Town of Coeymans and Coeymans Police Department, Coeymans Police Chief Gregory Darlington Hit Hard with a Notice of Claim for Civil Rights Violations, Violating Citizen’s First, Fourth, and Fourteenth Amendment Rights, Criminal Obstruction of Justice and Official Misconduct Charges.

We reported on the village of Ravena’s insane posting of a “No Loitering” sign on a public gazebo and Ravena mayor John Bruno and hatchet-woman Nancy Warner’s harassing of citizens who congregate in or around the public gazebo, especially on nights when the Teen Center is open. Bruno and Warner were actually observed cruising the gazebo at bizarre hours, and the Coeymans police joined in the harassment.

What the village of Ravena didn’t realize and what the Coeymans Police and police chief Gregory Darlington apparently didn’t know but should have is that the village of Ravena so-called no loitering law is 110% unconstitutional and violates citizens’ civil rights and the provisions of the First, Fourth, and Fourteenth Amendments to the United States Constitution that guarantee citzen’s rights of assembly, expression, due process, and prohibit unlawful search and seizure. In fact, the village of Ravena and the Coeymans Police Department actually were courting criminal charges of obstructing justice and official misconduct, according to the Notice of Claim served on the village of Ravena and the town of Coeymans.

Ravena mayor John Bruno and village of Ravena board members Nancy Warner, William Bailey, Martin Case, and Rocco Persico, and town of Coeymans supervisor Stephen Flach and Coeymans board members Peter Masti, Thomas Boehm, Thomas Dolan, and Dawn Rogers were all named in the Notice of Claim, a requirement before filing a full-blown lawsuit against the village and town.

The really troubling part of these harassment and civil rights violation allegations is that at least two of the culprits are employees of the RCS Central School District: Martin Case is a social studies teacher (Of all things, social studies! And he is the biggest hypocrite of them all!) at the high school and Rocco Persico is a school psychologist at the high school. What does that tell you about the types we have in direct contact with the kids? The very people we are paying to teach them in the schools are harassing them in the streets!!! Hypocrites!!! And one of them is “clergy” (of a sort), Coeymans supervisor Stephen Flach and Peter Masti is a R.N. and allegedly a serious “Christian.”  Hypocrites!!!

In fact, Peter Masti writes in a letter to the editor and published in the Times Union (Thursday, September 17, 2009 ):

Where will it stop, this all-powerful government stripping us of our rights in the name of “protecting others”? I do not have the answer, but we will not have to come up with it if we do not let it start at all.

and here’s another Peter Masti quote (Times Union, January 8, 2013):

“When government thinks it is God, it oversteps its role in a most serious manner. It needs to remember that its oath is to uphold the law as it was originally intended.”

Yes, Mr MastiWell it’s there now and now you and your friends will have to fix it. Our question is:  When will you and your fellow board members, the Coeymans Police Department and the Village of Ravena stop stripping us of our rights?!? Can we put action where the words are?

And while we’re at it, lest we be accused of casting a blind eye to clergy who themselves cast a blind eye to the evil right under their noses, let’s not forget the apostate-hypocrite pastor of St Patrick’s Roman Catholic Church in Ravena, the very type of “renewal” priest that Paul VI had in mind when he stated that the “smoke of satan has entered the Church thru a small crack,” (or maybe his holiness meant a small crackpot‘). Rev. James Kane of St Pat’s, among his many, many abuses of rules and liturgy, has made the arch-satan of the Coeymans Police Department, Gerald “Dirty-Hands Jerry” Deluca, a lay minister, and has placed Dirty-Hands Jerry Deluca in the sacred space of the sanctuary as a reader of Holy Scripture during the Catholic liturgy.  This is an incredible sin when you think of how the Christian churches, Protestant and Catholic,  are always preaching and publishing about social justice, human rights, etc.! Holy hypocrisy, Batman!

The Coeymans Police Department and Police Chief Gregory Darlington were also named in the claim because of their cooperation in enforcing the illegal law and for their obstruction of justice, official misconduct, and violation of civil and protected constitutional rights.

The Claim demands payment of at least $1,000,000 in damages or, and this is where it gets interesting, that the village and town make public apologies, publish their apologies together with the apology of the Coeymans police chief in the local official newspapers and, as an alternative to the at least $1,000,000 plus, to make no-strings-attached donations in the amount of $100,000 per year for five years to the Ravena-Coeymans Teen and Youth Activities Center, the non-profit youth services organization that mayor Bruno, councilwoman Nancy Warner and the Coeymans police have been harassing.

