The Editor Responds: What have you become, America?

This is what we’ve become, fellow Americans. It’s nothing to be proud of unless you’re some sort of pervert[1], which most of you are; you like watching without revealing yourselves or speaking up. You like lurking and thinking no one knows your’re there. You like fake names, fake profiles, fake pictures. You like Facebook and fake friends. You like online porn and … well, I’ll stop there. Am I right? Well, now that we can agree on a starting point, here’s where you can give some thought to what you have become —
and whether there’s anything left worth redeeming.

  • On September 12, 2018, 1,464 people read the articlesRiley’s Song: Verse Two” and “Riley’s Mom Responds: A mother’s perspective.”
  • Since we posted “We are Reopening the Case” on September 7, 2018, to September, 13, 2018, we averaged almost 500 new readers a day with an average of almost 600 page views a day.
  • In the period from “We are Reopening the Case” (September 7, 2018) to “Riley’s Mom Responds: A mother’s perspective” (September 12, 2018) we had almost 5,000 new readers on Smalbany Blog.
  • We received a total of 18 comments of which 9 were from cranks with negative comments and 9 were from persons supporting Smalbany’s work on this one investigation.
  • Of the total of 18 comments, 6 were from a sicko calling him/herself “Smalbany is full of crap” using an email “smalbanyisfullofcrap@gmail.com.”  2 were from a weirdo calling him/herself “Douche” and using an email “dickhead@gmail.com ; ”  both of these dingleberries were trying to get a moment of cheap fame in their low lives by stealing from the real issue. The remaining negatives included 1 from a friend of Hagen’s (you can imagine what that one had to say).
  • The remaining 9 were from supporters: 1 from a close friend of Riley (JH), 5 from someone close to Riley, and a touching comment from Riley’s mom (which we published with her permission at “Riley’s Mom Responds: A Mother’s Perspective”). Two others were from a reader/commenter calling him/herself “Tompkins” and more concerned with the name of the road than with the subject matter of the article, and one kind “Keep up the good work” comment.

Do the math: That’s 0.0036% or 4/1000 or 1/250 meaning that only 1 out of every 250 readers got off their ass to make a comment one way or the other. As for the positive comments versus the negative comments, they were evenly divided 9:9. But only 0.0018 or 2/1000 or 1/500 = 1 out of every 500 readers left a comment pro or con.

We can’t believe that so many readers could have been so callous as not to even have left a condolence message for the family, or at least to have insulted Smalbany. Stated another way, we are at a loss that so few of the readers had the courage to have an opinion and share it!

We have to look at these figures and wonder whether Americans have become so dehumanized and so insensitive as not to have given a second thought to a terrible tragedy and a terrible injustice. Yes, readers, this is not only a terrible tragedy, the death of a young man just beginning his life, and a terrible tragedy for his family and friends, it’s a terrible stain on what we so facilely call a country of laws, a God-fearing people, a country founded on humane values, and a country that cherishes family values.

This tragedy is not just a personal tragedy nor is it a merely family tragedy, it’s a social tragedy, an American tragedy. Your responses tell us and everyone just simply viewing the Smalbany blog that Americans are all talk. This tragedy tells the world — Yes! The WORLD! These three articles have been read by people in Canada, France, Sweden, as far away as the Philippines and Dubai, and even in Texas! — this tragedy broadcasts to the entire world what hypocrites Americans are.

Riley’s Song[2]

Riley’s Song is a song about youth, love and future. It reminds us of the beauty of Riley “Jeremiah” Kern’s young life and saddens us that his has been cut short.

But our Riley’s Song is the tragic song of what America has become — or not become. Our Riley’s song is about injustice, incompetence, cronyism, cover-ups, infidelity, irresponsibility, lawlessness, favoritism. Our Riley’s song is about a society that has become so materialistic that it has lost all sense of morality and goodness but is so blind as not to even notice the weeping lesions all over its corrupt body.

Riley’s mom asked a question of one of our contributors just yesterday. It was a question about the Biblical prophet Jeremiah, so we had to pass it on to a theologian/clergyperson for a proper response. The fact that she asked the question had more to do with a completely different thought but sometimes things happen for inexplicable reasons. This is one of those things.

You see, she asked what we thought Jeremiah 22 meant. Jeremiah is one of the major Old Testament (First Covenant) prophets, a prophet who is revered as a major prophet by all three Abrahamic traditions: Christianity, Judaism — Jeremiah is so important that he has been made canon in Judaism—, and Islam. Not only is there a Book of Jeremiah, the Book of Lamentations is generally accepted as having been his work. Jeremiah is also known as the “Weeping Prophet,” because when you read his words describing and mourning the fall, capture and destruction of his beloved Jerusalem, and if you read Lamentations, you will hear Jeremiah’s anguish, and yes, tears, in his words. We even have an English word based on Jeremiah’s writings: “jeremiad,” a sad lamentation.

In his response, the Reverend explains:

Jeremiah sends a warning message:

“Doom to the one who builds palaces but bullies people, who makes a fine house but destroys lives, who cheats their workers and won’t pay them for their work, who says, ‘I’ll build me an elaborate mansion with spacious rooms and fancy windows and rare and expensive woods and the latest in interior decor.’” (Jer 22:13-14)

Woe, doom, to the one who takes wonderful care of themselves at the expense of others. Woe, doom, to the one who provides for their own luxuries or comfortable living at the expense of others who work for almost nothing.

We have become driven to get a good feeling without any effort — to make believe that everything is peachy.  Isn’t it right to try to get a good deal, to go where we can get the best deal for the lowest price? Isn’t it wonderful when we can cheat someone out of something and feel good about it, or get a new friend with a mouse click? We love to fool ourselves. When you get a compliment on that fake profile picture on Facebook, we often enjoy telling the story of what great bargain we are. Why is it, when we get something by cheating or screwing someone, we think we’re a smart? Why is it when we have so many virtual friends we actually think we are loved or liked? Is cheap and deceptive always better?

What if we would take a moment when purchasing an item to ask questions like “Why is this so cheap?” or when we accept a friend me invitation, ask, “I wonder who this person really is?.”

We, as a culture, are so absorbed in our consumption of things and entertainment, and even people that we ignore or forget what the actual cost is to ourselves, our own humanness, the rest of the world.  Think of this example, since we are a country that loves kids so much: Some countries are known to use and abuse child labor more than others, and those countries are big exporters to the USA, and Americans do love to get something cheap but they are less interested in knowing the history of the cheap; in other words, they suspend their condemnation of child abuse for a moment so they can enjoy their cheap.

We, as a society, find it very easy to suspend morality, values, ethics, humanity for cheap. But cheap is receiving the benefits without paying the cost involved.

This is what the Lord says: Do what is just and right. Rescue from the hand of the oppressor the one who has been robbed. Do no wrong or violence to the foreigner, the fatherless or the widow, and do not shed innocent blood in this place. (Jer 22:3)

I hope that helps you to have at least a starter understanding of this great and sensitive prophet.

Somehow, the young man, Riley, picked up the nickname “Jeremiah,” and used it as his alter ego; it even appears on the cross, the roadside memorial, marking the place where he died. Now isn’t that something to think about?

Think of how this all began: In an article published on August 4, 2018, “Three Articles on New Baltimore Scandals: Pick One or Read All,” just days after Riley’s death, we added just a simple footnote. Just a footnote, asking the question:

Is this a cover up to protect a prominent Ravena family? Doesn’t the young man’s life mean anything or do we just sweep the whole thing under the carpet? We need to start asking questions. The 20-year old man is not just another raccoon, Mr Contento!”[3]

Putting all of this in a sort of perspective, most of our readers will recall a scandalous incident that occurred last March 2018, in the Village of Ravena, at Faith Plaza shopping mall. The incident involved two Coeymans police officers in two Coeymans Police Department vehicles harassing and running over a wild raccoon in full view of dozens of witnesses. The incident was videoed by a witness and appeared on Facebook and YouTube; it went viral and created an international uproar. Not only that, a petition was started called “Justice for raccoon killed by officers from Coeymans Police Department” which was signed by more than 110,000 people! The incident was addressed at the Coeymans Town Board Meeting on March 22 by no less than 5 angry citizens, some coming from as far away as Amsterdam, NY (about 50 miles from Ravena). The speakers were interviewed by local television and print media and the interviews broadcast on the evening news. The story was picked up by a large number of newspapers nationwide. It was a real scandal and it was about the inhumane treatment of an innocent wild animal.

Justice Demanded for a Raccoon. It’s a start.

Smalbany covered the story because it was just another nail in the Police Department’s coffin.

