The RCS Sports Association is selling Raffle tickets for something they don’t have: permission to build a new concession stand. Have they done all the preparation necessary to get permission for the stand? Or are they operating illegally again. Is it time to get their non-profit status taken away permanently?

fraudOperating a concession on RCS CSD property, public property, is open to anyone or any organization that satisfies the RCS CSD standard policy for operating a stand or booth on the property. It does not grant monopoly status. Furthermore, the last time we heard, to operate a concession on the school property you had to go through the formal proposal process, provide up-to-date documentation of your organization, your officers, your financial status, your tax status, detailed operation plans, insurance coverage, etc. Our investigations show, at least up to the time of this posting, that none of the above has been done by the District or by the RCS Sports Association. Why not?!?

Based on past RCS Sports Association practices, we’d also like to ask whom the RCS Sports Association is backing in the upcoming elections and whether they are using Association funds to underwrite any campaign. If anyone has that information, we’d appreciate it if you’d let us know.

We have purchased a RCS Sports Association raffle ticket for $20. The tickets are allegedly being sold to raise funds for a new concession stand. Now that we have a ticket in our possession, we need to ask several questions:
 
Our investigations have shown that apparently

  • there has been no public bidding for the 2013-2014 year for any concessions for the RCS school district;
  • the RCS Sports Association does not yet have authorization or approval to construct a new concession stand on RCS school property;
  • the RCS Sports Association has not yet presented a plan to the RCS board of education informing the board of such a plan or the plan has not been publicized for public comment;
  • there has been no public information put out that the RCS Sports Association is authorized to sell raffle tickets impliedly representing or that they have approval and authority to construct a new concession stand, and representing the implied endorsement of the RCS CSD (“implied endorsement” is giving the impression that you have endorsement but really don’t);
  • the RCS Sports Association has apparently not submitted to the RCS CSD or to the RCS board of education architectural or business plans, estimates, etc. for such a project.
  • The RCS Sports Association, although it has no official connection with the RCS CSD and is not endorsed by the RCS CSD, further misrepresents its implied connection and endorsement by misusing the RCS mascot logo on the ticket. Who gave them permission to use the RCS sports teams logo on their association material?

  • And the list goes on!

Isn’t the District procedure to request proposals for such a project or for concession operators? Or has that procedure been waived (= forgotten) for special cases?

Has the RCS Sports Association filed all the necessary paperwork to operate on RCS CSD property, public property? As public property, there is no such thing as favoritism and anyone who can satisfy the requirements, the same requirements applied to the RCS Sports Association, can operate a concession on the school property. Right? So maybe we all should go out and sell raffle tickets for our hotdog stand, or our pizza cart, or our nachos booth! Sounds like a plan if we all operate like the RCS Sports association!

Putting the Cart before the Horse: It looks like the RCS Sports Association, an organization that has no  official relationship with the RCS Central School District and is not an RCS CSD department, is up to its old tricks again. Has the Ravena-Coeymans-Selkirk Central School District again lost control of the arrogant maverick calling itself the RCS Sports Association? Is the RCS district being set up by the RCS Sports Association for another embarassment, another scandal?

We are asking the RCS CSD why this situation exists and is allowed to go on. Haven’t we learned anything in the past about how the RCS Sports Association operates? Has the RCS CSD again lost control of this gang who are not officially associated with the school district yet act like they’re running things?

One of our readers asked about the rules attached to the ticket, so we’re reproducing them here and commenting on them below:

Rules

(1) Winning numbers are determined by the three “3” numbers of the NEW YORK State Evening Pick – 3 Lottery as matched to the number appearing in the box located on each calendar. Each calendar acquired will have a unique 3 – digit number. (2) All cash winnings will be determined by the amount of money indicated on each day of the calendar. (3) All numbers are played straight as drawn. (4) All winners will be paid in a timely fashion. (5) The State of NEW YORK may have bonus days. On those days, the first three “3” digit numbers corresponding to the “Evening Pick – 3 Number” drawn will be honored. (6) The organization will determine each winner from the numbered information sheet completed with the acquisition of each calendar. (7) Each information sheet must be filled out accurately at the time of donation and winnings will be administered by an authorized representative of this organization. This fundraising project is in no way related with the lottery of any state and nothing has been bought or sold. Donations are made and random prizes are selected using an impartial random number generator. The RCS Sports Association Raffle Ticket is a Mass of Contradictions:

 The ticket (see the illustration above) clearly says that the person is making a “$20 donation.” It does not “suggest” a $20.00 donation but states that the donation is $20.00. In other words, if you don’t “donate” $20.00 you can’t participate. This means that the “price” of the ticket is $20 and you are paying for or purchasing a ticket which allows you to participate.  Unless the RCS Sports Association is not making the “donation” optional or accepting any amount for the ticket, the “price” of the ticket is $20.00. In other words, the RCS Sports Association is selling you a ticket allowing you to participate and you are purchasing that right to participate for $20. This logically contradicts Rule No. (7) which reads in pertinent part: “nothing has been bought or sold.” So, having bought a $20 ticket, shouldn’t the RCS Sports Association be collecting sales tax?

Rule (1) seems to be stating that the winning number will be the number drawn by the NYS Evening Pick – 3 drawing. That means that at least 999 tickets have to be sold by the RCS Sports Association to cover the possible numbers drawn on any evening. What it does not say is that if 999 tickets are not sold –  – say only 150 tickets are sold at $20 each to cover the promised “more than $3000” possible in prizes, at least 849 numbers will not match and will have no winners. The odds are very, very slim for your $20 investment. Each calendar has only one unique three – digit number so the odds are still pretty slim. In order to cover all possible numbers between 000 and 999, at least 999 tickets have to be sold.

According to Rule (2), it looks like the RCS Sports Association has budgeted a total of about a maximum of $375 in possible payouts each week. What if they don’t make the sales to cover 8 weeks of possibly $375 obligations per week or more than $3000 in possible payouts? Are they promising more than they can offer? Or is Jena Misuraca going to cover any shortfalls?