The citizen filing the Notice of Claim explains that he is not interested in profiting for himself but the civil rights abuses have to stop. Furthermore, he says, if the village of Ravena can afford to finance an unlawful and fraudulent (our words) Ravena Health and Fitness Center to the tune of $105,000+ a year, a healthclub that excludes persons under the age of 18 years, the very group that the Teen Center takes under its wing, then it can serve justice and fairness by making a gift, a donation to the Teen Center, too. Young people are citizens, too, and should not be excluded from the generosity of taxpayers! We agree 150%.

The second Notice of Claim that was served on the Town of Coeymans is going for the tender parts of the Coeymans Police Department and its incompetent police chief, Gregory Darlington…alleges discriminatory law enforcement, criminal obstruction of justice, and violation of civil and protected constitutional rights.

The Notice of Claim also charges the town of Coeymans, the town of Coeymans supervisor Stephen Flach, and the Coeymans town board and members Peter Masti, Thomas Boehm, Thomas Dolan, and Dawn Rogers aiding and abetting the misconduct in the Coeymans police department and the incompetence of Coeymans police chief Gregory Darlington because the Coeymans town supervisor Flach and board members Masti, Boehm, Dolan, and Rogers have the duty and responsibility of directly supervising Darlington and his band of rabid wolverines. The Notice of Claim specifically names Darlington, Gerald Deluca, Ryan Johnson as examples of the failure of the Coeymans Police Department.

The Notice of Claim also names Coeymans police officer jason Albert for his role in the sham investigation of Cathleen M. Deluca a.k.a. Cathy Deluca, wife of Coeymans Police Department employee, Gerald “Dirty-Hands Jerry” Deluca. Officer Albert seemed to have had trouble reading the law or had some help having trouble reading the law and botched up the investigation not only of the initial complaint against Cathy Deluca, manager of the controversial Ravena Health and Fitness Center, but managed also to overlook the fact that Deluca and her employee Claude A. Wheeles conspired to criminally falsely report an incident (seems to be a local habit in Ravena-Coeymans) , and yet another criminal offence of obstruction of justice! Incredibly, Albert glossed over the facts and even closed the investigation just hours after having interviewed the complainant and then actually ignored evidence proving that Deluca and Wheeles had lied! We have the stuff and it’s unbelievable. But it just goes to prove that it rally pays off in Ravena-Coeymans if you know someone in village or town hall.

Since Coeymans police chief Gregory Darlington’s wife, Leah [sp?] Darlington, works in the Albany County District Attorney P[udenda] David Soares’ office, Could that have a little something to do with the disappearing investigations or the disappearing felonies? Waddaya say, Chiefie? Wifie and you in cohoots to save the Delucas’ bloated arses?

The obstruction of justice charges and official misconduct are both misdemeanors.

But the worst offence to the public is the fact that the Coeymans supervisor Flach and the Coeymans town board and its members  Peter Masti, Thomas Boehm, Thomas Dolan, and Dawn Rogers, elected officials who took oaths of office to support and to protect the constitution have done just the opposite. Because they have failed miserably in their duties and obligations to supervise the Coeymans police chief, Gregory Darlington, and the operations of the Coeymans Police Department, they have indifferently, negligently, and in some cases wilfully violated citizens’ civil rights and protected constitutional rights. While this situation might be the norm in the village of Ravena, we do expect more from the town of Coeymans (Why? We don’t know.)

Gregory Darlington is a public employee, not an elected official, and is subject to the provisions of a job description both as a civil service employee and as a town employee, as well as to periodic evaluation and, if necessary, disciplinary procedures. But the town of Coeymans board has pussy-footed around and has let Darlington have his way in the department everywhere from ignoring blatant abuses, to ignoring employee misconduct, to refusing to communicate with citizens, and has not been held to the minimum standards of his written job description. But he’s being paid more than $90,000 a year out of taxpayer money! And nobody’s watching him or keeping him on the straight and narrow. WTF is going on here, people?!?