Perhaps we’re being unfair and perhaps we’re missing something. But if 110,000 people will come forward and sign an online petition and leave their comments demanding justice for a wild raccoon, and leave their comments expressing their outrage, what have we been missing in the Riley P. Kern case? Are we missing something or are we trying to avoid the perversion, the ugliness staring us directly in the face?

110,000 signatures, almost as many comments for a raccoon. Almost as many outraged comments. Coverage nationwide by numerous newspapers. Coverage by local print and television media with interviews. Outraged citizens appearing to make public statements at a public Town of Coeymans town board meeting on the record. What are we missing here?

We at Smalbany are not missing a thing, ladies and gentlemen. We are fully aware of what’s going on locally and in society. The real question is: “What are YOU missing?”

Perhaps this Smalbany blog, these articles on Riley, are in fact a jeremiad, bitterly lamenting the state of society and its morals in a serious tone of sustained invective, and even containing a prophecy of our society’s imminent downfall.

Perhaps the questions we are asking are going over your heads. Perhaps you are so far gone that you can’t even understand what we are pointing at and saying: “Wake up! This is a sickening state of affairs! Say, DO something!”

Riley Parker “Jeremiah” Kern is dead. Riley Parker “Jeremiah” Kern was a young human being, a young man, good, kind, handsome, talented, smart; he had a wonderful future ahead of him. Riley Parker “Jeremiah” Kern was killed under clearly suspicious circumstances in a freakish accident. Riley Parker “Jeremiah” Kern is crying out for justice, the justice that even a wild raccoon was able to obtain.

Riley Parker “Jeremiah” Kern has become a symbol full of meaning of what we are, have become, but can yet redeem as human beings.

Take responsibility.  Meet your obligations. Demand Justice.

Riley’s Song: Verse Two – Update on Our Investigations.

There are too many contradictions, gaps, inconsistencies in the Riley Kern case to allow anyone with any sense of decency or any trace of compassion to rest easy. While we can’t answer all questions in such a tragic event we can at least try to be honest and thorough in answering those that are answerable. We can at least meet our obligations to come forward and speak the truth. We can at least do our best to connect the dots and minimize doubt and with doubt mistrust. None of this has been done in Riley’s case, at least as far as our investigations and informants have shown. Here’s where we are as of today.

They’re gonna getcha!

Riley Kern was 19 at the time of the accident. Riley Kern’s funeral was on his 20th birthday. Riley Kern, although just before his death, was living with his mother and sister in Kansas, was a local boy. Riley Kern grew up in the RCS area and even attended Ravena-Coeymans-Selkirk high school. Riley Kern’s father, Paul Gumpher, still lives in Climax, New York.

A group of local young people loved and respected Riley to such an extent that they got together and made the trip to Kansas to pay their respects and say a last farewell to Riley at his funeral. For all we have to say about today’s young people, that gesture of loyalty and love struck at even our heart chords. There’s no words to say that would do them the credit they deserve but Thank you! You really did Good!

We are asking Travis Hagen: If you have nothing to hide, nothing to fear, do you go into hiding?

A local man, Travis D Hagen, 48 years old, formerly of Ravena, New York, now residing in the Greene County hamlet of Coxsackie, just south of Ravena, has all but disappeared from the radar. Hagen didn’t have the decency even to express his condolences to Riley’s family at the death of their son, a death caused or at least contributed to by Hagen. Hagen is even avoiding the insurance investigators in the case. This raises the obvious question of: If you have nothing to hide, nothing to fear, do you go into hiding?

Why are you hiding?

Travis Hagen, 48, was driving a 2007 GMC pick-up truck on State Route 143 at the junction of County Route 106 (Tompkins Road) in front of the Sycamore Country Club. We might ask what Hagen was doing out there in the early evening hours of Friday, July 27, 2018, so far from Coxsackie on a sultry summer’s evening. There’s not a lot out there at that time of day except perhaps some friends and some brews. Informants share with us that Travis does like his brew. More on this later.

Informants also tell us that there is an annual Terrry Hagen Golf Tournament held at the Sycamore County Club, and that the elder Hagen , now dead, was a popular denizen at the country club and an avid golfer. Dots are starting to connect, aren’t they?

Well, the Terry Hagen Memorial Golf Tourny was held at the Sycamore Country Club on August 18, 2018, so it’s reasonable to suggest that Travis Hagen was at the Sycamore Country Club taking care of “business” over a couple of brews, planning or finalizing details of the golf tourny. Sound reasonable to you? Why else would anyone be in that desolate area on a Friday evening? Now, an investigator would certainly have to question the staff at the Sycamore about Hagen’s being there that evening and what he was doing. Doncha think?

One person killed, NO accident reconstruction, and NO police photos taken.

Riley P. “Jeremiah” Kern

The NYS DMV Police Accident Report (MV-104A (6/04) shows the accident to have occurred on July 27, 2018, a Friday, at 6:22 p.m. One person killed, no accident reconstruction, and no police photos taken. That’s a bit irregular. Although our research with the National Weather Service shows that July 27, 2018, was generally sunny/partly cloudy with a high of 86 and a low of 67, there is no mention of weather conditions in the police report. Wouldn’t you think that would be important? Not according to Patrolman Ian Foard of the Coeymans Police Department, the “investigator” at the scene.

Back to the Police Report: In the Accident Description/Officer’s Notes section of the report, Riley’s vehicle is referred to as V1 and Hagen’s vehicle as V2, in the extract of the Police Report below, we are transcribing V1 to Riley and V2 as Hagen . Foard writes:

“Riley was traveling around a curve at high speed and Riley lost control of the vehicle and laid his motorcycle down.[1] Hagen was traveling Northbound [sic] on Route 143 and as Riley came around the curve it (V1 or V2? Riley or Hagen ?) traveled into the Northbound lane in front of Hagen.  Hagen swerved to avoid impact and struck Riley. Riley was ejected and struck the rear driver side of Hagen’s vehicle. Riley’s vehicle traveled under Hagen ’s causing damage to the undercarriage of Hagen s vehicle and eventually ending up behind Hagen ’s vehicle. Riley did pass away from crash-related injuries at Albany Medical Center.”

According to Patrolman Ian Foard, he was the last official to arrive at the accident scene after the EMTs arrived. So where did he get all of this information? Foard’s entry in the form is undated but the report shows that it was “reviewed by” Daniel Contento (acting Police Chief, Coeymans PD) on August 7, 2018, eleven (11) days after the accident, not including the day of the accident! eleven days later. The accident occurred at 6:22 p.m. on July 27, 2018. Riley died at Albany Medical Center shortly after 10 p.m.

Typical cop fashion: Cover me!

Only one “eye witness” is given in the report (we’re withholding that person’s name for now), who was allegedly mowing his “yard” according to Foard. Our visit to the scene would complicate that witness’ claim to having been an “eye witness” because the only property near the scene is to the South and the site of the accident would have been impaired by bushes. But the eye-witness named in the Police Report by Foard and claimed by Foard to have been “mowing his yard” at the time of the accident, is a big problem. You see, the so-called eye-witness lives on Alcove Road — and we are assuming that’s where his “yard” is —, some 4 miles distance from the accident site!

The one eye-witness was, according to Foard, “mowing his yard.” The problem is, his yard is 4 miles away from the accident site!

But that’s the least of the problems with Foard’s very late report. In fact, New York State Vehicle and Traffic Law Article 22, § 605. Report required upon accident reads (in pertinent part):

“(a) 1. Every person operating a motor vehicle, except a police officer (as defined in subdivision thirty-four of section 1.20 of the criminal procedure law ), a correction officer, or a firefighter, operating a police department, a correction department, or fire department vehicle respectively while on duty, if a report has been filed by the owner of such vehicle, which is in any manner involved in an accident, anywhere within the boundaries of this state, in which any person is killed or injured, or in which damage to the property of any one person, including himself, in excess of one thousand dollars is sustained, shall within ten days after such accident, report the matter in writing to the commissioner.”

“2. Failure to report an accident as herein provided or failure to give correctly the information required of him by the commissioner in connection with such report shall be a misdemeanor and shall constitute a ground for suspension or revocation of the operator’s (or chauffeur’s) license or all certificates of registration for any motor vehicle, or of both, of the person failing to make such report as herein required.  In addition, the commissioner may temporarily suspend the driver’s license or permit or certificate of registration of the motor vehicle involved in the accident, or of both, of the person failing to report an accident within the period prescribed in paragraph one of this subdivision, until such report has been filed.  However, no suspension or a revocation shall be made of a license or certificate of registration of any police officer, correction officer, or firefighter involved in an accident while on duty for failure to report such accident within ten days thereof if a report has been filed by the owner of such vehicle.”