Rule 3 is pretty straightforward— we think but we can’t know for certain—, if the numbers 1, 2, and 3 are drawn on a particular day, the holder of unique 3 – digit number 123 is apparently the winner on that day; in other words 321 or 132 etc. will not be paid. What is implied is that there is only one possible winner on each day but then that would not cover the full possible range of 899 possible 3 – digit numbers that could be drawn; if it did, the possible winnings would exceed the total of at least $3000. So the deck is stacked against the buyer of a ticket. To cover the $3000 possible total winnings at least 150 tickets have to be sold at $20 each just to break even. But the deck is stacked because there are 61 days on which only 1 purchaser can win each day. This means that out of the 999 possible numbers drawn, there can be only 61 winners (June has 30 days and July has 31 days  =  61 days x 1 number and 1 drawing per evening). So theoretically, if the barest minimum number tickets (150) are sold to cover the $3000, only 61 persons can win out of 150 total tickets sold and that’s out of a possible total number of 999 possible numbers that can be drawn every evening! The odds are not good, they’re infinitessimally bad!

And the statement “61 Chances to Win” is not only misleading but mathematically inaccurate!

 We loved Rule (4): “All winners will be paid in a timely fashion.” But what exactly does it mean? Paid immediately. In a week? In a month? In a year? “Timely fashion” is a bit vague and ambiguous.

Rule (6) mentions that “The organization will determine each winner from the numbered information sheet completed with the acquisition of each calendar.” Wait a minute. Didn’t we just read that winners are determined by the NYS Lottery Evening Pick-3? What’s the deal now? I don’t recall having provided any information nor having received any information sheet. Normally the numbers on the ticket would be secret until the purchaser scratches the film off. It seems that if there is a “numbered information sheet,” the numbers are not secret. There’s a problem with this, since the winning numbers are not being drawn locally but relying on the New York State Lottery Evening Pick – 3, the sellers of the tickets don’t need to know who has what number.

The rules also state that the “winnings will be administered by an authorized representative of this organization.” (Rule 7). I’m not sure how to understand this statement that “winnings will be administered by an authorized representative” of the RCS Sports Association. If anyone has any clue what this means, please help us. Rule 7 goes on to say that “Donations are made and random prizes are selected using an impartial random number generator.” This cannot be correct. First of all, whether the “donation” is really a donation is questionable. And the donation I made was certainly not made by “an impartial random number generator,” it was made by me, an impartial blog owner! And the prizes are not randomly selected, they are specifically set for each day of each week of the months of June and July, very regularly: Sun. $75, Mon. $40, Tue $40, Wed $40, Thu $40 Fri $40 and Sat $100 ($375 per week). There’s nothing random about the prizes, which are not really prizes, but awards. The RCS Sports Association is talking Double-Dutch, double-talk where I come from!

Another disturbing point is that nowhere on the ticket is the RCS Sports Association clearly identified as being the operator of the so – called “raffle”. Furthermore, nowhere on the ticket is any statement made to the effect that the proceeds from the raffle will be used for the purpose of building a concession stand, much less exclusively for that purpose.

The ticket does not properly notify the purchaser that the RCS Sports Association is allegedly operating as a non – profit organization—Is it a non-profit?—and it does not give the organization’s registration number.

The ticket does not properly notify the purchaser that the claims made on the ticket are indemnified by any kind of insurance, should the RCS Sports Association be unable to make good on its claims.

The ticket lists Jena Misuraca as a contact person and shows some obscure entity called Sports Information Media wwwsportsinformedia.com without any specific or clear statement what Sports Information Media has to do with the so – called raffle. Going to that website we find:

“Sports Information Media provides customized professional-looking printed sports products and is the industry leader in high quality carbonless, multi-part lineup cards and roster cards for any sport. If you don’t see what you want, give us a call and we can make it for you.”

So what exactly has this Sports Information Media company or whatever it is have to do with the alleged concession stand or with the RCS Sports Association. That’s yet another question that needs to be answered.

There are too many contradictions, too many loose ends to satisfy even the most gullible resident in the RCS school district.

Our advice to the RCS Central School District is: Keep you distance from this one and stand by your established policies for proper credentialing of any applicant, complete applications, deliberation, voting  by the board, and public bidding!

Anyone selling raffle tickets in good faith should have the prize or the objective legally in their hands. The RCS Sports Association does not have any of the necessary formalities or paperwork but are selling raffle tickets. This situation is tantamount to selling raffle tickets for a car you don’t own. It’s FRAUD.

In addition to all of the above, how is the RCS Sports Association complying with IRS tax laws relating to the winnings? Who is liable for the tax? There is no statement covering the tax issues on the ticket. Is the $20 donation tax deductable? Is the $20 price for the ticket subject to sales tax? Are the winnings subject to tax? Are the revenues made by the RCS Sports Association being reported propertly? This sounds like a very messy operation, if you ask me!

 We’d like answers to these questions. How about you?

Pundenda-obsessed Dave is merely a tool of the machine; he’s to stupid for anything else and too corrupt and immoral (read: amoral) for any other place. A graduate of the boys’ club called Albany Law School, he’s ethnic, and a West African immigrant, he’s in like flint as the “token” in the in-appearance-only ultra-liberal Albany political machine (when it comes to pandering for votes) as long as he kisses his handler’s mechanically conservative asses (the spirit of Erastus Corning delights). Soares has no self-esteem and no morals so he’ll do just about anything…or anyone. He’s gotten his share of space on this blog, too.

We followed the harassment and conspiracy that was hatched to malign board of education members by the Coeymanazis, no doubt with the assistance of the teachers association and the backing of the New York State United Teachers union, NYSUT.

As residents and citizens started to see the light and the writing on the wall, we moved on to uncovering corruption and the crooks in the RCS communities, most conspicuously the village of Ravena and the town of Coeymans, especially the Coeymans Police Department. There was plenty of scandal to go a long way, and it kept us busy for a year reporting on the truth while the Albany Times Union and its junk journalists concentrated on partisan (read Coeymanazi) low-life scandal reporting, obviously fed rubbish by the local Coeymanazis and their keepers in Albany.