According to the citizen filing the Notice of Claim, “I’m just fed up with the favoritism, the dishonesty, the conspicuous double-standards and the abuse in this community. And it really gets my dander up when they go after easy prey like kids or brain-dead druggies and let the real criminals go Scott-free. No pun in intended when you know they let Scott Lendin off the hook! We see the crimes of boardmembers relatives like Tom Dolan’s son [Editor’s Note: Dolan is Coeymans town board member and liaison to the Coeymans Police Department] and Dawn Roger’s daughter [Editor’s Note: Dolan is Coeymans town board member and also town liason officer to the Coeymans P.D.] disappear! When you have friends in the police department, like Scott Lendin claims he has, felonies tend to disappear! That’s just not right! But they’ve f**ked with the wrong citizen now and for the last time! I’m taking no prisoners in this war.” YES! Stick to your guns and fight the good fight!

We hope that some of the citizens in the Ravena-Coeymans community will stand up and join this courageous citizen and join the fight to clean up Ravena-Coeymans and to take back our civil rights!

    I would like to share.

    I don’t live in the town nor do I want to. I have driven through for over 22 years and as soon as I get to the 30 mph marker I slow down and warn others I drive with because I know they are sitting waiting. Again I get it.

    My problem comes in when my son is pulled over for a loud muffler at 9:30 a.m. on 9W. We know that his muffler is loud, and we also know he may get pulled over for it. Just like having tinted windows it’s a ticketing you are willing to accept. The car is completely legal, just passsed inspection a few months ago and is registered and insured to me (mom). After all that, where I don’t agree with the police department is when they tell him his car smells like pot. Again this is 9:30 a.m., he just left me 10 mins prior from Hannacroix, and his car is so small you literally would have to be in it to know if it smelled like pot. He explains “I don’t smoke pot” and you can drug test me if you want. They tell him he needs to get out of the car and he’s asked if he has any weapons on him, which he of course tells the truth that he has a spring-assisted pocket knife in his pocket, and another knife in his glove box, which he purchased recently at the gun show in Albany. Its kind of like having a head light out and not knowing it. My son is a red neck we live in the woods and I can honestly say we use his knife all the time. I always say “can I use your knife”.

    Now he is put in the back of the car to be detained until the police chief decides what to do with him. Oh and he decides to arrest him, put him in cuffs, finger print him, mug shot everything. Hold him for several hours and now go on to tell him he won’t be released until he turns people in for drugs.

    Ok lets back up. They searched him and his car, towed it, etc … never found anything on him or in the car and he was not under the influence whatsoever. He was told to plan on spending the night in jail, and if he gives info up they can pursuade the chief to let him out. They would not let him call home.

    Now let’s understand my son is homeschooled, double dyslexic, ADHD, and his father was killed in a car accident 7 years prior on 9W. He has no record, no knife incidents, and the knives were given to him from his family members.

    I completely understand there is a drug problem in town and I also understand about bad kids out at night ruining other peoples’ property. If he was part of this I would completely understand why he was sitting in jail.

    But when a police officer falsely accuses a young man only to try to get information I am completely disgusted. What are we teaching our young people. I can’t stand a lier, especially grown people.
    Yes pull him over for his muffler, yes give him a ticket, yes take his knives. But to turn it into a drug problem is completely insane. My son is so upset and very confused and I am as well. Our feelings are very hurt and on top of it, I reached out to the police department only to look like a crazy mom. I would have loved to sit down with them to explain both our sides, but also let them know that they can’t just accuse every young kid they pull over.
    Lets not turn good kids into bad kids!!!!!

      Your story is nothing new in Coeymans. They’ve been doing this for some time now and it’s lousy police work and terrible community relations. What that dodo-cop Coeymans police chief Darlington says publicly and does behind the scenes are two different animals. Darlington is a pathological liar and scoundrel. As the Chinese teach, “the fish rots from the head down,” and thats certainly true of the Coeymans police department.

      What we’d like you to do is F.O.I.L. (demand for production of documents under the New York State Freedom of Information Law) the Police Incident Report from the Coeymans Police Department and any other information, including demanding a copy of any video taped interrogation that was done of your son (you can get this on CD for a minimal charge). If they interrogated your son without Mirandizing him and without his having a lawyer present or the opportunity to have one, it gets even more serious.

      You can foil all of the information, the Police Incident Report, the ticket, the arraignment, the interrogation, etc. by filling out a form at the Coeymans town offices, see the town clerk who’s always very helpful. Do not file the F.O.I.L with the police department directly because Darlington has a habit of losing the demands for information. Do it with the Town Clerk and have her enter it into her log and provide you with a copy of the F.O.I.L. form. Under the law, they have to respond within 5 days with a date by which they expect to have the documents ready for you. If they give you any trouble, please contact us at rcs.confidential@gmail.com.

      We’d also like you to let us know when you get the documents and we’d like to have a copy of them.