“(c) The report required by this section shall be made in such form and number as the commissioner may prescribe.”

The law is clear on the reporting requirement and the time for reporting. In fact, in the next section, it actually states at VTL § 606. Processing of required reports:

“The commissioner [the DMV], when processing reports of accidents filed pursuant to this article, shall give priority to reports involving serious physical injury (as defined in subdivision ten of section 10.00 of the penal law ) or death.”

The investigating officer, when making his report, is an agent of the Department of Motor Vehicles, that is, the “Commissioner” in the laws. Accordingly, if there is serious physical injury or death involved, the officer is to give “priority” to the report. But it took the Coeymans Police Department eleven (11) days just to get the report written and reviewed! No one is going to tell us that the Coeymans Police Department is that overworked and understaffed that it takes 11 days to fill out a form! Incompetence and indifference; criminal obstruction!

Not only is the police report late and in violation of the law, it is incomplete and inaccurate!

First of all, Patrolman Foard and Sgt Daniel Contento apparently can’t read or understand the clear labels on the form. For example, in the section “Vehicle Model” the form actually gives examples, such as “Mustang, Corvette” but Foard (Contento) insert “Motorcycle” for Vehicle 1 (V1, Riley) but “Sierra” for Vehicle 2 (V2, Hagen).

In the “Emergency Medical Services” the form requires times (in military notation; we are converting to conventional time notation here). EMS was  “Notified at 6:24” and “Arrived at the scene at 6:26 p.m.” The form shows that the EMS “Arrived (with Riley) at hospital” at 7:05 p.m. We don’t find those times to be believable.

First of all, any 911 calls go through the Albany County Sheriff’s Dispatch Center in Albany, who then take down the details and relay them to the appropriate First Responders. That alone should take several minutes. Then the First Responders have to get their acts together and get to the scene, which will take another several minutes, at least. But the accident, according to the report happened at 6:22 p.m. If we are to believe the accident report, the accident was reported after the accident occurred, naturally, that is, after 6:22 p.m., the 911 dispatcher contacted the local EMS, who then got all their information and gear, and personnel together and got to the scene at 6:26. That’s in less than 4 minutes!!! Do you believe that?

That raises yet another question: How long did it take anyone to make the 911 call once the accident occurred?

But it took them about 45 minutes to get the dying boy to Albany Medical Center! And that’s assuming the ambulance arrived at the very same moment as the EMS, which is unlikely because they were also busy trying to decide whether to medevac (Lifeline) Riley to the hospital, a decision that fell through the cracks due to “thunderstorms” in the area (Thunderstorms? No mention of these in the National Weather Service reports. Rain, maybe, but no thunderstorms in Albany County on July 27, 2018).

Back to the report: Patrolman Foard writes that the first point of impact on Riley’s motorcycle was at point 11, the left door. We weren’t aware that motorcycles, much less Riley’s bike, had left doors but maybe Patrolman Foard and Sgt Contento know more about this than we do.

Besides, if you are filling out a form, you’d indicate everything you need to indicate, wouldn’t you? It’s all done half-assed, as usual in Coeymans! We’ve always said, ”You pay peanuts, you get monkeys!”

And then you put them in uniforms and hand them guns.


Editor’s Note: New Law in New York: Serious Accidents to Trigger Mandatory Sobriety Tests in New York. The new law expands the responsibilities of police officers who are first responders to the scene of a motor vehicle accident if the collision either caused a serious injury or caused a death. Now, among the responsibilities that police have as they investigate the cause of the accident is a responsibility to assess whether the driver was in violation of state traffic law or not. Under the previous rules related to field sobriety testing, the laws in New York stipulated that it was up to the discretion of the officer to determine if a person should be tested for impairment. The new rule simplifies and streamlines the system and ensures that drivers don’t simple evade the law when a death or a serious injury happens.

According to New York State Senator Pamela Helming, who was one of the bill’s sponsors, indicated that” “Individuals need to be held accountable for their choices, especially when it leads to the death or serious injury of someone else.” Helming also warned: “Eliminating loopholes in the current law that allow drivers under the influence to escape prosecution at the expense of someone else’s life is a start.” With new evidence available to demonstrate intoxication after serious accidents, victims should be better able to pursue claims for compensation against those who caused collisions while drunk. A New York City car accident law firm can provide help to victims in taking action.

The bill was signed into law on December 18, 2017, and went into effect 30 days after signing.


Seems both Foard and the Sycamore Country Club have no clue where they are.

The accident happened on State Route 143 40 ft South of what Foard calls Tompkins Road. The roadway Foard is referring to, apparently, is County Route 106. Tompkins Road is not the roadway’s DOT real designation but is the street name used by locals and the Sycamore Country Club in its address, but then the Sycamore Country Club is located in the hamlet of Coeymans Hollow, not in Ravena! Seems both Foard and the Sycamore Country Club have no clue where they are. Foard can almost be forgiven, being from Mechanicville and given his history (see below, Editor’s Aside].

Annotated Police Report Sketch

The narrative text also states that Riley was “traveling around a curve at high speed.” How does anyone know that as a fact. Foard himself admits that he was the last to arrive on the scene, after the EMS. The eye witness named in the Police Report was “mowing his yard” and lives on Alcove Road. OK. Maybe Foard can explain how a guy mowing his lawn 4 miles away could see the accident? That guy must have one hell of a set of eyes! Or has Foard left something out? What’s your guess?

In the narrative (text) description of the accident, Foard notes that Hagen’s truck sustained “damage to the undercarriage of Hagen’s vehicle” but Foard does not indicate that damage in the diagram! This raises the question of whether Foard was able to crawl under Hagen’s vehicle to inspect it and on what grounds Foard determined the damage to be caused at the time of the accident. We don’t think that a part-time patrolman has that expertise. Do you?

Foard makes an interesting commitment as to the sequence of the events: He writes that Riley “laid his motorcycle down” indicating that Riley was actually in control of his vehicle and took the emergency measure of putting the cycle into a skid to avoid the accident. This in no way would indicate that Riley “lost control of the vehicle” as Foard speculates in his narrative. Foard was not there and given the situation, it’s unlikely that any witness would be able to state with certainly that Riley lost control of his motorcycle.

Foard then writes that Hagen “swerved to avoid impact and struck Riley.” This is the black letter written narrative that likely went through some editing and, if anything had to be changed before or after Contento “reviewed” and passed the report, that something would have been changed. As it now reads, Hagen struck Riley, not the other way around!

In this narrative the sequence continues: Riley was “ejected and struck the rear driver side” of Hagen’s vehicle. According to the damage diagram in the Police Report, Foard indicates in the Damage Codes for Riley’s vehicle: Point of impact 11 (left, driver side door), “Most Damage”: 8 (rear of vehicle), and Foard enters three other damage codes: 14, undercarriage; 5, passenger side door (or right side of vehicle), and 11, driver side door (or left side of vehicle).

Foard indicates Damage Codes for Hagen’s vehicle:  : “Point of impact 1” (left, front headlight/fender), “Most Damage: 8” (rear of vehicle), and Foard enters three other damage codes: “1”, (left, front headlight/fender); “”10”, driver side door (or right side of vehicle), and “12, driver side front panel (or left front side of vehicle). But this doesn’t seem right because the pictures taken by an EMS person do not show Driver-side damage at all!

Nothing in Foard’s report seems to agree. And it was reviewed by acting police chief Sgt Contento, and released to the Department of Motor Vehicles! How embarassing!

When asked about this, the EMS photographer/journalist explained that the only damage he documented was on the passenger door side, a dent, probably from impact (how else would you get a dent like that shown in the image?) When questioned further, the EMS photographer/journalist explained that if there were no damage he would not have photographed it; there was not damage on the left side, the driver’s side, of Hagen’s vehicle, according to this EMS photographer/journalist.

So this information, along with Foard’s statements in the Police Report actually damage any credibility of the Coeymans Police investigation, if there were any investigation at all, and contradict or rule out most of what Foard writes in his report!

Here’s some other information that creams Foard’s report. The manufacturer’s specs for the 2007 GMC Sierra driven by Hagen give a front ground clearance of 9.1 inches. The rear ground clearance for this vehicle is 12.1 inches, or an average of 10.6 inches along the length of the vehicle.