And then there’s Ravena. What would Ravena be without a nest of corruption housed in the village hall. What would Ravena be without a senile ill-tempered godfather in Depend®, mayor John Bruno,  presiding over his court of blathering inbred Bruno, Persico, Biscone, Albano dwarves, the Delucas and the Warrens cowing and bowing to get their carrion-toxic talons into anything of value. We covered their latest larceny: the Bruno-Deluca-Warren Memorial Fitness Center and their feeble and misguided attempts to oust the RCS Community Library so that Cathy Deluca and Nancy Warren could prance and pose in their “own” fitness club–or is it a dairy farm–they “purchased” with Ravena taxpayer money to the tune of $40 grand!

eat-more-brainsYes! We were then and continue to be the bastions of Truth in this community while the Albany Times Union (a.k.a. Times Useless), the Ravena News Herald, and other local rags, including the local television sharks on  News Channel 10, News Channel 6, and News Channel 13 continued their tabloid journalism licking at the stale blood drawn by the Coeymanazi ambushes, and writing award-winning pornographic fiction based (almost) on slightly true facts creatively altered and embellished, but a final version of “facts” a.k.a. factoids. When they weren’t doing the Coeymanazi’s dirty work in print, they were days, even weeks late on the so-called stone-dead-cold “stories”, and stories they were, most of the time following on the heels of articles already posted on this blog. And you pay for the stale pulp fiction reported in that mass of advertising called  the Albany Times Union or that major collection of public notices called the Ravena News Herald. I just don’t get it.

Those of you who have been regular readers and who have signed up for e-mail notification of new articles and comments (You can follow this blog by clicking on FOLLOW ME in the upper right margin and entering your e-mail.)  Are very well-informed about the goings-on beneath the surface on the board of education, in the schools, and in the village and town boards.

More recently we published our observations about the Coeymans town board’s outrageous decision to award MidHudson Cablevision a 15-year exclusive contract for cable and Internet services (read Ravena-Coeymans: The Land of Goofy!) and followed that article with a sequel and update on that shameful betrayal by the Coeymans town board of residents in the town of Coeymans (read Sequel to “Land of Goofy”).

We drew attention to the fanatical and villainous presentation by John Anthony in the recent presentation that totally distorted the doctrine of “sustainable development,” striking fear and anxiety in an already paranoid local population. We tore that stupid propaganda a part in our article, Need More Unconstructive Anxiety?, and cast shame and disgrace on the organizers for having imposed such arrogant and misinformation propaganda on local citizens and voters!

Again, in an idiotic article degrading the pages of the already base Ravena News Herald by Bryan Rowzee that centered on local Coeymanazi building inspector Laverne “Larry” Conrad, while misquoting American poet laureate, Robert Frost, and quoting Laverne Conrad.

You may remember Laverne “Larry” Conrad as  part of the comedy duo, “Laverne and Surly“, who appear regularly on the Coeymans Comedy Channel (MidHudson Cablevision’s public access channel 11), featuring cameos by Tarty Tom Dolan, BoboCop Jerry Deluca, DodoCop Gregory Darlington, Bobo and Dodo doing their ” Wild West Keystone Cops” clown act, the Surly Siblings (Stephen Flack, Thomas “Tom” Dolan of MidHudson Cable fame, Peter Masti, Thomas Boehm, Dawn Rogers) as well as the Juggling Justices Gregory Dardiani and Harold “Hal” Warren who dress up as judges and make a mockery of the law (assisted by evil shyster clowns Gregory Teresi and Michael J. In the meantime, you can continue collecting empty beer cans à la Cathy Deluca to send your kids on school field trips, while she’s posing for mayor Bruno in their “community” fitness center with Nancy Warner–at a cost of more than $40 grand of your tax money, plus their salaries! Now back to the Albany Times Union, Fred Lebrun, and the Sequel to Articles on this blog…

A reader drew our attention to an article that appeared in the Albany Times Union on Sunday, February 24, 2013, and written by Fred Lebrun, a fossil writer for the Albany Times Useless who occasionally pops up with an opinion. The article is entitled: LeBrun: Tax cap denies a ‘sound, basic’ education system and is basically a commentary (now you know how much fact it contains).

We’ll just post a couple of quotes from the article with some short comments, and you can make the rest of the connections and draw your own conclusions.

The governor’s beloved 2 percent tax cap was challenged in a lawsuit filed by the New York State United Teachers union in state Supreme Court in Albany. The suit offers multiple arguments why the tax cap is unconstitutional, asserting that it locks in unequal funding between have- and have-not school districts across the state, ”while pushing many school districts to the brink of educational and financial insolvency,” in the words of NYSUT President Dick Iannuzzi.  Right away, you should see red: our beloved special interest, rape the taxpayer organization, the New York State United Teachers, NYSUT, godparents of our very own teachers union lackey, Matt “the Mutt” Miller, is bringing the suit. Now you know it’s not good news for the taxpayer no matter what Lebrun says. But you must already know what’s coming next: doom, gloom, suspicion, dark days ahead, you’re losing your schools, your children are going to be eaten by aliens, etc. You know, the same-old-same-old whenever NYSUT raises its double-dealing-double-dipping head.

It is irrefutable that the effect of the incomplete tax cap passed in June 2011, while politically popular and a contributor to the governor’s high standing, has been disastrous for school districts and local governments.

That self-destructive attitude and the greed of the teachers union and its members, the teachers, are what’s killing the districts. Millions are being spent on the mismanaged, wasteful money pits we call schools that are turning out idiots at graduation. Why? Because the majority of parents and taxpayers are indifferent and don’t get involved with how their districts are managed or how their elected officials in Albany and Washington are turning their backs on their communities.

Just read some of the articles on this blog and you’ll know too well why our schools and local governments are turning into liquid waste.

Sadly, we are watching a catastrophe unfold that will deeply affect many of our children at their most vulnerable ages, and which will have consequences for the rest of their lives.

The State Education Department has warned that between 100 and 200 school districts will be insolvent within two years.

