, NBC? Now’s your chance.

$$$ Got money to launder? $$$

Now YOU, National Bank of Coxsackie, cannot say you didn’t know. Now YOU, National Banck of Coxsackie, will take a closer look at your depositor. Now, YOU, National Bank of Cosackie, will have to answer to you customers how and why this secrecy has persisted for so long. And thanks to one our readers and one of your customers, one of the brave new breed who’s sick and tired of the sheeple attitude, like so many others, and who’s decided to step out and and speak up, we now know where the money’s being laundered, if you’ll pardon a somewhat nuanced choice of words.

And RCS Sports Association, old or new, this would be a great time to come clean, produce your paperwork, your insurance polices, your tax records, your list of officers. We the public, the residents of this district, yeah, maybe even the National Bank of Coxsackie may be interested before they get audited, investigated, or prosecuted.

And all the parents who have been writing checks like these should be asking the same questions as we’re asking here.