The 2008 Buel motorcycle driven by Riley has a width of about 29” and a length of about 78 inches. Given the condition of the motorcycle as shown in the pictures taken at the accident scene, and given Foard’s report saying that Riley’s motorcycle “struck the rear driver side” of Hagen’s pickup truck” and then “traveled under Hagen’s vehicle[,] causing damage to the undercarriage of Hagen’s vehicle[,] and eventuallyending up behind Hagen’s vehicle.” Given the specs of the two vehicles, you think the cycle would have been a mangled mess. It wasn’t — at least not until Burn’s Towing got their hands on it. (Click the link to view the insurance investigator’s photos.)

True to local scoundrel form, Burns + Sons Auto Repair & AAA Towing in Ravena (2537 US 9W Ravena, NY 12143 ) didn’t waste a minute getting their hands into Riley’s family’s pockets. We have learned that Burns charged the family more than $1800 ($300 for “towing” the motorcycle and $65/day for storage)! Good Lord! The cycle weighs only about 350 lbs and two men could lift it onto a pickup bed! Thank you! Burns & Sons Towing (Ravena) for confirming everything we have ever had to say about local crooks!

This is one of a long series of botched investigations that have become the hallmark of the Coeymans Police Department. It’s not only that they are incompetent and too arrogant to call in real professionals from the Albany County Sheriff’s Department or the New York State Police, their incompetence and arrogance has and is continuing to cause good people a lot of unnecessary suffering. On top of all that, we as taxpayers are paying for this incompetence and abuse! How stupid can it possibly get?!?


Editor’s Aside — Some Notes on Coeymans Patrolman Ian FOARD

It appears part-time Coeymans patrolman Ian FOARD comes to Coeymans from the Mechanicville PD, and he brings a bit of baggage with him.

At the regular meeting of the Mechanicville City Council on Wednesday, February 5, 2014. Mayor Baker and the Mechanicville City Council appointed Ian Foard to the position of full-time desk-officer at a rate of $13.47/h (Resolution #20-14)

According to the official minutes of the Coeymans Town Board Meeting of March 22, 2018 Mr. Foard was appointed to the position of Probationary Part-Time Police Officer effective March 26, 2018. Foard’s appointment was contingent upon Foard’s signing a personal services contract with the Town of Coeymans and his paperwork being filed with the Human Resource Clerk. According to the minutes, Foard would be compensated at the rate designated in the current Collective Bargaining Agreement. (Resolution #063-18). At that same meeting, Sgt Daniel Contento was appointed acting Police Chief (Resolution #062-18).

The Albany Times Union reported on January 25, 2018, that Ian Foard was one of five Mechanicville police department employees who filed a multiple-charge complaint with the Mechanicville Human Resources Officer alleging multiple abuses by Mechanicville Mayor Baker. Foard alleges in the complaint that when Foard was dealing with a personal family matter, Mayor Baker allegedly told Ian Foard, that his father is “disgusting, weird” because he is transgender. Baker allegedly told Foard “every mistake you’ve made was because of your dad.”

The 5-page complaint was filed with the Commissioner of Accounts Kimberly Dunn who acts as the city’s human resource officer and city clerk. It was signed by Police Benevolent Association officers President Alexander Dunn, Vice President Matthew Dunn, Foard, the bargaining unit’s treasurer, and Rabbitt, the union’s secretary. Both Alexander Dunn and Matthew Dunn are the City Clerk’s, Kimberly Dunn’s sons; the rumor is that the Dunn boys were put up to the complaint by momma Dunn, who has her eye on the mayor’s office.

Later, on July 12, 2018, the Albany Times Union reports that the charges against Mayor Baker were dropped, and that Mechanicville Police Chief Police Chief Joseph Waldron “retired,” “retired” usually used to pretty up the fact of “resigned.”

Ian Foard subsequently resigned or was terminated from employment with the City of Mechanicville Police Department and was later hired as a part-time patrolman by the Town of Coeymans.

We have requested information from the City of Mechanicville relating to FOARD’s termination or separation.

[1] Motorcycle accidents involving a laydown by the operator of the motorcycle means that when the motorcyclist experiences a sudden emergency and he decides to lay down the bike rather than collide with another object. Because of the suddenness of the hazard, the rider applies the brakes and the bike slides on its side.

As you may recall, we wrote in a July article, “Three Articles on New Baltimore Scandals: Pick One or Read All,”, asking “Did you know?” about the case of a young man who was involved in a fatal motorcycle-pickup truck accident in Coeymans Hollow. We wrote:

At the time, we were suspicious that the accident didn’t get a single word of coverage on any media, and we asked Why?

Since we published that very small bit of information, we’ve received contacts from people who have read the inconspicuous item and have contacted us with a huge amount of information and many, many questions.

In the meantime, we have received some information on Travis Hagen that points to a cover-up in the case of the young man’s death. At the very minimum, a number of people involved in the investigation of the accident and reporting the so-called “facts” are going to have to answer a lot of very unpleasant questions very soon!

Three Articles on New Baltimore Scandals: Pick One or Read All.

First of all: Were you aware of these little tidbits?

At the January 1, 2018, Organizational Town Board Meeting:

Mr. Jeff Ruso appointed former New BaltimoreTown Supervisor, Nick Dellisanti, to be his deputy supervisor. Dellisanti showed his true colors when he refused to appoint non-party campaign workers to key town positions when he took office; his damning response was, “Republicans appoint Republicans.” Seems that New Baltimore Town Supervisor Jeff Ruso takes it a step further, since Ruso was Dellisanti’s deputy supervisor, “Cronies appoint cronies.” The net effect is that Dellisanti, although he had all sorts of excuses why he didn’t want to run again in 2017, got himself appointed to act as supervisor.  Ruso runs unopposed in New Baltimore and gets “elected” to be Town Supervisor and then he selects Dellisanti to be his deputy. Clever little trick, doncha think? Don’t they call that a dictatorship elsewhere? Single party system, unopposed (s)elections. Padding the panel.

But what really reveals Ruso’s attitude towards his unopposed election to be supervisor are his own words on appointing Dellisanti: “Now the appointment is mine entirely as Town Supervisor,” but Ruso did have the decency to ask the Town Board to ratify his appointment by Resolution. His motion was seconded by his constant sidekick Shelly vanEtten, whose husband also serves on the Planning Board as chairman, and somehow got on the Town Agriculture Committee, indirectly pulls strings on Town committees through his wife, Shelly van Etten, a sitting Town Board Member.

The shyster factor was also confirmed with the re-appointment of Tal Rappelea to be Town Attorney. Rappelea will receive more than $800/month as Town Attorney, generally sitting for about an half-hour next to Ruso or Dellisanti once a month at the regular Town Board meeting, if he even shows up.

New Baltimore Property Taxes: Absolutely No Rhyme, Reason, or Answers!!!

The New Baltimore Board of Assessment Review met on Grievance Day, May 22, 2018, and the Final Tax Roll was published on July 1, 2018.

The Office of the Sole Assessor, currently occupied by Mr. Gordon Bennett (an employee of the Town), and the New Baltimore Board of Assessment Review (all appointees by the current Town board) is representative of the rest of New Baltimore’s dog-and-pony act, their excuse for Town government: Complete Incompetence and Ignorance!!!

Grievance Day is also a dog-and-pony act, where a gang of five appointees sit and demonstrate how ignorant and poorly qualified they are for determining the quality of property assessments in the Town of New Baltimore. The assessor sits by and listens, not contributing much in the way of assisting the poor wretches or preventing them from making complete asses of themselves and taxpayers!

Here’s this year’s tally of stupidity based on documents provided by the Town of New Baltimore and the official taped recordings of the New Baltimore Board of Assessment Reveiw of hearings held on Grievance Day, May 22, 2018, at New Baltimore Town Hall:

Shyster Michael Biscone of Ravena, apparently a bosom buddy of Mr. Bennett, since they are on a first-name basis, even in an official proceeding like Grievance Day, represents two property owners before the Board of Assessment Review, and presents their cases in a rambling fashion, so you have to pay close attention to understand the bottom line on the tapes. [Editor’s Note: For those of our readers, we are providing links to the Greene County online Property Tax Information website, where you can read everything about the properties we’re discussing. It’s all public access. Just click the links in the text below to go to the property information. The link to the main page, where you can search properties by municipality, tax map number, last name, first name, etc. is Greene County Search. ]

The first property is on Roberts Hill Road (565 Roberts Hill Rd, West Coxsackie NY 12192); it’s actually two properties that were once one but was divided in order to sell them. One has a house on it sitting on three acres (Tax Map No. 28.00-2-31.2). The other portion is 37 acres of undeveloped property (Tax Map No. 28.00-2-31.1). Mr. Biscone, on behalf of David Hales, whom he refers to as a “fine young man,” argues that the two properties should be assessed as one. He also admits that Grievance Day is not the place to argue his reasons but he does so anyway. Hales purchased the property in 2017 for $206,000. Bennett assessed the property for $210,000. The New Baltimore Board of Assessment Review, practically no questions asked, reduced Hales’ assessment by $49,000. Why? You’ll never know.