Lebrun must have been asleep for the last several years! The catastrophe has been unfolding for some time now, Mr Lebrun. We’re right in the epicenter of it. DUH! Yes, Mr Lebrun, we are all aware of that fact but not many of our readers, sadly, have the guts or the balls to open their eyes, tighten their belts, and turn on the lights to see the writing on the wall. Again, read our articles and learn why the schools suck, why the kids are idiots, why the board of education is stymied in getting anything really effective done with the teachers special interests working against them, and why the local communities are drowning in their own raw sewerage with Coeymanazis like the town of Coeymans board, the local Coeymanazi police force, and the Coeymanazis on the street doing everything they can to have it their way or no way. Do you really think that business want to operate in a backwoods, Neanderthal community that is so business-unfriendly, corrupt, or that families want to live like that. The multi-year highway to insolvency for many of them will be already littered with discarded teachers and administrators, dropped programs and advanced placement courses required for college admission, and cuts, cuts and more cuts impacting the core teaching mission.

Look, this didn’t happen over night, people! And it’s not going to get cured over night, either. What Lebrun is writing is crap, to be very honest. He, like so many others, are doing your bloody thinking for your and framing your life according to their views! YOU NEED TO DO YOUR OWN THINKING. BUT FIRST YOU HAVE TO GET BACK TO REALITY!

  • Do you drive your car without replacing the fuel used? Of course not. You’d be stuck in nowhere in no time!
  • Do you drive your car with a flat tire? Of course not, you’d cause more and more damage to the car the longer you drive! What was a small repair now is a major disaster!
  • Do you keep driving at 55 mph when you enter a 30 mph speed zone, even when warned that speed is checked by radar? Of course you don’t. If you did you’d lose your driving privileges in a very short time and be taking a mortgage to pay your fines and super-fines!So why do you drive the economy by taking away without replacing or not making necessary repairs and adjustments? Why do you damage the environment without repairing the damage you cause?

Why do you keep taking from the cookie jar without replacing the cookies and then complain that there are no more cookies? That’s the simplified state of facts. It all starts with Y-O-U!

Yes, the fast track to damnation will be littered with teachers, programs, administrators, advance placement programs. Why? Because they are not working and are costing an arm and a leg. They are NOT WORKING and are killing what does work: You and Me!

Look teachers are nice but they’re out for themselves. To think differently means you have your head in a fog. What the teachers don’t grab to make their lives easier the teachers union will grab for them. Guess who’s going to foot the bill for the $80-120 thousand plus salaries plus enhancements, plus benefits, plus summers off, and some very hefty pensions (after they move out of the district, like former interim superintendent Elizabeth “Betsy” Smith has done after padding her pension!). You and Me!

You’ve been paying for programs and administrators that have been substandard and that’s not only in this district. Sure they have to go! You’d have to go if you did on your job what they manage to do and stay employed! Abusing students. Indifference to student welfare. Bullying students. Having students bully other students. Just being jerks.

And “advance placement programs?” What a load of purest propagandist rubbish! Why isn’t “advanced” the standard like it is in Germany, Japan, Russia? I’ll give you a little hint: because parents like to delude themselves into thinking that little Johnny or Ginny is something special. WAKE UP! They’re far from special and in comparison to students in other countries they’re far below average! Our colleges are crap, too, because they attempt to educate the average who come to the colleges with below average abilities. Why? Because our colleges are not in the business of education…they’re more in the business of doing research for corporations or are in the real estate business! Our kids get advance placement on the international stupids list!

There are plenty of statistics and studies to document just how poorly the American student is doing in comparison with Europe and Asia. It ain’t pretty. Here are just two: Alliance for Excellent Education-Fact Sheet (March 2008), USA Today: In ranking, U.S. students trail global leaders. It’s downright embarrassing! And to think that with a graduation rate in a mid-70% range at the Ravena-Coeymans-Selkirk  Central School District  our per student expenditure is more than $21,000, we should be asking some very hard questions, indeed!

Why is that, parents? Don’t blame it all on the self-serving teachers. The teachers want the same thing you do: cars, houses, money, vacations, time off, etc. Blame it on yourselves for your own greed and indifference to the welfare of your offspring! Try parenting instead of getting more stuff. Try socializing your asocial cave creatures. Try teaching them respect (for others and themselves). Try teaching them how to be members of a community. Try teaching them how to love and be loved (and I don’t mean loving their own stuff or someone else’s–translate “stuff” any way you please). Give them a home not a car to live in. They don’t need A.S.A.P. programs or Teen Centers, they need parents. Real moms and dads!  Need I go on or are you finally catching on.

As for the so-called adults among us: You had a brain at birth but through chronic misuse or unuse it’s gotten a bit screwed up. Maybe you’re reading the Times Union pulp fiction too much, or watching your MidHudson Cable ripoff too long. But you really need to make some corrections in your own lives, in the community, and then you can start on the bigger picture. But first you have to relearn how to use what gray matter might still be left after exposure to the fiction you have been fed by the media, by your leaders, by yourselves.

And the Times Union and the other media can start with themselves or suffer the consequences. The local elected officials who have been screwing you for years have to go. What we need is an ethical print and electronic media system that publishes true facts and less mistake, error and fear. The media and the government is misusing you and misinforming you, controlling you by making you suspicious of others and keeping you anxious and fearful. You actually have control if you’d only take it.

You need to get involved, though. You have to stop leaving it to someone else. That’s not how it works. Or you can stay stuck where you are. It’s your choice.

Of course, the town of Coeymans board members didn’t utter a peep in response. In fact, they should all have been tarred and feathered and run out of town.

But it doesn’t stop there. We, at least did some of the research and obtained some really scary numbers for you neighbors in the town of Coeymans to choke on.

With the cooperation of some interested readers, we found out that MidHudson Cablevision does offer an Internet connection service only for customers who don’t want to use MidHudson’s television offerings. But look at the cost:

  • MidHudson Cable television package includs cable TV and Internet: about $78.00/month
  • MidHudson’s stand-alone cable Internet (Internet only, no TV) connection ( repeat: no TV service): about $73.00/month

So, it looks like there’s no savings at all if you just want an Internet connection only, like most other providers like Time Warner provide at reduced cost. MidHudson Cablevision is going to gouge you no matter what you want, they do it because they can. The town boards of Coeymans (and New Baltimore) have seen to that.