        We are awaiting my sons court date. I so far have invested into this matter $850.00 for a lawyer and towing. I received a letter back dated April 28 stating that my foil request has been denied.
        Reason: Investigatory Files. I put the claim in on 4/9/14.

        Hi, Stacey:

        We wouldn’t accept that crapola from Darlingon’s Coeymanazi civil rights violation machine. Have you received any disclosure from the Coeymanazi p.d.? Appeal the denial to the Town of Coeymans Supervisor. Your attorney has the authority and power to demand to review any documents (broadly defined, including interviews, incident reports, complaints, search warrants (Now that’s a joke, isn’t it?). A letter to the judge wouldn’t hurt, either. Has your son been charged? Arraigned? He has a right to copies of those documents, too. This sounds like another due process rights violation by the Coeymans p.d. We are not attorneys but even the most ignorant resident can see through this sham of an investigation. Best thing to do is tell your attorney to demand disclosure of everything they have. Please note, however, that the courts do not come under the Freedom of Information Law, so you can’t F.O.I.L. court papers from the court.

        This sounds like you should file a Notice of Claim against the Coeymans p.d. for violation of due process and obstruction of justice. Get all of your paperwork that you have in order, including extraordinary expenses, any loss of income, medical expenses. Be sure to get your doctor to refer you for “psychological stress and duress,” you need some sort of referral to throw in their faces (they’ll ask you specifically about any stress or duress, loss of income, extraordinary expenses so be prepared).

    Though, I don’t live in the town of Coeymans, or the Village of Ravena, anymore….. I can say, I am proud to call Ravena my hometown. My parents owned a business in Ravena, from the Mid 80’s to the mid 90’s, I attended and graduated from the RCS school. With that said, I have a college degree, served 8 years in the U.S. Navy, honorably discharged after 09/11/01 and returned to the area. Now, to have to read this “insulting and degrading” info that you are posting so strongly, makes me sick… [redacted] A true concerned person, would step up, and be an adult. As I am doing, and as I will continue to do, I will read the info, process the facts, research your statements, and say….. [redacted] Obviously, some “people” (whether they are youth or not, I don’t know) can’t have respect for the taxpayer’s money. I, for one, asked myself “what if someone spray painted my deck, or garage, or gazebo? How would I feel?” Which, as an adult, with respect, was an easy answer….. don’t do to others as you wouldn’t want done to you. If MY child was doing questionable activity, I would hope someone would have the courtesy to call or text me, and let me know. I know that Nancy Warner, Greg Darlington, and quite a few of the Coeymans Police are also residents and neighbors. THEY HAVE THE RIGHT to protect the land, people, and property within the village / town…. why? BECAUSE THEY PAY FOR IT! [redacted] Parents need to parent, and keep a leash on their children. The little hoodlums that continue to vandalize the village, will eventually be the recipient of KARMA! I hope I get to drive the KARMA bus, [redacted] feel free to contact me, I’m not scared…..

      Thank you very much for your comment. We are posting it because it represents all that is wrong with our communities, our schools, our universities and colleges, our military, and finally with the people who walk around in a toxic haze and can’t see past their guts.

      Our schools are putting out robots that are programmed but do not think; our universities hand out degrees that are worthy of a Walmart clearance sale, our military has its heroes but you’re not one of them, you are a very special breed of humanoid called a sheeple. One unfortunate part of your deplorable state is that you enjoy being what you are: nothing but a herd animal. The other unfortunate part of your condition is that you wave your ignorance around as if it were something you could be proud of. It’s not.

      We are publishing your idiotic rant because it proves our points so eloquently and represents the sour cream of the crop of ignorant readers–luckily you are in the minority–who admit they don’t live in Ravena or Coeymans yet have an opinion about what’s going on here, even have an opinion about what goes on behind closed doors, and are stupid enough to admit it all, that is, to admit they are ignorant. But we’re being too fair to you Duane R. Keezer II, because we should be saying “stupid” because ignorance can be cured, stupidity cannot.

      Yes we agree, at least in part, on one point: Parents should keep their kids on a short leash–your’s obviously did but it got tangled around your neck and cut off circulation to your brain.

      You would have come across more believable had you not commented in such broad strokes about things you know nothing of. Take your own advice and, Grow Up, Keezer II.