The second property is an interesting case. Again, it’s presented by shyster Biscone and is a property owned by William Brant, who, by the way, gives his address as 72 Brownstone Way, Apt. 410, Englewood, New Jersey (!), and owns the property on US Rt. 9W, between the Best Western and New Baltimore Family Dentistry (Tax Map No. 40.00-4-2.111). He’s had his plan for a for-profit senior living project that has been before the New Baltimore Planning Board for several years now, and has finally gotten approval. If you drive down US Route 9W going South, you’ll come to the Best Western Hotel, and then New Baltimore Family Dentistry. The Brant property is between the hotel and the dentists there’s a cute little cottage sitting in the middle of the field (that’s the Brant property) . In fact, you can see the temporary road leading into the property, where construction preps are being done. Looking towards the back of the property is a small building, a “well house” that is discussed below.

The property is assessed at $120,000 land value, but Biscone somehow convinces the New Baltimore Board of Assessment Review that it’s overassessed at $70,000 because of a “well house.” Biscone argues on behalf of Brant that the “well house cost” Brant only $27,000 but Bennett has assessed it at $70,000. If you’re lost here, don’t worry, it doesn’t make sense unless you listen to the tapes about 3 times. It’s a smoke and mirrors act and works for Biscone and Brant because the BAR buys it and reduces Brant’s assessment by $25,000. You’d think the members of the BAR would have the property tax reports in front of them to follow along but Hey! If they did that they might have smelled a rat and caught it. But that would be asking too much of a bunch of sillies trying to look important.

One tidbit that Biscone drops is that he will “drop off a number of receipts” that would prove what he was saying (not that Michael Biscone was ever concerned with the truth). But he never had to do that because the BAR made their decision to reduce the assessment that evening, on May 22, 2018, without the benefit of any proof or documentation.

What’s even more interesting is the fact that Biscone mentions that one of the contractors, whose receipts he was going to produce, is none other than Robert van Etten, New Baltimore Town Board member Shelly van Etten’s husband. What’s even more interesting is that van Etten, who owns an excavation-construction business located in Ravena, New York (only per the address), is the chairman of the New Baltimore Planning Board (and of the New Baltimore Town Committee on Agriculture)!!! Yes, readers, that’s the same Planning Board that kept Brant’s application in Limbo for several years and only just approved it! Does anyone smell something like conflict of interest here? Corruption? Stupidity?

Does anyone wonder Why? Mr. Brant got his Planning Board approval for his project after so many years of hassle? Just saying …

Case No. 3 is a property owner whose primary residence is in Long Island and who owns a property on North Ridge Road in Hannacroix. 2 acres with a 1 family house on it. Mr. Crimeni, whose primary address is 48 Lace Lane, Westbury, NY, is crying poverty. You see, he thinks his assessment is too high and he’s paying too much in taxes for his weekend country estate, comparing his New Baltimore taxes to his $8,000 Long Island taxes. Crimeni’s property (Tax Map No. 4.00-3-20)  full market value is $195,000 and is assessed at $145,000 but Crimeni is still not satisfied. (There seems to be some confusion also in the tax records because on one page for the same property we find the full market value to be $195,000 and on another page we find that value to be $116,000. It also shows it to be a 1-family house but the house has 0 living space! Maybe there’s an explanation for this?) Anyway, Rocco Crimeni co-owns the property with Nicola Crimeni (apparently his brother) and to listen to their story and compare it to the tax records is like, well, it’s like pure steaming bullshit. The original assessment was on a full market value of $195,000 which was assessed by Bennett at $145,000 for the 2 acres and the house. After the BAR heard Mr. Crimeni’s sad story we find that the assessment for the 2 acres and the house was reduced to a full market value of $119,298, and an assessed value for 2018 of $85,000, total tax bill of $ ??? The final assessment is $85,000, a total reduction of $60,000 !!! Great job, Ms Degnen and company!

Just for kicks and giggles, here are a couple of excerpts from the Crimeni hearing:

Crimeni: There was a trailer on the property and it burned down because of a wood stove we had there.

Crimeni: We purchased an Amish house for $38,000…the Amish people built it…it’s a shell…We’re finishing it ourselves.

Crimeni: We’re not rich people … the disparity in Mr. Bennett’s assessment is tremendous…We have a house on Long Island…and the taxes are $8000…

Degnen: You said it was a shed…[Editor’s Note: Crimeni did not say it was a “shed”, he said it was a “shell”! Degnan makes many such mistakes throughout the hearings. Is she hard of hearing or just demented?]…What are the dimensions?

Crimeni: 26 x 28, 2-story…We don’t have the money to finish it.

Degnen: Are you living there now? [Editor’s Note: Apparently Degnen missed the part where Crimeni says he lives on Long Island. She also hasn’t done her homework or she would know that Crimeni’s primary address is on Lace Lane, Westbury, NY!!!] … Do you have water and electricity? [Again, Degnen, homework? Familiarity with properties?]

BAR Member: Do you have the amounts of houses near you…did you bring the houses near you? [Editor’s Note: Apparently the BAR member is asking if Crimeni has any comparables, that is, information on similar properties in New Baltimore. The BAR member should know she should have these or could get them online in a couple of seconds. We did! In fact, if you go to the Greene County link we provided, enter the tax map number and go to the property page, you’ll be able to see the comparables for the property. Crimeni: We ran out of money…We don’t have no money … We can’t afford this … [Editor’s Note: Here comes the best one: ] … We don’t live up here!

Hi, I’m the village crazy lady, and I’m on the Board of Assessment Review.

Now don’t you just have to sit down and cry hearing a story like Crimeni’s? Well, he apparently tugged at the heart-strings of the BAR because they allowed him a $60,000 reduction in his assessment, no questions asked!!!

For your information, you can find out any information you want on Greene County properties on the Greene County online property tax site, SDG Mate Online, and can search by property tax map number, owner’s name, etc. It’s all public access and available to anyone who is interested. We could go on with the remaining 6 properties that received similar reductions but we’ve made our point. There’s something really wrong in the New Baltimore Assessor’s Office and on the New Baltimore Board of Assessment Review and it needs fixing. We think it’s corruption and collusion because there’s no rhyme, reason, or fair play in these determinations. Here’s why:

Two properties on New Street in the Hamlet have been the subject of a great deal of anxiety and discussion because since late 2016, severe damage was identified. In the one case, runoff from the street caused the collapse of the building foundation, making it unusable. Then Town supervisor Nick Dellisanti (now Deputy Town Supervisor) and then Deputy Town Supervisor Jeff Ruso (now Town Supervisor), together with Town Board member Shelly van Etten, personally inspected the site and identified a number of problems. Two days later Dellisanti, Ruso, and then Highway Superintendent Denis Jordan and Deputy Highway Superintendent Scott van Wormer visited the site and confirmed the same problems. After that the New Baltimore Highway Department created new problems and the Town was served with a number of Notices of Claim for the damage. In 2017, the Highway Department and Callanan paved New Street and created a mess. We won’t go into details here but if you want details go to our article: “New Baltimore Superintendent of Highways and Board to be Sued – AGAIN!

Dellisanti and Ruso’s game was “deny and hide,” handing the matter over to the town’s insurance company and their lawyers. Town Law would allow the town to make out-of-court compensation to the owner subject to the approval of a NYS Supreme Court judge but NO! they’d rather force the already traumatized owner to have to go to court and then to the poorhouse. That’s Republican fair play, apparently. No one in Town Hall wants to admit the wrong done. In fact, Dellisanti’s personal notes of a discussion with then Superintendent Jordan records that Jordan’s response to the resident’s request for a meeting was, “Let them sue us!” Apparently Dellisanti and Ruso agreed.

The owner of the property continued paying his taxes like a good citizen even though he couldn’t use the property and the damage was continuing because the Highway Department didn’t know what they were doing and Dellisanti and Ruso didn’t either – or they didn’t have the balls to go after Jordan directly. So the property owner requested a reduction in taxes on the collapsing building and the other impaired property, and appeared before the New Baltimore Board of Assessment Review with a complete written history of the case and numerous photographs showing the damage.