But wait! Maybe the brilliant elected Coeymans town board negotiated special substantial discounts for Coeymans residents owing to the extraordinary 15-year contract. Or did the Coeymans town board negotiate to obtain frozen rates for 5 or 10 years so that residents would not have to face constant increases and added service charges. After all, that would be fair. MidHudson gets a 15-years exclusive concession for providing cable and Internet service, and residents get special rates or frozen rates. Do you think that’s what happened?  Let’s ask. You ask and I’ll ask.

But any report would be incomplete if we didn’t look at speed of service. But that’s kinda difficult if you don’t know how to do the number crunching, because the suppliers, especially Midhudson Cablevision, play the misinformation game here, too! Here are some examples (we’ve converted the megas and the kilos for you):

Time Warner offers the same service, 3 Mb for about $29.99. Midhudson Cablevision offers the same thing to us for $72.95!

Here’s an interesting comparison, too: the average cost for equivalent services costs:

  • in the USA: $47.00/month
  • in South Korea: $38.00/month

Ever wonder why that is? Ever wonder why we’re years behind Europe and Asia with our cell phones and Internet services? Ask your elected officials. Ask them why US Corporations are holding back and why the US government is suppressing cleaner faster services! Think it might have something to do with money and greed?

But the insanity of giving one supplier exclusive rights to the community for 15 years is beyond belief! Looks like no other supplier will ever consider coming to Coeymans or New Baltimore and that means we keep our primitive, second-rate services for a real long time. Now that the Coeymans board has handed the gift of a 15-year exclusive franchise to backwoods MidHudson  no real provider is going to make the investment to come into the area and compete with MidHudson, so we’re dead in the water, folks!

Do you feel like your cable bill is significantly higher than it used to be? That’s probably because it is. According to a recent article published by the Huffington Post, “The average cable TV subscriber pays nearly three times as much for cable now as they did in 2001, according to research by SNL Kagan cited by the Wall Street Journal. The jump in average prices — to about $128 per month from $48.” (Source: Jillian Berman, “Cable Television Bills Have Nearly Tripled In The Past 10 Years,” The Huffington Post, 12/30/11)

And there’s more cable good news for the consumer, thanks to our whore federal government: Under a recent Federal Communications Commission rule change effective Dec. 10, 2012,  millions of television owners who do not currently have a cable box will have to get one for every set, according to public service consumer resource guide Consumer World. Again, according to the Huffington Post:

“[F]or some consumers, that could mean an additional monthly rental fee to access cable down the road.

“The FCC has once again found a way to pick the pockets of cable customers,” Consumer World founder Edgar Dworsky said in a press release.

“Under the FCC’s new rule, local cable TV operators can now scramble their signals, which means a set-top box will be required on every TV to view programs. Those boxes cost around $10 each per month, according to Consumer World.”

So, when I first started following this unheard of suggestion of a 15-year cable services contract for the Ravena-Coeymans area, I couldn’t believe that anyone could or would take such a proposal seriously without negotiating some pretty hefty advantages for the consumers in the Ravena-Coeymans area. Actually, I would even balk at a 5-year contract with the back-woods service provider MidHudson Cable. But a contract with that bunch for 15 years? That is downright stupid.

But then I read in a rather confusedly written item in the Ravena News Herald, “Coeymans renews cable contract,” by Byan Rowzee (February 7, 2013), that even the bleakest estimates of the stupidity of the Coeymans town board can be exceeded! And so it was exceeded when the board renewed a 15-year exclusive contract with MidHudson Cablevision. A sad day indeed for Coeymans residents (especially those wide-assed, potbellied sports fan nacho-gobbling couch potatoes! And the guys, too!)

I and my neighbors have direct personal experience with MidHudson’s disappointing and very expensive cable service, if you can call it service, we receive from MidHudson Cable. Let’s just discuss the notion of “service” in general.

Customer service is not 24/7. If you lose service for any reason, you’re out of luck until MidHudson goes back to work. But they’re ever-ready to sell you a new package of “services” at a price far above say Time Warner.

Their equipment is ancient and frequently failing but they want you to purchase cable television packages bundled with Internet telephone and other Internet services. But these are unreliable given the ancient infrastructure used by MidHudson cable.

Compared to other cable services and television/Internet/phone providers, even disregarding the ancient infrastructure used by MidHudson, their services in this area are shoddy and unreliable. They use above-ground lines and modems which means that you’re out of luck if the lines fail because of storms or icing.

Data transmission speeds and quality are average or below average compared to other providers. Here’s the clincher: if you want to transmit a larger file or transmit at higher speeds, you have to purchase a more expensive plan! Now I’m talking about such small files by today’s standards of say, 3 Mbytes! And if you want to send to more than say 5 e-mail addresses, you’ll have to upgrade! (That’s why we use free services like Google e-mail!).

And read your monthly bill VERY carefully. If you do that you’ll find that MidHudson Cable has the sneaky practice of adding small increases to your services and other fees!

Those are just a few of the reasons why MidHudson should be told either play fair and upgrade their equipment of get out of town! But does the Coeymans town board think that way? Hell NO!

The small minds in these small towns don’t have a clue. They’re too important to think. Besides, if they sell the communities down the river, they are probably getting a Judas payoff.

Why else would your elected officials sell out for 15 years, 15 YEARS to a small, inefficient, below-average provider of a vital service to most of the town of Coeymans residents? If the town of Coeymans has awarded an exclusive franchise to MidHudson Cable for 15 years, the board should be lynched! What that means to this community is that MidHudson has a literal strangle hold on the community in terms of what cable services you, the community will receive, and for how much! You will be at their mercy for 15 years!

An exclusive franchise is a goldmine for MidHudson, because if anyone else–that’s competition–tries to come into the area and provide a service option or alternative for cable users, they’ll either be told by MidHudson to get lost or they’ll have to pay MidHudson off to come in. The town board made a great thing better for MidHudson: they virtually sold Coeymans to MidHudson!