Even for your own public rant? [redacted] For your info, I do own property in the town of Coeymans, [redacted] I have family, still in Coeymans and Ravena, but I choose to live in COXSACKIE, [redacted] Those who have defaced, and lowered the cost of living in, Ravena. It’s absurd articles like the one you originated, that drove me out of the village and town. Back when I thought it was a “no win battle” trying to better the area.         Thank you once again, Keezer II, for your comments. They reveal more of the negative about you and your view of the world than they do of a logical pattern of rational thinking. Again, you provide a feeble attempt to entertain but no attempt whatsoever to illuminate. Your forté is definitely not in persuasive presentation.

        I’d like to correct you on at least one point: This is not a “debate” as you put it. A debate would require at least two parties representing different sides of an issue while attempting to gain the higher ground in virtue of the quality of the facts offered to defeat the other’s position. So far you have not offered any on-topic facts, just ranting. It’s not a debate.

        In your second comment you merely re-establish, redundantly, what you had already established in your first comment, clearly positively reinforcing our initial impression of you. That’s regrettable because you appear to have completely wasted a second opportunity to redeem yourself in the eyes of our readers.

        You seem to have very little insight into who you in fact are: While you rant and rave about name-calling and failure to take into account real facts, your two comments give clear testimony to your own hypocrisy. It may help to look in the mirror once in a while; you may be frightened by what you see.

        The most discouraging and disappointing aspect of both of your comments is that in the first you took up the behaviour, of which you were actually complaining, and in the second round of comments (note the plural) you simply compounded the errors of the first commentary. That’s odd from where I’m sitting and reading because you misused both opportunities to offer a cogent and intelligent support of your case. Because you chose to simply repeat your previous ragged clichés it becomes conspicuously obvious that you really have nothing to offer.

        If you’ll accept an invitation, a challenge if you prefer, why don’t you pick one or two statements made on this blog and take issue with them factually. If you feel some or all of the facts are incorrect or the accusations unfounded, tell us Why? Counter our facts and statements with verifiable facts and statements of your own. That will make you more credible and offer an alternative point of view for our readers.

        There you have it: and invitation or a challenge. With which points do you take issue and what are the factual bases for your defenses, your objections, your arguments? Try to respond on-topic, please, and give us some facts, some documents (take our example, when we received copies of the Notices of Claim we published them–they’re public access so Why not? After all, you wouldn’t expect the village of Ravena or the town of Coeymans to have put them out for the public to examine, would you?).

        I’ll wager we won’t be hearing back from you any time soon. But surprise us, why don’t you? But please be warned that if you persist in your already established pattern of annoying nonsense that is completely off-topic, we’ll have no alternative but to trash the comment(s) without further consideration. We hope you understand our position.

      Thank you, Ronald, for your comment. Actually, Gregory A. Darlington is chief of the Coeymans police department, which covers the entire town of Coeymans, including the village of Ravena. His salary in 2013 is $91,317 plus benefits and pension contributions. For a town with about 8,000 people that’s a hell of a lot of money, I admit, and for what?

      And we shouldn’t forget that the $90,000 plus doesn’t take into consideration his department care and its fuel and upkeep. Then we have the overall budget for the entire Coeymans PD which is an absolute JOKE considering that the Albany County Sheriff’s proposal would have save the town more than $500,000 a year for the first 4 years!!!! How does the town board, this community justify such a waste of money?!?

      The Coeymans Poice Department hires every other department’s refuse or is composed of rookies who can’t even piss straight. Then there’s the part where they hire all their relatives (Darlington’s “assistant” Kerry Tompson is his brother-in-law, Darlington’s daughter is a dispacher as is Thompson’s son, Darlington’s secretary’s son is a “trainee”, and the list goes on).

      Darlington’s not alone in this criminal mess. The town supervisor, Stephen Flach, and the town board are reponsible for “directly supervising” the polce chief and the department. Has that happened? You can guess that the town board’s relatives misdemeanors and felonies wouldn’t disappear so quickly if they came down hard on the Coeymans PD. So who bears the brunt of the enforcement actions and vindictive justice? You guessed it: the rest of us.

      The Coeymans PD has to go and so do the members of the town board. Some of them have to go to jail, actually, like Deluca.

      We’re doing what we can to clean things up, and we’re getting the citizens’ attention.

      Yes, I suppose but even using the bulldog on a motorcycle is tantamount to animal abuse when captioning it “Coeymans Police Chief.” The problem I have with using a “pig” is that the scientific research indicates that pigs are actually extremely intelligent. That alone would be misleading, given the obvious mental level of the typical Coeymans cop, expecially their “chief.”