The problems first began when New Baltimore Sole Assessor refused to provide the members of the Board of Assessment Review with copies of the property owners request saying, “It’s not our responsibility.” But it is his responsibility to provide the BAR with copies of all complaints, it’s in the Real Property Tax Law!!! At the Grievance Day hearing, Gordan handed the four members present ONE copy, his file copy, of the requests for reduction of assessment on two properties. The hearing was a complete mess, confusion, the BAR couldn’t follow the conversation and Degnen kept on saying, “That’s not our problem. You have to go to the Highway Department,” and had to be repeatedly reminded that the information was being provided for background only, so the Board would understand the history of the problem. Degnen just couldn’t get it. The rest of the Board had no idea what the property was.  By the way, New York Real Property Tax Law requires the Board of Assessment Review to be familiar with the properties they are considering. They were not, which was obvious already in the Hales, Brant and Crimeni cases.

The bottom line: The New Baltimore Board of Assessment Review made all their decisions that evening, during the 4 hours they were hearing 11 case presentations, and did not adjourn to reconsider additional information, did not go into executive session to discuss any details of any property, as they should have done, did not request additional information, and refused to inspect the property. They approved 9 out of the 11 cases for reductions of between $12,000-$60,000, properties whose owners simply thought they were being taxed (Hales, Brant, Crimini) but the properties that were damaged and destroyed because of Town of New Baltimore negligence got NO CHANGE!!!

The Town of New Baltimore, the Office of the Assessor, and the Board of Assessment Review refuse to respond to inquiries or to answer communications on the subject. New Baltimore public servants at work, it seems. Any questions? You won’t get answers from Town Supervisor Mr. Jeff Ruso, Deputy Supervisor Nick Dellisanti, Highway Committee member Shelly van Etten, Sole Assessor Mr. Bennett, or Board of Assessment Review Chairperson, Donna Degnen.

The board is made up of five appointees including: Donna Degnan, Linda LeClair, Ronna Smith, Lynn Taylor, and This year, the members of the  Board of Assessment Review, chose Donna Degnen to be the chair. The fifth member, Bernard “Bernie” Jones was absent on Grievance Day.

The members of the BAR receive $200 each, and the chair, Ms Degnen, $250, with an additional $50 per meeting for meetings beyond two meetings. So that came out to about $50.00/hr for each of the members of the BAR for the 4-hour Grievance Day hearings. Degnen received an additional $50.00. Total for Grievance Day circus appearances: at least $1050.00 to give away almost $300,000 in property tax reductions, the majority of which were totally unsubstantiated if you listen to the tapes!

The Board of Assessment Review and the Office of the Sole Assessor are just as indifferent and incompetent as the Office of the Supervisor and the New Baltimore Town Board.

We have obtained the taped recordings of the proceedings of the Grievance Day hearings before the Board and can only say that the bowel sounds in a special ed class would make more sense than what we had to listen to in the tapes. Degnen was dithering and the rest seemed intent on making their presence and importance known by asking irrelevant and generally uninformed questions. None of the four Board members were familiar with any of the properties presented. Just a minute, one member, Linda LeClair, was the only member who showed any interest in the properties and the only member who had personal knowledge of a property. That’s a very poor showing.

But the Board did hear presentations on a total of 11 properties and granted reductions in 9 of them. Two properties, one literally collapsing and unusable and the other defaced by former Highway Superintendent Denis Jordan’s incompetence, were left unchanged, despite comprehensive exhibits and a clearly well-founded presentation. We think that there’s some collusion/conspiracy with the Town of New Baltimore and the BAR to avoid admitting any damage to the two properties, since, if any department or agency of the Town of New Baltimore admits the severe damage to the properties, it will cause havoc in Town Hall. Town Hall has been ignoring the damage and trying to discourage the owner from demanding compensation in their usual way, that is, let their insurance company lawyers make any court case impossibly expensive. That’s New Baltimore Town Hall at work. They ask for residents’ votes and then send them to the poorhouse when something goes wrong and the resident asks the Town to be fair and evenhanded. It’s a lousy system.

Several of the 9 reductions stand out as particularly loathsome and examples of the corruption in small town appointed committees. But first of all, let’s look at some general facts:

The assessments in New Baltimore are done on the basis of the Full Market Value and an Equalization Rate is applied. The Equalization Rate is a percentage that is applied to the Full Market Value to arrive at the assessed value. In New Baltimore this year the ER is 71.25% which means that the assessed value of properties this year is 71.25% of the Full Market Value. That’s legit in our estimation. But that’s were the legitimacy stops cold.

The total value of the properties is divided into two items: the land value and the property value (living area, etc.). The problems start with the Sole Assessor’s, Mr. Bennett’s method for determining the land value, which has absolutely no rhyme or reason and, in Bennett’s own words, the basis for determining the land value is, “Because it’s easier.” “Easier?” Yes, it’s easier to just apply a random value per acre than doing an actual calculation. It’s easier for Bennett.

In the Town of New Baltimore, Bennett has assigned land values to comparable properties as shown in the examples below:

The wide discrepancy in the Sole Assessor’s land values is one example of a huge irregularity.

The chart shows properties that are in the same area of the town, actually the Hamlet, but if you look at the land assessment, compare it to the acreage, and then to the per acre assessment, you’ll see why we are so up in arms about Bennett’s crazy assessments! They just don’t make sense! How can the land value of a property of 0.18 acre be assessed the same amount as a property of 1.03 acres, that is, a land value of $11,000??? Then have a look at the difference in the proportional value (last column) per acre!

A property on S. Main Street in New Baltimore of 0.05 acre (Total assessment: $56,700, Land assessment: $9,600) has a proportional price per acre of $192,000!!! WTF?!?!

We’ve written to Mr. Bennett several times and he refuses to answer. We’ve also complained to New Baltimore Town Supervisor Jeff Ruso about the fact that his employees and appointees refuse to answer inquiries but he’s refused to respond as well. It appears that when New Baltimore officials feel the heat of unpleasant questions, they tend to hide or ignore questions. (See Ruso’s comments regarding the resident’s letter, above.)

What’s even worse is the fact that the Board of Assessment Review was very generous in granting their friends handsome reductions, while denying reductions to touchy properties, like ones that are impaired because of Town incompetence. Here are the results of the Board’s “deliberations”:

The Board’s reductions ranged from $0 – $120,000 but there’s no logic; the stories behind the reductions are, however, very troubling. For example:

Brant is the developer who has the property on 9W, just behind the New Baltimore Family Dentistry buildings. Brant is a developer and has been planning to develop the property to put in some sort of housing project. He’s complaining because he feels his property is being overassessed. So, moneybags Brant pulls on the heart strings of the Board and they give him a reduction in assessment of $25,000.

Another property owner, Spence, is apparently interested in selling the property but wants a reduction in assessment for some reason. So the board hands Spence a reduction of $12,000.

But the worst example we have to offer from our investigations, listening to the hearing tapes, and reviewing the documents produced by the New Baltimore Board of Assessment Review and their determinations is a property owned by a downstater, Mr. Cremini and his partner:

Cremini owns a primary residence in Long Island and 2 acres in New Baltimore, where he and his partner a building a weekend home, which is livable and has electricity and water. Cremini is crying the blues because his assessment is “too” high. He pays about $8,000 in property tax on hi primary residence in Long Island and, convinced the Board that he can’t afford the taxes on his New Baltimore property. So the board reduces his assessment by $60,000!!!! Cremini lives in a primary residence on Long Island, can afford to own more than 2 acres and a house in New Baltimore, cries poverty and the Board reduces his assessment by $60,000!!! Of course, Mr. Bennett agrees.

Another property got a $12,000 reduction. Go figure.

Of course, the Board of Assessment Review doesn’t response to our inquiries regarding the reasoning behind these reductions. But our information comes from the actual tape recordings of the hearings made by the Board, and from the official Order for Change in Assessments and the so-called “minutes” of the Board’s meeting.

Thumbs down AGAIN for Plantet Fitness in Glenmont.

We recently published a scathing article on the Planet Fitness franchise, particularly one local facility in Glenmont, New York. Our research actually showed that what we reported about the Glenmont facility is epidemic in most Planet Fitness locations. It seems it’s a corporate characteristic: incompetent management and staff, poor maintenance, and the majority of members are really not what you want to work out with.

The only judgment-free we can find is that it is free of any good judgment.

We have received another serious complaint about Planet Fitness operations, this one points to serious violations of rights guaranteed and protected by the United States Constitution, that is, freedom of speech and opinion. Seems that if someone at the front desk not doing their job but listening to private conversations can go to management who, without due process of any kind such as discussing a possible problem, simply disciplines a member by terminating their membership. No questions asked. Now that’s Planet Fitness customer care. As we’ve already reported, Planet Fitness is a bottom-feeder among fitness clubs, and is really going to hell in a hand basket if recent observations and reports are accurate. Judging by this contributor’s letter, it’s only getting worse.