You see, when you sign a contract for most services for an extended period of time, you usually get some added value, some extras, like added services for free or discounts. Maybe I should be asking Mr Thomas “Tom” Dolan, the one who spearheaded the move to accept the 15-year contract, Mr Peter Masti, Ms Dawn Rogers, Mr Thomas Boehm, and town supervisor Stephen Flach these questions:

  • Is the 15-year contract an exclusive franchise?
  • Which other cable services providers were asked to submit a proposal to provide cable services to at least to the town of Coeymans or to the village of Ravena and the hamlet of Coeymans.
  • What future benefits do they expect from MidHudson Cable for the town of Coeymans?
  • How does this deal impact on any other service providers who want to come in and provide competition to MidHudson, and perhaps improve services in the area?
  • What were the economic considerations discussed by the board for allowing MidHudson to have the town of Coeymans as their very own money purse?
  • Did the Coeymans town board negotiate any special discounts for services to residents in the town who now are forced to use MidHudson as their cable provider?
  • Did the Coeymans town board negotiate any special services for the residents in the town who are forced to use MidHudson Cable?
  • Did the Coeymans town board negotiate any rates caps or limitations as part of the contract to prevent MidHudson from continuing their sneaky practice of jacking up rates and adding fees and costs to monthly bills?
  • How much money was paid by MidHudson to the town of Coeymans for the privilege of serving the town of Coeymans?
  • Will the board members who pushed this goofy deal through be willing to make public their MidHudson cable bills for the last six months before the deal and for the next six months? Maybe the public would like to see what board members, especially Mr Tom Dolan, are paying for their cable services.

Wouldn’t you be interested in knowing some of the answers to these questions? I know I would.

We also expect that the Goofies on the New Baltimore Town Board will be next on MidHudson’s Hit List–That is, If New Baltimore’s Goofies Haven’t Been Sucker Punched Yet!

But she did little when she was in the job, now she’s given her notice–after she’s padded her retirement checks with the $140,000 salary she’s ending with–and so she can wait it out another month or two, she’s a shorttimer now. She’ll leave the mess for the next crook who gets hired to the position.

We covered the illicit, delinquent, and illegal conduct of the RCS athletics coaches when they asked students to sell raffle tickets on behalf of the RCS Sports Association (see our article, Raffle, Anyone?). It was clear in that article that there was serious misconduct going on right under Brian Bailey’s and Elizabeth Smith’s noses!  We also published Superintendent Smith’s idiotic response (rather, refusal to respond) to that situation, as well in our article, No Response From District Office, Ms. Smith. It gets worse, still, because when we published our article on our suspicion of illegal money transactions at the National Bank of Coxsackie by the RCS Sports Association, there was still no action taken (see our article More Money Questions…Who’s Cashing the Checks?)

No Answers, Betsy?

So, even after all of that scandalous misconduct, we are still asking why the RCS district offices, the Superintendent, especially, and the Board of Education, too, have not addressed these concerns and put their foot down squarely on the culprits’ necks?!? We’re still asking WHO? is the RCS Sports Association, WHAT? are they doing having the coaches hand out raffle tickets to students to sell, and HOW MUCH? the RCS Bottle Blitz is paying to use school facilities!

We recently obtained a copy of a letter request addressed to Superintendent Elizabeth “Betsy” R. Smith, dated September 11, 2012 and received at the District Offices on September 12, 2012, in which a concerned resident requests information regarding the action taken against the RCS athletics coaches who writes:


“Could you please advise me of the action taken with the coaches that told the students to sell raffle tickets? It is my understanding that this is illegal and the students again were placed in a situtation that gave them no recourse except to do what they were told for fear of reprisal. Also, who is collecting this money, and who and what will these funds be used for? Many community members are very concerned that inappropriate behavior on the part of our teachers/coaches continues and feel it is essential that administration take immediate, legal action against any and all staff who continue to disregard policy and law further damaging the welfare of the students as well as this district’s reputation.

The letter is very clear in that the writer asks specific questions:

  1. What is the action taken with the coaches who unlawfully told students to sell raffle tickets?
  2. Who is collecting the money?
  3. For whom and for what will the funds be used?
  4. The question is also asked impliedly “What action the administration is going to take against any and all staff who disregard policy and law, endangering students and damaging the district’s reputation?”

The questions are pretty clear, aren’t they? You’d expect the Superintendent of schools to be able to read and understand such simple language, wouldn’t you? After all, it’s clear English, and it’s really quite clear and plainly stated, isn’t it?

But the question is nagging: Why doesn’t Superintendent Smith simply answer the questions? She simply refuses to answer our questions or those posed by residents! Why is that, we wonder!?! So, here’s your Superintendent of Schools, Ms Elizabeth “Betsy” R. Smith‘s “answer” to the resident’s written questions:


Thank you for your letter, which I opened today.  [Name Redacted] delivered it to me after our Building, Grounds and Transportation meeting yesterday.   All RCS coaches of fall sports were notified of the law restricting raffle ticket sales to adults 18 and over. 

“Community Organizations and Parent-Teacher Organizations may conduct fund raisers and raffles.  Those organizations can be contacted for information about their fund raisers.

Am I missing something, or what? “Thank you…[Name Redacted] delivered the letter…All RCS coaches…were notified of the law restricting raffle ticket sales to adults 18 and over.” What about the coaches distributing the tickets to students and telling them to sell them? Did you miss that Betsy? Didn’t you understand the question, Betsy? Need your eyes examined, Betsy?

Wot Duhn’t U Understand, Ms Smith?

“Community Organizations and Parent-Teacher Organizations may conduct fund raisers and raffles.” Duh! So what, Betsy? Who cares?
Those organizations can be contacted for information about their fund raisers.” What in hell are you blathering about, Betsy? Have you lost your mind? Who cares? Answer the damned questions, why don’t you?!?

So parents, residents, community members, on September 18, 2012, at the very next board of education meeting, we urge you to press Ms Smith for a more detailed, responsive answer to these questions we’ve raised in our article about the raffle ticket sales (see Raffle, Anyone?), Smith’s command of the English language, and the progress made in getting the required documentation from the RCS Sports Association that verifies their legality.

Who’s Cleaning Up the Money?

We will also be interested in parents, residents, taxpayers, and community members pressing Ms Smith and the Board of Education to know how much the RCS Bottle Blitz was charged for the use of the high school cafeteria on September 14th. As an outside program not affiliated with the RCS school district and not a registered organization of any kind, the RCS Bottle Blitz would be subject to hourly charges for the use of the school property, just like the community sports clubs are being charged. We need to know, How much? Who’s paying for opening and closing the building, the insurance, the utilities, the clean-up, etc.?

So, Superintendent Smith, we have just one last question for you: If YOU, the Superintendent of Schools for this RCS central school district, can’t read and comprehend simple English in a short letter asking very clear and concise questions for the purpose of answering them just as plainly and concisely, how do you intend to convince parents, taxpayers of this district that they are getting what they think they’re paying for.

Also, will you please now answer the questions the resident asked in the above letter. Thank you!

The RCS District RFP Is an Embarassment and a Sham!

When I See a Request for Proposals that is So Poorly Written or Fails To Attract Qualified Applicants Three Thoughts Come to Mind:

1) Either the writer has no idea what s/he’s doing and hasn’t a clue how to write an RFP.
(But what about the business manager the district is paying, shouldn’t she know how to write an effective RFP?)

Or
2) The writer has no intention of attracting qualified applicants and is simply complicating the application process to discourage qualified applicants.
or
3) Both 1) and 2).

Something I’d Expect to Find in the RCS Concessions RFP!

We’ve Received A Copy of A Reader’s Message to the entire RCS board of education and to both the RCS Superintendent of Schools Elizabeth “Betsy” Smith and the RCS CSD business manager, Ms Diane Malecki. Rather than discuss it, it’s actually worth publishing in its entirety. The reader says it all:

Ladies, Gentlemen:
 
 I am forwarding this message to all members of the board with the exception of Howard “Bray” Engel,Edward “Teddy” Reville, and Judy Sylvester, whose e-mail links do not work on the RCS CSD BoE webpage.
 
I have read through the RFP that is available from the RCS CSD website and find it to be a completely substandard document in terms of clarity, composition, wording, pitiful grammar, incorrect terms, vagueness and ambiguousness, and general content.
 
The author appears not to have any knowledge of the purpose and intent of an RFP nor the difference between an RFP and a contract.
 
The document is entirely an amateurish embarassment to the district and anyone who had a hand in its drawing!
 
Quite frankly, the fact that it was released on or about August 9, 2012, and requires receipt of proposals by an express deadline of August 16, 2012, at 11:00 a.m. is absoulutely unrealistic by any standard! Notwithstanding the delays in mailing and returning the proposal by the bidder, the materials could not possibly be properly read and digested, not to mention discussed and questions formulated, in that time. It is ridiculous to expect that all of the required documentation could be assembled and submitted in that short period.
 
The general impression made by the document is that it was ostensibly drawn in haste, and with an with an express purpose of discouraging or rendering impossible any good faith response by any conscientious bidder. I also question whether this was in fact the sole intention of this RFP in order to satisfy one sector of the community while favoring another. This question will likely be brought up at the next BoE meeting.
 
Another troubling aspect of the release of this RFP document is the obvious fact that it was not written by a competent writer and quite clearly was not reviewed by a competent reviewer, much less by a competent business administrator or legal professional or paraprofessional. That fact notwithstanding, it is a gross violation of protocol and of the prerogatives of the board of edcuation that the document was written and released without apparently consulting the BoE. It is my understanding that the BoE should have reviewed the document before its release to the public and, further, that the BoE had final approval or rejection authority over the document. It seems that that protocol was egregiously and perhaps speciously abused and violated. That is another question that will likely be addressed to Mme Superintendent at the next BoE meeting.
Under no circumstances should this call for public bids be considered licit or even legal under the circumstances, and the entire process should be declared null and void, and the RFP recalled until it can be properly done.
 
I am attaching a copy of the RFP that I reviewed. I have included comments in the first 6 pages of the document but the overall quality of the writing and of the document content was so abominable that a thorough or complete commentary on it would have been prohibitive in terms of time and effort. The comments I have made in the first 6 pages are generally characteristic for the rest of the document, however.
 
Should you have any questions regarding this communication, I shall be more than happy to address them on request.
 
One final note: I have communicated on at least two occasions with Mme Superintendant Elizabeth Smith with specific requests and questions. The lead time for her responses is unacceptable. I have not received a single response yet to two previous inquiries.

So what’s the reason you put out such a piece of garbage, Ms Betsy Smith. Is it that you cant write an effective Request for Proposals, or is it more accurate that you intentionally made the process so unwieldy, so complicated, and so burdensome specifically to discourage local businesses from applying. That sounds more like an RCS tactic, doesn’t it. Make it so complicated and burdensome or expensive an no outside buinesses will apply. Then you won’t get any flack whey you simply say no one applied and so now we have to give the concessions to the “new” RCS Athletic Association. Right? Is that it, Betsy?
 
Another reader raises the interesting question of why it would be necessary for a local business to surrender anything to the District. After all, the local business is paying considerable amounts of tax to the benefit of the District and town, is providing a needed and desirable service for the spectators of sports (note: not “sporting”) and athletics events, in virtue of the bidding process are the best value for the money, and in contrast with the RCS Sports Association, are legal and authentic. And on top of that the District wants a cut of the gross proceeds from the concession. Give us all a break and dispense with the greed, Missy!
 
And are we correct in assuming that the “new” RCS Sports/Athletics Association will be held to the same standards as any other bidder? One would reasonably expect so, of course. And that their documents will be available for public inspection.
 
Note also, that this doesn’t let the “old” RCS Sports/Athletics Association off the hook, does it? Or does it, Mme Superintendant? That investigation should be and is ongoing, we would reasonably expect.
 
 
Well, we’ve seen through the trickery and it wasn’t hard at all to do. Are we paying more than $140,000 a year for an amateur? No, two amateurs: the Superintendant and the RCS district school business manager (Diane Malecki)! How much taxpayer money does that add up to?
 