Now Planet Fitness staff are eroding protected rights like free speech, and they’re doing it in a discriminatory way without any notion of fairness or due process. If you’re Mr Nice Guy, you’ll be the first to go because you won’t beat the crap out of the [redacted] manager or his [redacted] staff. Right Daniel Boughton.

Planet Fitness – The Constitution-free Zone

Here’s what we just received (it’s a bit long but we thought it was worth reprinting in its entirety):

Dear Smalbany Editor:

Let me start out by saying that I am not easily impressed or shocked. In my professional life I have encountered incredible suffering and incredible stupidity and ignorance but, I must admit, just when you think you’ve seen and heard it all, someone comes up with another masterpiece of idiocy.

Well, I do apologize, since I am writing to the Smalbany blog, a remarkable venue of never-ending-exposure of local stupidity and ignorance, and the suffering it causes. I read your blog and sometimes just have to shake my head, roll my eyes, and offer a fervent prayer that my friends and neighbors in the Ravena-Coeymans-Selkirk communities, and our neighbors in the New Baltimore and Greene County communities, read your stuff and wake up to what’s going on. Before I tell my story, and I hope you will publish it, even if you have to edit some of what I have to say, let me first say Thank you! for your time, energy, interest in our communities, but most of all for your guts in saying what others don’t even dare to think. It’s a terrible shame that our communities have become what they are, and we need people like you and your contributors to help us out of the morass into which we’ve sunken thanks to our apathy and unwillingness to speak up.

Several weeks ago, I read a piece the Smalbany blog published on the Planet Fitness franchise [See our article, “Planet Fitness a.k.a. Planet Failure“. The Editor], and I was appalled at what I read. Appalled because I have personally witnessed and experienced much of what you described. But to think that it is so widespread was what really floored me.

Yes, I am, or was, until today, a so-called Black Card Member. I really don’t know why I stuck with Planet Fitness as long as I had but, like so many of my colleagues and friends who are or were members, the fact that it is the bottom feeder of health and fitness facilities was offset by the fact that it was cheap and was on our way home. Well, that’s what we kept telling ourselves.

The fact is, Planet Fitness is a bottom-feeder. Anyone with any sense will admit that and now that there’s more competition in the Albany area with beautiful new YMCAs in Delmar and Coxsackie, Best Fitness, VENT, and other serous, real gyms and exercise studios, the situation as I have been able to observe over the past couple of years is getting worse at Planet Fitness. Worse in that there seem to be more sociopaths and low-lives than ever. But that may be because Planet Fitness is losing all of their top-shelf members to the YMCAs and to the other, more glamorous competition. So I guess they have to make up for their losses by offering cheaper and cheaper deals and attracting a lower and lower class of member

Your article only scraped the surface of what’s going on at Planet Fitness, though, and you have to be a regular at Planet Fitless to really know how bad it is. Don’t be suckered in by the hype and the marketing garbage. This stuff can’t be made up!

Yes, management, if you can call it management, is substandard. At the Glenmont club the manager is about 30 years old and has been “managing” a PF facility for 12 years. 12 years!!! Doing the same thing, dusting equipment, mopping floors, cleaning out urinals, hiring brainless and immature front-desk personnel, and making lame excuses. Clocks were out for months. Equipment unrepaired for weeks. Urinals not working for weeks. Sink fixtures broken likewise for weeks. But the most irritating experience is the type of people that are becoming the regulars. They have no respect — but what can you expect when the staff has no respect —, no gym etiquette, they’re dirty, and the list goes on.

I’ve recently observed the so-called trainer giving an equipment blitz-tour: a quick explanation of what the piece of equipment is working but I have never seen her tell the new member that after using the eequipment, he or she should wipe it down with a paper towel and some of the sanitizer provided. It’s no wonder that these people use the equipment and leave their residues all over it. They have to be told to wipe off their sweat and dirt but nobody at Planet Fitless tells them!

I’ve also never heard or seen the trainer or any of the other staff telling members to pick up after themselves or to put the weights back where they belong. It’s even more of a mess than what you describe in your article.

Management is incompetent and staff are lazy and indifferent. What’s worse still is that the manager is about as mature as the adolescent minds he hires. I guess it makes him feel more comfortable, sorry soul that he is. I can’t imagine what he thinks of himself but then, it takes all kinds.

Yes, I was shocked today when the Glenmont Planet Fitness manager , Daniel Boughton, called me over as I was leaving the facility. He stood there mumbling a lot of words and I was having trouble discerning what the devil he was going on about. I stopped him and asked, “What is it you’re trying to say?” He responded: “I have to terminate your membership.” To be honest, that wasn’t the worst news I could have been given, since I was only waiting until my current membership ran out and I was going to cancel anyway, investing the money in a YMCA membership, because of the quality of the facilities and the programs. No big deal. He’s terminating my membership so now I don’t have to wait. OK.

But curious me, I had to go one step further and asked him Why? What he told me hit me like a brick. His reason: “You are continuously using foul language.” Are you kidding me? Do you know who you are talking to? He repeated, “You are continuously using foul language with staff and other members.” News to me!

I couldn’t believe my ears but when he repeated what he had said I knew I had heard correctly.

My initial reaction was to ask “What are you talking about? First of all, I’ve never used foul language with your staff or with other members.” But ‘continuously’? That really bothered me.

Mr. Boughton pointed out that a couple of months ago I approached him in an agitated state because of some dangerous activity in the free-weights area and an abusive member. I did mention to Mr. Boughton that the member told me to “F**k myself and go tell the manager.” I did quote the member and I did tell Mr. Boughton that “I don’t have to put up with that kind of sh*t.” Yes. I was upset because I was fed up with the same old same old and Boughton and his staff just hold a love fest at the front desk ignoring everything.

Today, another member, a workout buddy, and I had a chat about a new member slamming weights and leaving weights all over the place. My buddy had already told the guy to stop dropping the weights and making such noise. [Editor’s Note: PF has what is called a “Lunk Alarm” which is a whistle or a siren that is operated from the front desk when a member makes too much “inappropriate noise” in the “Non-judgement [sic] Zone.” But isn’t that a judgement [sic[? Apparently the front desk attendants were to busy love-festing to push a button.] He also told him to put his weights away after using them. He was ignored and so he went to the front desk to get one of the “attendants” to talk to the guy. At about this time, rather than being told again to “f**k myself” by some lowlife, I approached the front desk and also asked that someone talk to the guy. The attendants looked uneasy but when we insisted, one of them, a kid, left his perch and seemed to go over to the unruly member. At that point I said something like “#*($(&(@#!! retard member and the staff is too.” I was not happy with how the staff member responded; it was as if we were bothering him, making him do his job, the snotty brat. Apparently [redacted] attendant was offended and carried the “story” back to Boughton, who decided that I was abusive and “continuously using foul language with staff and other members.”

PF Has It But Staff is Too Lazy to Push the Button!

So what I got for my years of membership and loyalty is an insult and a termination. Oh! And I got handed a scrap piece of paper with Daniel Boughton’s manager’s name and telephone number. Boughton told me if I wanted to discuss the termination I could call Dan Harms, his boss. No thanks! Dealing with one ding-a-ling is enough for one day. [Editor’s Note: Wise decision. We’ve spoken to both Boughton and Harms; you don’t want too much contact with the brainless; it might be contagious.] Besides, I wouldn’t want to interrupt Mr Harms’ urinal fishing.

That was it. My private remark to a like-minded buddy was enough to get my membership terminated. No discussion, no inquiry. Summary termination. Isn’t that illegal on some planets?

I could go on but what’s the use? Planet Fitness is Planet Fitless. It sells memberships whether you use them or not. New members, short-term widgets get dumped on veterans who know how to work out together and make life miserable before disappearing, paying their $10 and some ridiculous monthly pittance.

Your article was over-the-top right. Everything you wrote is true but in reality it’s actually worse.

At this point, after some 5 years a Planet Fitness member, and getting treated like that by the likes of the Glenmont Planet Fitness staff, I’m grateful for the nudge to move on.

People interested in real fitness and professionally managed facilities, management who cares, and members who care about their club and their health and safety would do well to avoid Planet Fitness. Yes it’s cheap but you get what you pay for. Some people will accept that. People with any self-respect won’t.

In fact, I know many local people read your blog and at least my friends who read this blog will know why they are not seeing me any more. Well, that’s another Planet Fitless (we liked that so we’re going to use it) horror story. We’ve edited in some emphasis and some notes and edited out some words but for the most part, we’ve reproduced the letter as sent and received.

Does this sound like a lawsuit in the making to you? We think there’s good lawsuit in this situation and we’ll be happy to research the possibilities for our reader.

There’s a saying that goes “There’s a sucker born every minute.” We guess that at that rate, there will be enough suckers to keep Planet Fitless going for a while but then what? Are you one of those suckers?

Coeymans Police Turning Into Coeymans Gestapo Again?

Is Anyone Supervising the Rookies Turned Loose on Our Streets?

The Coeymans Police are Getting Heavy Handed Again. Get rid of Amanda L. Mueller, she’s bad news! Silly cow wants to be a bully cop!

If you are a local resident and driving through Coeymans, and happen to have a headlight out, wouldn’t you be grateful for a warning from a helpful police officer rather than a ticket right away? Well, forget the helpful patrolman and welcome the Fascist Gestapo back to Coeymans. And just when we thought things might be getting better, the Coeymans Police Department stocks up on ignorant brutes to harass local residents.

Coeymans has a really lousy record when it comes to female law enforcement trainees. Remember Danielle Crosier, she was a real loser, unless she was running police vehicles off the road or onto guardrails. She kept her job for as long as she could by doing deputy chief Kerry Thompson (while he was also doubling as an Albany County Sheriff Department lieutenant). So how’s trainee Amanda L. Mueller, Badge No. 149 keeping her job? She doing one of the Coeymans board members? No, that can’t be. None of the board members has any balls; no balls, no drive.


Two Coeymans police officers stopped the resident for a headlight being out.

Problem is, the Coeymans police, or at least trainee Amanda L. Mueller doesn’t know the difference between a vehicle’s high beams and fog lights. But if Mueller was partnered with another officer, a male officer, who was the senior officer. Certainly not Mueller. And if Mueller was not the senior officer on that patrol, why didn’t the senior officer set her straight? Go figure. Cops, as we all know, stick together.

But we’re a bit confused by Amanda’s ignorance. You see, Amanda Mueller’s father owns Mueller’s Automotive, the automotive repair business on 88 Main Street in Ravena. That’s the same place that services the Coeymans Police Department vehicles. Now isn’t that an interesting coïncidence? As we always say, “Follow the money!” Now, given that fact, wouldn’t you think that sweet little Amanda would know the difference between fog lights and high-beam headlights?  What’s more, might little Amanda’s quick-to-hand-out-tickets behavior be a hint that maybe she’s plugging good ol’ dad’s automotive repair business, one of the only ones in Ravena-Coeymans, and that getting the work done at Mueller Automotive might be the first step to a dismissal of the ticket? Sure, everyone in Ravena-Coeymans knows that Amanda Mueller is a local and who her daddy is!

We see a serious conflict of interest case growing out of this otherwise unfair, but minor incident involving a Coeymans Police Department employee, a local automotive business, a police trainee who is a close relative of that business owner, and the fact that the town of Coeymans, the Coeymans Police Department does business with that trainee’s father’s business. The plot thickens with a little investigation, doesn’t it?

We see a serious conflict of interest in Amanda Mueller’s actions. Corruption, perhaps?


Hint to the Coeymans Police: You need aIl the support you can get from literate, competent residents. (Obviously you’re not getting it from your Twitter tweets!) You mess with the better element in this community and you’ll have more to deal with than just a disgraced town justice and a corrupt town board. If you want community support and good will, and you really need it in these times, you start by being helpful, not abusive. Your trainee Amanda L. Mueller and her partner were abusive to the local resident who happens to be a very upstanding and influential person, who could put most police officers to shame in terms of integrity and ethics.

They say that they’re there to “Serve and Protect.” Has anyone told them that?

Cold-Case Coeymans

They can’t complete a criminal investigation.
They can’t take a criminal complaint.
They’ll ignore evidence and obstruct justice (Right “Detective” Jason Albert”?)

If they do, it’ll go cold and they can close it. CLOSED. UNRESOLVED.
But motorists beware! If you have a headlight out, they’re gonna gitcha!

Someone needs to counsel trainee Amanda /.L. Mueller that as a patrolman, she’s part of the executive branch of government, not the judiciary. She is not out there to make decisions, to judge a resident, and then to punish the resident. That’s the job of the judiciary in observance of the provisions of the Constitution and scrupulous interpretation of law. We doubt Ms. Amanda L. Mueller has the training, education, or brains to do that.

Judge Judy’s Response to Coeymans Cop-trainee A.L. Mueller.

Two Coeymans police officers one female and one male, stopped the resident for a headlight being out.

Problem is, the Coeymans police, or at least trainee Amanda L. Mueller doesn’t know the difference between a vehicle’s high beams and fog lights. But if Mueller was partnered with another officer, a male officer, who was the senior officer. Certainly not Mueller. And if Mueller was not the senior officer on that patrol, why didn’t the senior officer set her straight? Go figure. Cops, as we all know, stick together.

Mueller: “I would have let you off with a warning but because you gave me an attitude about the high beams, I’m going to give you a ticket.”

When they stopped the resident Mueller insisted that the resident “Turn off your high beams.” When the resident responded that the high beams were not on, and he was driving with his fog lights on, Mueller becomes annoyed. Her response to the resident: “I would have let you off with a warning but because you gave me an attitude about the high beams, I’m going to give you a ticket.” Attitude?  ATTITUDE?  The resident was merely stating that his high beams were not on, that his fog lights were on. So she’s wrong and retaliates. Just what we want to see in our law enforcement. Bullying. So, Amanda Mueller doesn ‘t like being wrong and if she is, she’s going to get even. Nice police work. Nice community work.


Editor’s Note: For those of our readers who, like Coeymans Cop-trainee Amanda L. Mueller, don’t know the difference between high-beams and fog lights, we’d like to help you out: When driving in fog or even in wet conditions, or when visibility is poor, the light from regular headlights reflects off water droplets back into your eyes, impairing rather than improving visibility. Fog lights are positioned low on the vehicle and have a wide beam angled toward the ground, which reduces glare and helps you see the road better. (Source: CarId at https://www.carid.com/fog-lights.html, last accessed on 20 December 2017) So, dear readers — and trainee Mueller — there’s a big difference between high-beams and fog lights. 


If Mueller said what she is reported to have said, there will be repercussions

We are going to make our inquiries because we think that all stops must be recorded, audio and/or video. If there’s a recording, one of our editors will be looking for it and will review it. We will obtain a copy of the ticket issued to the resident as soon as possible, and will follow the case. If there is a recording of the interaction during this stop, and if Mueller said what she is reported to have said, there will be repercussions.

Now isn’t that sweet? Mueller doesn’t know high beams from fog lights and when she’s corrected, it becomes “attitude” and then she retaliates. Retaliation is not in the script, Mueller! In fact, you need to be disciplined for your unethical and unlawful conduct. We assume that all of the transaction was recorded? If so, we’ll get a copy. After all, if a warning would have been enough, just because the resident corrects her, she becomes BULLY COP!

Bully Cops Back in Coeymans!

We expect respect and courtesy.

Notice to the Coeymans Police and to Patrolperson Amanda L. Mueller: Get a grip! Loosen up! We don’t like bully cops and we don’t like retaliation. We expect respect and courtesy. If you think your uniform gives you license to abuse and to bully, your ass is going to be grass and you’ll be looking for a job. Probably a job more in line with your lack of skills and stupidity: a greasy spoon waitress.

It’s behavior like Coeymans patrol Amanda L. Mueller, Badge No. 149, that gets our attention. And the Coeymans Police Department does not want our attention. Ask former chief Darlington and some of his lackies.

Maybe we have to get back on the bandwagon. Maybe we should start pushing again to eliminate the Coeymans Police Department. it seems that all they can do is let criminal investigations go cold. But they are getting real good at bullying AGAIN.

We’ll be following developments in this case and from now on we’ll be looking a bit closer at what’s going on in Coeymans law enforcement or more accurately, Bully Patrol.

What say you, Chief McKenna?

We’ve been very fair to the Coeymans PD since Chief Peter J. McKenna took over. We’ve been very fair to Chief McKenna and very supportive. We have always rated Chief McKenna’s programs and efforts very highly. But now we have to step up to the plate and start policing the police again. True, it takes only one rotten apple to spoil the whole bushel, but who’s going to do the damage control? We know the Crandall mob wants total control. What say you, Chief McKenna?

Maybe Patrolman Mueller’s blood sugar was low. Was it that time of the month, Mueller? That may be why she was testy.