We agree with the recommendation made by the reader: The present RPF is a sham and must be recalled without prejudice, and be reviewed by competent individuals, submitted to the board of education for review, comment, and ultimate approval, and then, ONLY then, be released to the public in a form that is clear, unambiguous, correct, and which makes it possible to respond professionally and in good faith.

Ms Smith, Ms Malecki: You both should be embarassed, chagrined and personally shamed for allowing such a piece of rubbish to have gone out to the public in the first place. We shall be examining the possible motivations and purposes in sending out the RFP in it’s shameful form in yet another article.

One of our regular commentors, Pundit, pointed out some very interesting points, which we’d like to publish on their own, because they’re so on target. Pundit writes in response to our article Bottle Blitz Secret is Out…

Bottle Collection Question:

I wonder if I would be able to obtain a receipt for any deposit bottles and/or cans I leave so that I can use it as a donation write off on my Income Taxes? Not being a Tax authority, I would have to guess that the group collecting the bottles would need to keep track of how much was ‘donated’ for their tax return too.

This stuff can really get sticky.

Actually, it would seem if I gave say $100(2000-Five Cent containers) in deposit containers I would have spent money to purchase the product meaning I would -once again- be giving a portion of my earnings directly to what would need to be a not-for-profit/for profit organization which, in turn is passing it on to the RCS District, meaning I have now transferred $100 more of my money to the District.

It just keeps getting better and better with each passing day!

We responded:

Thank you very much, Pundit, for a very clear and correct analysis of the bottom-line problem we’re dealing with in this case.

You see, you pay the deposit up front when you purchase the beverage, as a pledge to return the can or bottle, at which time you will receive your pledge, the deposit, back. Now, if you give the right to that deposit away, for example, when you make a charitable contribution by giving away your say, 2000 bottles and cans, equivalent to a cash contribution of $100, and the recipient in turn redeems the 2000 bottles and cans for their value of $100 in cash, that becomes revenue or income. In the case where they say they are doing this not for themselves but on behalf of say, a group or organization, what then? Someone has to keep track of the money trail. If you make a charitable donation of $100 wouldn’t you want to be able to deduct that amount from your taxes? But you’d need a receipt to claim that safely.

And the individuals collecting the proceeds, how are they handling the revenue? Are they redeeming the bottles for cash? Do they get a check?

You’re being followed!

Who deposits the check? Into a personal account or into a program account? Who then becomes responsible for the taxable income? If it goes into a personal account or a business account and that business writes out a check to say, the Sports Association or to the School District, does the writer of the check then take advantage of the tax benefit of the “charitable donation” to the SA or the CSD? Does it then become income for the Sports Association or the school district, and if so, is the Sports Association required to keep books and to report the income? (Yes! they are!)

Basic question: Who gets the advantage of using the charitable donation deduction? The people contributing the bottles and cans are certainly not getting any benefits.

Great questions, great analysis, great points, Pundit! Let’s see if we get any answers.

It’s Coming. Are You Ready?

At this point I’d really like to remind all of you disgustingly self-righteous guardians of the public morals that only a couple of months ago you all were fired up, together with that skank-gossip-monger-in-tow Dayelin Roman at the Times Useless, and turned into a veritable lynch mob ready to string up a local businessperson on the board of education for appealing, read APPEALING, his tax assessments. Isn’t it funny that a select group of you are all too ready to forgive the “old” RCS Sports Association and cast a blind eye on the “new” RCS Sports Association (for trying the same unlawful and deceitful tricks), and the DeLuca Bottle Blitz for worse misconduct? Some of you are all too ready to have double standards and that should make the rest of us very uncomfortable. It’s worse still because the RCS Sports Association and the Deluca RCS Bottle Blitz are so publicly visible, and any misconduct by them really has a very bad effect on the community as a whole, but inflicts a really ugly scar on any group claiming to benefit the schools, students, and students’ activities. Organizations like the RCS Sports Association and projects like the RCS Bottle Blitz must be held to an even higher standard than ordinary businesses!

So, Cathy Deluca and your supporters, RCS Sports Association and supporters, RCS loud-mouth coaches, and teachers clique: What are your answers to these questions? They’d better be good!

But wait a minute! Don’t Cathy Deluca and Gerald “Dirty-Hands Jerry” Deluca claim to have several businesses, including the so-called DeLuca Public Affairs (no pun intended!), the Main Street Small Business Coalition, and isn’t old Dirty-Hands Jerry connected with the ARANY (the Automotive Recycling Association of New York) as a “consultant,” (in What? may we ask!), the New York State Assembly, etc? And doesn’t old Dirty-Hands Jerry Deluca claim to work closely, to have an “in” with the NYS Department of Environmental Conservation (the DEC)? Isn’t Edward “Teddy” Reville is the Protective and Marine Coatings Manager for eastern New York, Vermont and western Massachusetts with the Sherwin-Williams Company? Isn’t James Latter an engineer with GE? Aren’t Alice Whalen (retired) and Howard Engel teachers? You’d expect these people to recognize and acknowledge all of the good sense behind RFPs (requests for proposals), insurance, documentation of organization, etc. but why are they opposing all of the businesspersons on the board of education (who are not teachers or married to a teacher) when the board of education calls for it. Whalen, Latter, Reville all voted against it! Why are they opposing the board of education’s demands for proof of organization, lists of officers, proof of tax filing? Shouldn’t they be supporting all of this tooth and claw? What are they hiding, who are they protecting? What’s their agenda? Maybe you should be asking Mrs Deluca, Mr Deluca, Mr Reville, Mr Latter, Ms Whalen, Mr Engel? What’s the deal? What’s your agenda?

And RCS board of education members, how are you going to handle this problem BEFORE it becomes a thorny public concern complete with audits and investigations? Are you going to stand your ground and demand answers, documentation? Are you going to oppose the teachers clique and the easy-sleazy superintendent and demand accountability from any organization dealing with the schools?

That’s why, dear readers, the non-teacher, resident / businesspersons on the RCS Board of Education, Robbins, Lukens, Sylvester, Randy K., Vadney–, are demanding that organizations and anyone claiming to be doing something “for the kids” or for the schools cough up proof that it’s entirely legitimate and legal. Get it now?
